During this meeting, we discussed a number of property maintenance issues relating to the Fridley City Code. From this discussion, I identified the following items which need to be corrected: 1. Fridley City Cade requires that all vehicles must be currently licensed/street operable and kept on a hard surface parking area if they are stored outside. You should obtain and affix current license tabs and move the vehicle into the existing driveway area if you decide to keep this vehicle on the property. 2. Recently, the City received a letter of concern from residents living adjacent to the above referenced property. In this letter, the residents state that the property owner, Mark Solarz, does not maintain his property appropriately and the appearance of his residence greatly detracts from their neighborhood. Staff provides the following response to the various issues raised in this letter: Neglected Property The neighbors assert that Mr. Solarz has neglected to properly maintain his property in several respects. The following is an analysis of these areas: 1. Weeds/high grass Since Mr. Solarz took over this property approximately two years ago, staff has sent three weed notices regarding the property (once in 1992 and twice in 1993). In each case, Mr. Solarz cut the high grass and weeds prior to the end of the ten day time period. Despite the fact that Mr. Solarz has always complied with staff's letters in this regard, the neighbors are very frustrated that he waits until receiving a letter from the City before performing this work. However, the City has not needed to conduct weed abatement work at this residence in the past. 2. Sodding/landscaping Earlier this year, staff indicated in a letter to Mr. Solarz that he was required to prov1de sodding, seeding, vegetative cover, or other landscaping across the entire site as required by the Fridley Zoning Code. At that time, large portions of the side and rear yards were without grass or other cover. Staff cited Mr. Solarz for Property at 187 Longfellow Street N.E. September 29, 1993 Page 2 this violation in June 1993, and Mr. Solarz failed to make his initial appearance in Anoka County Court. Subsequently,. Mr. Solarz contacted staff and stated that the problem had been resolved. upon inspection, staff observed that additional grass growth had eliminated a substantial portion of the problem. At this point, staff requested that the City Attorney dismiss the charge against Mr. Solarz. While the neighbors concede that the problem has been resolved to some degree, they argue that this occurred "by nature" and not through any efforts made by Mr. Solarz. 3. Holes along residence The neighbors have expressed concern that Mr. Solarz' dogs are digging large holes around the outside of the house. While this activity is occurring to some degree, staff has not found any building or zoning standards which would clearly address this issue. It would appear that the only exception to this might be if this condition was deemed to constitute a public nuisance. Staff believes this conclusion would be somewhat questionable. 4. Dog feces There has been an ongoing concern regarding Mr. Solarz' failure to clean up after the dogs which he keeps on this property. Staff has addressed this with Mr. Solarz in person and by letter on several occasions. As with the weed issue, Mr. Solarz has always removed and disposed of areas of dog feces within a reasonable period of time after staff notification. For this reasons, no citations have been issued regarding this concern. Vehicles The neighbors have expressed concern involving storage of vehicles on Mr. Solarz' property. Their concern needs to be addressed as three separate topics. 1. Junk vehicles From time to time, one of the vehicles Mr. Solarz has stored on his property has been unlicensed and/or inoperable. On two occasions, Mr. Solarz resolved this problem prior to issuance of a citation; however, during the summer of 1992, he was issued a citation for a junk vehicle and unlawful outside storage of materials on his Property at 187 Longfellow Street N.E. September 29, 1993 Page 3 - property. In that instance, Mr. Solarz eliminated the violations prior to his initial court appearance, and the matter was resolved. Staff continues to periodically check the-licensing/operability of Mr. Solarz' vehicles and will continue to respond to neighborhood.complaints regarding their status. 2. Location Area residents have expressed dissatisfaction with Mr. Solarz' parking habits which sometimes include storing vehicles on the grass in his front and/or side yard. As you are aware, the City recently lost a case regarding vehicle parking on the grass, and the Council has just approved an ordinance amendment which will make this requirement enforceable. Based on this, staff will resume enforcement of the hard surface requirement concerning Mr. Solarz' property. 3. Insurance Since Mr. Solarz maintains a number of vehicles on his property, neighbors have asked whether or not he maintains proper insurance for these vehicles. As you are probably aware, proof of insurance is required when obtaining license tabs; however, it is possible that someone would renew the tabs and shortly thereafter cancel insurance to save costs. It has not been staff's past practice to attempt to check on the insurance status of a property owner's vehicles due to the time and effort involved. However, depending upon Council's direction, this is a possibility which could be explored since cancellation of insurance would invalidate the license tabs and render the vehicle a "junk vehicle". 4. "Green space" requirement One of Mr. Solarz' neighbors has expressed concern that this property owner may pave large portions of his property so the vehicles will be stored on a hard surface. (In fact, since staff has been dealing with Mr. Solarz, he has paved -additional area for his vehicles.) This neighbor's concern is that the neighborhood will begin to have a commercial appearance due to this pavement and the number of vehicles which it accommodates. Staff has relayed this concern to the Planning Commission and City Council, and the Planning Commission has expressed a strong interest in limiting the percentage of the front yard which may be paved. September 29, 1993 Page 4 Animals Perhaps the neighbors' chief. concern (and one which is responsible for some of the other issues previously raised) involves the dogs kept -on the premises. Often Mr. Solarz has placed the dogs outside when he is away from the residence, and the barking has created a nuisance for the adjacent neighbors. It is my understanding that numerous calls have been made to the Fridley Police Department and that police officers/CSOs have responded appropriately to individual incidents. Their greater concern is that someone should not be allowed to have animals outside when they are not on the property at the time, but there is apparently no ordinance provision which specifically prohibits this exact activity. Summary Staff has spent considerable time working on maintenance issues relating to Mr. Solarz' property. Included in this effort have been extensive discussions with Mr. Larson and others in the neighborhood. As a result of this activity, some of the residents' concerns have been addressed and improvements made when necessary. It appears from their letter of concern, however, that the neighbors believe that more improvement of the property is required and that a more strict effort must be made to deal with Mr. Solarz' behavior and lack of maintenance. On the other hand, staff believes it has made every reasonable attempt to enforce the applicable codes in each circumstance. Dear Mr. Larson: Thank you for your recent letter regarding maintenance concerns and related issues involving the above referenced property. The City greatly appreciates your time and effort in expressing these concerns and circulating this letter throughout your neighborhood to obtain signatures from others experiencing the same problems. My staff prepared the attached memo outlining your issues and responding to each of the concerns. The City Council received this memo and asked me to respond to your letter. Staff is continuing to work with the City Council on a proposed nuisance abatement ordinance which may address some of the issues arising on this property from time to time. The proposed ordinance would provide for an administrative process by which abatements could be conducted to remove junk vehicles and outside storage of materials from private property and the costs assessed to the owner. The abatements would be accomplished in a shorter amount of time than the current court process. This ordinance would not address all of the problems at this property, but it does require faster compliance by the owner. Hopefully, the ordinance will become effective January 1, 1994. During this conversation, Mr. Meade asked staff for an address of a property in violation, so that a photograph could be inserted with the article. Staff refused to provide this information, since the homeowner would likely not appreciate this action. Mr. Meade stated that he wanted A picture and would find one on his own. On October 29, 1993, I received a telephone call from Jeff Larson, who lives adjacent to the above -referenced property. Mr. Larson stated that late Thursday night, Mr. Solarz expressed extreme anger toward his neighbors from his front yard. Mr. Larson believed that Mr. Solarz probably saw the photograph of his residence along with the Focus article and concluded that his neighbors were responsible. Subsequently, staff contacted Mr. Solarz to discuss this matter. Mr. Solarz indicated that he had seen the article and picture and had become very angry. However, he called the Focus and was informed that the newspaper had taken the photograph of his property when the City refused to provide a location with current code violations. As a result, Mr. Solarz was aware that neither the City nor his neighbors were to blame for the photograph. Mr. Solarz stated that he intends to attend the public hearing on the proposed nuisance abatement ordinance tonight.
