flat roof repair people. I appears that there is a structural problem with Mr. Nee's
toot R appears the roof has an eight inch sag in it
the roofing foreman, Cliff Roland, who has worked for us for 32 years tells us
that he tried to level this depression with hardboard insulation Evidentally this
did not solve the problem We have attemped several times to correct the leakage
in this roof:
It is our intention to live up to our contract. 1his is very costly to us, so we must
perform this work, when the weather permits. hopefully in April.
We have left a tnessage for his attorney to talk to us about these problems. At
this time she has not r+ebaaed our calls. I left another message today.
Contrary to what Mr. Nee has stated, I had a long convern ion with the Fridley
building inspector: Ron Mkowtki he didn't appew to have an answer to the
problem and did not issue any work order to us.
7hie water ponding cannot be solved with tappered insulation, the bow in the rafters
is to severe. A center roof drain should be installed - Mr. Nee bas been trade aware
of this.
Again, I repeat, we will roof lie house at no charge to him according to our contract

My father had the flat roof of his residence at 219 Logan Park Way in Fridley, Anoka County,
replaced by Century Roofing in December 1997 for $17,875. He was given a 20 -year warranty.
The roof began leaking in the spring of 1998 and continues to leak.
The Fridley building inspectors believed the 1/8 inch per foot taper as required by contract (see
paragraph 3 of proposal) and manufacturer's specifications was not provided. This has been
confirmed by Tony Herbert, a former employee of Century Roofing, in a conversation I had with
him on February 8, 1999.
Enclosed pursuant to a conversation I had with one of your investigators on February 9, 1999,

I am writing to you as my father's attorney regarding the work your company did in the fall of
1997 to replace his roof. You provided a 20 year warranty guaranteeing your work. The roof
began to leak in the Spring of 1998. Your company has been out approximately four times to fix
these leaks. The roof continues to leak despite these repairs.
My father last wrote to you on September 3, 1998, a copy of which is attached. Our records
show your office signed for this letter on September 5, 1998. The roof has been leaking into the
living area, staining the interior cedar ceiling, damaging furnishings, and damaging the basement
ceiling. One of your employees, Tony Herbert, met with my father and a building inspector for the
City of Fridley, Ron Julkowski. Your employee agreed to re -seal the roof again at the then
leaking area. Since that repair, this area has again leaked. It appears that the slope to the roof is
not to contract specifications. An estimate has not yet been obtained as to the cost of the repairs
that will be needed due to this water damage. If the ceiling continues to leak, serious structural
damage will certainly occur.
The re -sealing and repair of the roof to meet original contract as well as manufacturer
specifications must occur immediately. This is clearly a major problem and cannot be remedied by
patchwork re -sealing. Please arrange to have your employees out to the residence as soon as
possible, and we invite you personally to come to the residence to view the damage and to
suggest what must be done for repairs.
Please be advised that due to the serious nature of this situation we cannot wait much longer

I'm writing this on the advice of my daughter (an assistant county attorney) who has also
been my attorney over the past 20 years. The purpose is to get the fact situation
established, as well as any misunderstanding we may have identified.

On June 20, 1997 you gave me a Proposal on behalf of Century Roofing to re -roof my
residence at 219 Logan Park Way NE in Fridley for $17,875.00. I signed this agreement
and in November, 1997 the job was undertaken by employees of Century Roofing.
The specs, according to the agreement were as follows:
1. Remove all existing roofing material, wet and damaged roof insulation and sheet
metal counter flashing
2. Replace all wet and damaged roof insulation.
3. Furnish and install a I lb. density polystyrene tapered roof insulation system.. Roof to
taper 1/8 inch per foot
4. Furnish and apply a V2 inch hardboard roof insulation over the tapered system.
5. Furnish and apply a G.A.F. Corporation #75 fiberglass base sheet to the roof area.
6. Furnish and install new galvanized scuppers, stacks and vents.
7. Furnish and apply a G.A.F. Corporation modified bitumen roof and bas a flashing
system in strict accordance with the manufacturer's specifications.

The Problems We Share and That I Hope To Resolve
A large part of the roof does not drain properly. It is the part of the roof over the ejqtp=
area, my office, the dining room, the kitchen, utility room, toilet and garage. Since I wu
wheelchair bound I can't go up on the roof to give first hand testimony. I have to rely
on others, photos and videotape for my information
The "others" include my son, my son-in-law, a neighbor and most significantly, two
Fridley Building Inspectors.
They all agreed on one part of the problem. ... the scupper that should perr3it that part of
the roQj to draigja. est 2 inches too high– This causes water -to pond and backup..
instead of draining. I am concerned that being continually under water is inconsistent
with the G.A.F. "Strict specifications" (our contract language #7) and that it will result in
the deterioration of that part of the roof.
I am also very concerned with what damage a pond of ice will cause in the winter.
That's exactly what caused the original damage in 1997 that made it necessary to hire
CENTURY to replace the roof..
I mentioned that the building inspectors thought there was another problem in addition
to the problem with the scupper. They thought that the 1/8 inch per foot taper may Aqt
exist. I believe they raised this issue with you. (Re contract provision #3)
In any event the Fridley Building Inspectors determined that the work was not
satisfactory, and that they tried to talk to you about it. But I have the impression that
you either could not be reached by phone and/or that you would not return their call.
They got the impression that you refused to discuss the problem.
It is my sincere hope that you will decide to correct the problem on your own iniative
simply because it is very much in your best interest to do so.
Failing that, my daughter and I will certainly seek another remedy which will cost a
considerable amount of money which would be better spent on making the necessary
corrections.
Please let me know what you intend to do so my daughter and I will know how to
proceed.

Re -roof approx. 4,500 sq. ft of roof surface as tallows:

On the ponded area over the garage, install a combination of flat & tapered insulation to effect drainage.
Install 1/2" wood fiber recovery board. Fiberboard will be mechanically fastened to the deck.
Install GenFlex 60 mil EPDM synthetic rubber roof membrane system.
Membrane will be fully adhered to the fiberboard as per mfg. specifications.
Flash all protrusions, curbs, perimeters, etc. using mfg. recommended details. Use reinforced, non -penetrating
perimeter termination.
Flash all plumbing stacks with premolded rubber pipe boots.
Install new prefinished cant facia metal at the perimeter.
Metal flashing will be installed using a concealed keeper strip.
Replace the existing scuppers with new prefinished steel scuppers.
