01 reduce the required setback from the top of the bluff line from 40 feet to 30 feet to recognize anCe ing
nonconformity on Lot 13, Block 1, Oak Creek Addition, generally located at 235 Logan Parkway NE, with the
following stipulations:
1. The petitioner shall obtain all necessary building permits prior to the construction of any addition.
2. The addition shall meet all zoning code requirements.
3. The addition shall be architecturally compatible with the existing home.
You have one year from the date of the Appeals Commission action to initiate construction. If you cannot
begin construction during this time, you must submit a letter requesting an extension at least three weeks prior

7:30 p.m.

MOTION by Dr. Vos., seconded by Mr. Zinter, to approve the December 12, 2001, Appeals
Commission meeting minutes as presented.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED UNANIMOUSLY.
1. PUBLIC HEARING: VAR #02-01 BY MARC AND SANDY NELSEN
Per Section 205.28.08.C.(1) of the Fridley Zoning code, to reduce the required setback
from the top of the bluff line from 40 feet to 30 feet to recognize an existing
nonconformity on Lot 13, Block 1, Oak Creek Addition, generally located at 235 Logan
Parkway.
MOTION by Ms. Jackson, seconded by Mr. Zinter, to waive the reading and open the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:34 P.M.
Ms. Stromberg stated that the petitioners are requesting a variance to reduce the required
setback from the top of a bluff line from 40 feet to 30 feet in order to recognize an existing
nonconformity at their residence. Summary of hardship is as follows: "Marc and Sandy Nelson,
the owners at 235 Logan Parkway in Fridley are requesting a variance from one section of the
Fridley City Code, Section 205.28.02, Critical Area District Regulations. A recent survey shows
their home to be 30 feet to the bluff line which is closer than the 40 setback as called out in the
Subsection of 205.28 Critical Area District Regulations. Because their existing home does not
conform to the current code, they need a variance before they can proceed with their addition.
This restriction poses a hardship to Marc and Sandy because their home is existing, and they
purchased it without knowing it was encroaching on the 40 foot setback from the bluff line." The
property is zoned R-1, as are all single family properties around it. The existing home is set
back 88 feet from the front yard lot line.

Ms. Stromberg stated that Section 205.28 states that all structures shall be placed not less than
40 feet from the top of the bluff line overlooking the Mississippi River. Properties affected by
this, section encompass all properties located between East River Road and the normal high
water line of the east bank of the Mississippi River. Even though the subject property is not
located on the Mississippi River, it lies within the critical area district and must follow the bluff
line setback requirements.— The petitioner's existing home is located 30 feet from the top of the
bluff line, and they are simply seeking this variance to recognize an existing non -conformity.
Ms. Stromberg stated staff recommends approval with stipulations as this is simply recognizing
an existing non -conformity. Staff recommends the following stipulations:
1. The petitioner shall obtain all necessary building permits prior to the construction of any
addition.
2. The addition shall meet all zoning code requirements
3. The addition shall be architecturally compatible with the existing home.
Mr. Kuechle asked if the addition is going to impinge any further on the bluff line setback?
Ms. Stromberg stated, no, it will not.
Ms. Sandy Nelsen, 235 Logan Parkway, stated they will be building where the property is right
now. The existing porch will become a regular room with the wall knocked down between the
dining room and the porch to make it usable space.
Dr. Vos asked if the addition would be coming out toward Logan Parkway.
Ms. Nelsen stated that it would be coming forward with the garage and out to the side of the
third garage but not going back any closer than it is now.
Dr. Vos asked if something was between the house and the Mississippi River.
Ms. Nelsen stated there is a creek behind the house.
Mr. Kuechle asked how long they have had the property.
Ms. Nelsen stated they have had it 8 1/2 years.
Mr. Kuechle asked if there was anything in the title or deed that talks about bluff line description.
Ms. Nelsen stated they have not looked into that. They discovered this with the architect when
they discovered the bluff line.
Mr. Kuechle asked if there were any problems with the stipulations.
Ms. Nelsen stated they did not have any problems with the stipulations, and that was the
purpose for getting an architect --to make the addition look nice.
MOTION by Dr. Vos, seconded by Mr. Zinter, to close the public hearing.

Dr. V.os stated this is the only option they have and since this is non -conforming, he would vote
for the variance. This would not encroach any more on the bluff line.
Mr. Zinter stated it is a reasonable request, and he would vote for it also.
Ms. Jackson agreed.
MOTION by Dr. Vos, seconded by Mr. Zinter, to recommend approval of VAR #02-01 with the
following stipulations:
1. The petitioner shall obtain all necessary building permits prior to the construction of any
addition.
2. The addition shall meet all zoning code requirements

Ms. Stromberg stated this does not have to go to the City Council.

Council actions.

following stipulations:

REQUEST
Petitioners, Marc and Sandy Nelsen are seeking to reduce the required setback from
the top of the bluff line from 40 feet to 30 feet in order to recognize an existing non-
conformity at their home at 235 Logan Parkway. The recognition of this non -conformity
is required prior to the issuance of any building permits to expand the home.
SUMMARY OF HARDSHIP
"Marc and Sandy Nelsen, the owners located at 235 Logan Parkway in Fridley, are
requesting a variance from one section of the Fridley City Code, Section 205.28 0-2
Critical Area District Regulations. A recent survey shows their home to be 30 feet to the
Bluff line which is closer than the 40 foot setback as called out in subsection 8. C.1 of
the section 205.28 0-2 Critical Area District Regulations. Because their existing home
does not conform to the current Bode, they need a variance before they can proceed
with their addition. This restriction poses a hardship to Marc and Sandy because their
home is existing and they purchased it without knowing it was encroaching on the 40

ANALYSIS
The property is zoned R-1 Single Family and is located and fronts on Logan Parkway.
The existing home was built in 1953 and a porch was added to the front of the home in
1994. The existing garage protrudes in front of the home and is setback 88.9 feet from
the front yard lot line.
Existing Home
City staff has received no comments from neighboring property owners.
CODE REQUIREMENTS
Section 205.28.8.0 (1) states that all new structures or uses shall be placed not less
than forty (40) feet from the top of the bluff line overlooking the Mississippi River.
Properties affected by section 205.28 0-2 Critical Area District Regulations encompass
all properties located between the center line of Anoka County Trunk Highway 1 (East
River Road) and the normal high water line of the east bank of the Mississippi River
running from the north boundary to the south boundary line of the City. Even though
the subject property is not located on the Mississippi River, it lies within the Critical Area
District and must follow the bluff line setback requirements.

The petitioner's existing home is located 30 feet from the top of the bluff line. They are
seeking this variance to recognize this existing non -conformity.
RECOMMENDATIONS
City Staff recommends approval of this variance request, with stipulations.

Reason for Variance
Marc and Sandy Nelson, the owners of a home located at 235 Logan Parkway in Fridley, are requesting a
variance for one section of the Fridley City Code, Section 205-28.0-2 Critical Area District Regulations.
They would like to replace their existing garage and three -season porch with a new garage, main level laundry /
mud room, half bath, and family room and a lower level bedroom and multi -use space.
A recent survey shows their home to be 30 feet to the Bluff Line which is closer than the 40 foot set back as
called out in subsection 8.0-1 of section 205-28.0-2 Critical Area District Regulations. Because their
existing home does not conform to the current code, they need a variance before they can proceed with their
addition. This restriction poses a hardship to Marc and Sandy because thier home is existing and they
purchased it without knowing it was encroaching on the 40 foot set back from the Bluff Line.
