PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4B, requires a side yard of not less than 10 feet that adjoins living area. Public purpose served by this requirement is to maintain a minimum of 20 feet between living areas in adjacent structures and 15 feet between garages and living areas in adjacent structures to reduce exposure to conflagration of fire. It is also to allow for aesthetically pleasing open areas around residential structures. B. STATED HARDSHIP: "We need the variance to line up the addition with the existing structure. If we moved the addition over, our door would lead into the storage room rather than the fimily room. If the addition was 10 feet from the lot line, it would make the bedroom addition 7 to 8 feet wide. We don't want to cover any existing bedroom windows." C. ADMINISTRATIVE STAFF REVIEW: The south portion of the proposed addition will be approximately 8 feet away from the detached garage on the adjoining lot addressed as 100 Logan Parkway. The Building Code requires a minimum of 6 feet. If the Board should recommend approval of this request, the staff has no recommended stipulations to offer. AD1,11NISTP.ATIVE STAFF REVIEW: The lot to the north of the petitioners is 171 feet in width. The structures on this adjacent lot are located to the -north. It appears then that the petitioner might purchase the 3.5 .feet from the neighbor and if that was done, then no variance would be necessary. The other alternative would be to place a small detached structure in the rear yard for the boat. Chairwoman Schnabel stated that she did not think a good alternative was the detached structure and Mr. Backlund.said it would have to be built up a bit and there would be a drainage problem with a detached structure. Mrs. Gabel asked how much distance there is between the two structures and Mr. Wiens said he thought it was about 70 feet. Mr. Clark stated that Mr. Wiens has enough land to sell oc.S an 80 foot buildable site. Chairwoman Schnable asked Mr.* Wiens about selling additional land. Mr. Wiens stated that he would rather Mr. Backlund build up to the lot line than sell any additional land He said he thought about selling at one time but changed his mind. Chairwoman Schnabel stated that, if the approval is granted, it would have to be a fire wall with no windows or doors and the overhang contained within the property. Mr. Backlund stated that there is not a large overhang on the house and the siding of the addition would be the same as the house siding. Chairwoman Schnabel expressed concern over any angling of the addition which would bring it closer to the garage next door. Mr. Clark said he measured between the garages and there would be $ feet between the two structures. Chairwom Schnabel asked about fire situationa and Mr. Clark said there are no problems as far as the building code is concerned and there are no openings on the side -of -the neighbors garage. Chairwoman Schnabel asked Mr. Doty if he has talked to his neighbors and if he would be doing the work himself. Mr.'Doty said he has spoken to his neighbors, told them of the dimensions, and there is not a problem. He further said he will be doing the work himself. Mr. Hall, a neighbor from across the.- street, said he does not have any objections to what Mr. Doty is doing but he has objections to what neighbors along side of him may be doing. Mr. Clark said they haven't heard an1thing from those neighbors and Chairwoman Schnabel informed him that if his neighbors decide to do something he will have a chance to object at that meeting. Mr. Barna felt that a possibility exists for Mr. Doty to do what he wants without having a variance and still leaving him with his bedroom windows. He further stated that he was uncomfortable with the living area that close to the garage and the one bedroom so far away from the other bedrooms. Chairwoman Schnabel said that they cannot base a decision on that, they are just dealing with footage. 'Mr. Doty said the garage is strictly sealed off. MOTION by Nuts.
