MOTION by Mr. Jones, seconded by Ms. Jackson, to approve the October 9, 2002, Appeals
Commission meeting minutes as presented.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON VOS DECLARED THE
MOTION CARRIED UNANIMOUSLY.
1. PUBLIC HEARING: VARIANCE REQUEST. VAR #02-19. BY ROBERT JOHNSON:
Per Section 205.07.03.D.(2).(a) of the Fridley Zoning Code, to reduce the side yard
setback for living area from 10 feet to 5 feet to allow the existing garage to be converted
into living space on Lot 23, Block 1, Oak Creek Addition, generally located at 130 Logan
Parkway.
MOTION by Mr. Jones, seconded by Ms. Jackson, to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON VOS DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:32 P.M.
Ms. Stromberg stated the petitioner is requesting a variance to reduce the side year setback
from 10 feet to 5 feet to convert his existing garage into living area at his residence at 130
Logan Parkway. The summary of hardship submitted by the petitioner states: "Need more
living space and garage is too small. Convert existing garage into master bedroom suite and
build a new garage. Need variance because existing garage is 5 feet from the lot line instead of
the required 10."
Ms. Stromberg stated the property is zoned R-1, Single Family, as are all surrounding
properties. The existing home and garage were built in 1954. City Code requires a 10 -foot side
yard setback between living area and the side yard property lines. The City Code also requires
a 5 -foot side yard setback between an attached accessory building and a side yard property
line. The existing garage meets the 5 -foot side yard setback; however, converting the existing

garage into living space would require a variance to reduce the side yard setback from 10 feet
to 5 feet. The petitioner also plans to construct a 40' by 24' detached garage in the rear yard of
his property.
Ms. Stromberg stated City staff has no recommendation as similar variances have been granted
in the past. Similar variances granted were: VAR #00-23 at 369 Hugo Street to reduce the side
yard setback from 10 feet to 5 feet to construct a home addition and VAR #98-05 at 150
Talmadge Way, to reduce the side yard setback from 10 feet to 4.4 feet to construct a home
addition.
Ms. Stromberg stated that if the variance is approved, staff recommends the following
stipulations:
1. The petitioner shall obtain a building permit for the conversion of the existing
garage prior to obtaining a building permit for the construction of the proposed
garage.
2. The petitioner shall install a Code -required hard surface driveway within 12
months of issuance of a building permit.
3. The existing driveway shall be removed and resodded upon completion of the
proposed garage.
4. The garage shall be architecturally compatible with the existing home and
finished with complementary siding and color scheme.
5. All vehicles shall be stored on a hard surface driveway as approved by the City.
6. The garage shall not be used for a home occupation or living area.
Ms. Jackson asked whether it was true that a variance was not required for the proposed
garage.
Ms. Stromberg stated, yes, no variance was required for the proposed garage.
Dr. Vos asked whether anything needs to be done on the east wall where the variance request
is because it is converting from a garage to part of the house — is there any kind of fire code
issue or anything that has to be different on that wall?
Ms. Stromberg stated there was nothing that she was aware of.
Mr. Jones asked if the petitioner is moving the driveway, does that mean he has to cut away the
curb?
Ms. Stromberg stated that according to Jon Haukaas, Public Works Director, the City will be
redoing that street within four to five years and, at that time, the curbing would be redone so the
petitioner does not have to fill in the existing curb at this time. However, a new curb cut will be
needed for the proposed garage.
Mr. Robert Johnson, 130 Logan Parkway, stated that regarding the first stipulation of doing the
garage first, he would like to do the project simultaneously because he is going to use the new
overhead door and windows on the garage.
Dr. Vos inquired if there was a time line for obtaining the building permit.

Ms. Stromberg stated they put the stipulation in because if the petitioner builds his second
garage before he converts the existing garage, he then would need a special use permit. That
is the reason for that stipulation; however, he could work on them simultaneously. So, if Mr.
Johnson pulled both permits at the same time, that would be okay.
Mr. Johnson stated that on the proposed garage, he has a setback of 3 1/2 feet on the east
side, and he is going to move that down another 5 feet because there are pine trees there.
Dr. Vos asked staff how close the garage can be legally.
Ms. Stromberg replied it can be 3 feet.
Dan Burkhalter, 144 Logan Parkway, the next door neighbor on the proposed garage side,
stated he owns the trees there. He just heard the petitioner wants to move it another five feet
which makes him a lot happier; however, his other concern is there are very large cottonwood
trees where the petitioner is putting the garage. Those trees are going to cause problems for the
petitioner and himself. He stated if there is a storm, branches are going to fall on the petitioner's
roof. He is very concerned about that. These trees have been here for 50 years.
Mr. Burkhalter replied the way it is laid out right now, the back garage will always be right up
against the big cottonwood trees. He would like to see that tree removed. It is very oversized
already and it's not going to get better.
Dr. Vos replied that may be something Mr. Burkhalter should talk to the Mr. Johnson about. He
asked if Mr. Burkhalter had any problems with having the garage converted into a living space
per the variance request.
Mr. Burkhalter stated he had no objections to the variance, but he knew once this variance is
requested, the new garage will be started so he wanted to comment now. The way it sits the
petitioner's cars will be parked right outside his bedroom window, and he's not very happy with
that.
Dr. Vos stated Mr. Burkhalter may want to discuss this with the petitioner.
MOTION by Mr. Jones, seconded by Ms. Jackson, to close the hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON VOS STATED THE
PUBLIC HEARING CLOSED AT 7:43 P.M.
Mr. Jones stated he did not see a problem with the variance proposal to make the living space
out of the garage and granting the variance changing the setback for the living space. He
understands the issue of the garage and the trees, and it sounds like they already made some
progress on that. The variance is separate from that anyway. He stated he would vote in favor
of the variance and asked Ms. Stromberg whether staff has heard anything else from any other
neighbors.
Ms. Stromberg replied, no, they have not.
Ms. Jackson stated she agreed with the variance proposal. The petitioner could put the
proposed garage where he originally planned; and since he is going to try and move it the

garage over, that would help and maybe he could not have his cars outside the bedroom
window because of the new garage.
Mr. Jones asked if the petitioner could put that garage there right now?
Ms. Stromberg replied the petitioner would need a special use permit to put another garage up.
Dr. Vos stated he agreed with the petitioner and that the neighbor on the other side is not going
to see any difference in the wall, it will still be 5 feet away, there will be somebody on the other
side rather than a car. It really does not have an impact on that neighbor.

REQUEST
Petitioner, Robert Johnson, is seeking a variance to reduce the side yard setback from
10 feet to 5 feet to convert the existing garage into living space at his residence at 130
Logan Parkway.
SUMMARY OF HARDSHIP
"Need more living space and garage is too small. Convert existing garage into master
bedroom suite and build a new garage. Need variance because existing garage is 5
feet from the lot line instead of the required 10 feet."

ANALYSIS AND CODE REQUIREMENTS
The property is zoned R-1, Single Family as are all surrounding properties. The
property is located on the south portion of Logan Parkway directly west of East River
Road. The lot is rectangular shaped and fronts on Logan Parkway. The existing home
and garage were built in 1954.
Existing Home
City Code requires a 10 -foot side yard setback between living area and the side yard
property lines. City Code also requires a 5 -foot side yard setback between an attached
accessory building and a side yard property line. The existing garage meets the 5 -foot
side yard setback requirement. However, the petitioner plans to convert the existing
garage into living space, which requires a variance to reduce the side yard setback from
10 feet to 5 feet.
The petitioner also plans to construct a 40 foot by 24 foot detached garage in the rear
yard of his property. City staff has received no comments from neighboring property
owners.

Ms. Stromberg stated the petitioner is requesting a variance to reduce the side year setback
from 10 feet to 5 feet to convert his existing garage into living area at his residence at 130
Logan Parkway. The summary of hardship submitted by the petitioner states: "Need more
living space and garage is too small. Convert existing garage into master bedroom suite and
build a new garage. Need variance because existing garage is 5 feet from the lot line instead of
the required 10."
Ms. Stromberg stated the property is zoned R-1, Single Family, as are all surrounding

Ms. Stromberg stated that if the variance is approved, staff recommends the following
stipulations:

garage prior to obtaining a building permit for the construction of the proposed
garage.
2. The petitioner shall install a Code -required hard surface driveway within 12

Ms. Jackson asked whether it was true that a variance was not required for the proposed
garage.
Ms. Stromberg stated, yes, no variance was required for the proposed garage.
Dr. Vos asked whether anything needs to be done on the east wall where the variance request
is because it is converting from a garage to part of the house -- is there any kind of fire code
issue or anything that has to be different on that wall?
Ms. Stromberg stated there was nothing that she was aware of.
Mr. Jones asked if the petitioner is moving the driveway, does that mean he has to cut away the
curb?
Ms. Stromberg stated that according to Jon Haukaas, Public Works Director, the City will be
redoing that street within four to five years and, at that time, the curbing would be redone so the
petitioner does not have to fill in the existing curb at this time. However, a new curb cut will be
needed for the proposed garage.
Mr. Robert Johnson, 130 Logan Parkway, stated that regarding the first stipulation of doing the
garage first, he would like to do the project simultaneously because he is going to use the new
overhead door and windows on the garage.
Dr. Vos inquired if there was a time line for obtaining the building permit.

Ms. Stromberg stated they put the stipulation in because if the petitioner builds his second
garage before he converts the existing garage, he then would need a special use permit. That
is the reason for that stipulation; however, he could work on them simultaneously. So, if Mr.
Johnson pulled both permits at the same time, that would be okay.
Mr. Johnson stated that on the proposed garage, he has a setback of 3 1/2 feet on the east
side, and he is going to move that down another 5 feet because there are pine trees there.
Dr. Vos asked staff how close the garage can be legally.
Ms. Stromberg replied it can be 3 feet.
Dan Burkhalter, 144 Logan Parkway, the next door neighbor on the proposed garage side,
stated he owns the trees there. He just heard the petitioner wants to move it another five feet
which makes him a lot happier; however, his other concern is there are very large cottonwood
trees where the petitioner is putting the garage. Those trees are going to cause problems for the
petitioner and himself. He stated if there is a storm, branches are going to fall on the petitioner's
roof. He is very concerned about that. These trees have been here for 50 years.
Mr. Burkhalter replied the way it is laid out right now, the back garage will always be right up
against the big cottonwood trees. He would like to see that tree removed. It is very oversized
already and it's not going to get better.
Dr. Vos replied that may be something Mr. Burkhalter should talk to the Mr. Johnson about. He
asked if Mr. Burkhalter had any problems with having the garage converted into a living space
per the variance request.
Mr. Burkhalter stated he had no objections to the variance, but he knew once this variance is
requested, the new garage will be started so he wanted to comment now. The way it sits the
petitioner's cars will be parked right outside his bedroom window, and he's not very happy with
that.
Dr. Vos stated Mr. Burkhalter may want to discuss this with the petitioner.
MOTION by Mr. Jones, seconded by Ms. Jackson, to close the hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON VOS STATED THE
PUBLIC HEARING CLOSED AT 7:43 P.M.
Mr. Jones stated he did not see a problem with the variance proposal to make the living space
out of the garage and granting the variance changing the setback for the living space. He
understands the issue of the garage and the trees, and it sounds like they already made some
progress on that. The variance is separate from that anyway. He stated he would vote in favor
of the variance and asked Ms. Stromberg whether staff has heard anything else from any other
neighbors.
Ms. Stromberg replied, no, they have not.
Ms. Jackson stated she agreed with the variance proposal. The petitioner could put the
proposed garage where he originally planned; and since he is going to try and move it the

garage over, that would help and maybe he could not have his cars outside the bedroom
window because of the new garage.
Mr. Jones asked if the petitioner could put that garage there right now?
Ms. Stromberg replied the petitioner would need a special use permit to put another garage up.
Dr. Vos stated he agreed with the petitioner and that the neighbor on the other side is not going
to see any difference in the wall, it will still be 5 feet away, there will be somebody on the other
side rather than a car. It really does not have an impact on that neighbor.

with the following stipulations.

REQUEST
Petitioner, Robert Johnson, is seeking a variance to reduce the side yard setback from
10 feet to 5 feet to convert the existing garage into living space at his residence at 130
Logan Parkway.
SUMMARY OF HARDSHIP
"Need more living space and garage is too small. Convert existing garage into master
bedroom suit and build a new garage. Need variance because existing garage is 5 feet
from the lot line instead of the required 10 feet."

ANALYSIS AND CODE REQUIREMENTS
The property is zoned R-1, Single Family as are all surrounding properties. The
property is located on the south portion of Logan Parkway directly west of East River
Road. The lot is rectangular shaped and fronts on Logan Parkway. The existing home
and garage were built in 1954.
Existing Home
City Code requires a 10 -foot side yard setback between living area and the side yard
property lines. City Code also requires a 5 -foot side yard setback between an attached
accessory building and a side yard property line. The existing garage meets the 5 -foot
side yard setback requirement. However, the petitioner plans to convert the existing
garage into living space, which requires a variance to reduce the side yard setback from
10 feet to 5 feet.
The petitioner also plans to construct a 40 foot by 24 foot detached garage in the rear
yard of his property. City staff has received no comments from neighboring property
owners.

issuance of a building permit.
3. Existing driveway to be removed and resodded upon completion of proposed
garage.
4. The garage shall be architecturally compatible with the existing home and finished
with complementary siding and color scheme.
5. All vehicles shall be stored on a hard surface driveway as approved by the City.
6. The garage shall not be used for a home occupation or living area.

Dear Mr. Johnson:
As you will recall, on October 23, 2002, the Fridley Appeals Commission
approved your variance request to reduce the side yard setback for living area
from 10 feet to 5 feet to convert the existing garage into living space. At this
time, we would like to reiterate the stipulations that were placed on the
approval of your variance, VAR #02-18.
1. The petitioner shall obtain a building permit for the conversion of the
existing garage prior to obtaining a building permit for the
construction of the proposed garage. - Building Permit #33866 was
issued on September 8, 2003 for both the conversion of the existing
garage and the proposed garage.
2. The petitioner shall install a Code -required hard surface driveway
within 12 months of issuance of a building permit. - You have until
September 8, 2004, to have your new driveway completed.
3. The existing driveway shall be removed and resodded upon
completion of the proposed garage. - When the new driveway is
installed, this stipulation must be complied with within 60 days
(you may wish to coordinate both of these proiects at the same
time).
4. The garage shall be architecturally compatible with the existing home
and finished with complementary siding and color scheme.
5. All vehicles shall be stored on a hard surface as approved by the City.
6. The garage shall not be used for a home occupation or living area.
