new garage on all of Lots 1, 2, and 3, Block 3, except the East 95.5 feet, Block 3,
Spring Brook Park, generally located at 300 Longfellow Street.
MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading of the public hearing
notice and to open the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:50 P.M.
Mr. Hickok stated the variance request is for the property at 300 Longfellow Street. The
parcel is at the comer of East River Road and Longfellow Street. The request is to
reduce the side yard setback for a garage on a comer lot from 30 feet to 25 feet from the
property line.
Mr. Hickok stated the lot is an unusual shaped lot with the northerly property line 133.5
feet and the southerly property line 61.8 feet. A single family home with a garage is
located on the lot. The existing garage is to be demolished with a new garage
constructed in the same location but set back further. The setback comes across the
front southerly comer of the garage so that a triangular portion of the garage requires a
variance.
Mr. Hickok stated the lot was split in 1963 creating a smaller lot condition for this property.
The remaining lot has an odd shape but at one time it had an additional 95 feet to the
east. As a result of that lot split, there is limited area for a garage to be located. The
code is specific as to comer lots and setbacks. This area south of the home is about the
only area where a garage could be located. As staff seeks to work to eliminate variances
wherever possible, they asked about a diminished size for the garage. The petitioner
feels they need the additional depth to meet their needs.

Mr. Hickok stated similar variances have been granted in the past. The garage will be set
back as far as possible to meet the rear yard setbacks. Since this is within previously
granted variances, staff has no recommendation.
Dr. Vos asked if staff had received any comments from the neighbors.
Mr. Hickok stated they had not received any comments. He talked with the petitioner
about that also, and he believed the petitioner had received only positive responses.
Mr. Kuechle asked how wide the boulevard is in that area.
Mr. Hickok stated there is a very large boulevard dimension. East River Road is to the
west with a frontage road and a very wide right-of-way. There is an additional 7.5 feet to
the lot line Inside the curb line.
Mr. Jones asked from which point is the setback measured.
Mr. Hickok stated they take the dimensions from the true property line.
Dr. Vos stated this means there is 7.5 feet of additional green space.
Mr. Hickok stated this is correct.
Mr. Christiansen stated he has been a resident here for about 24 years. They have
wanted a garage ever since they moved in, and they are now getting around to doing it.
He provided some pictures of the property. They have two boys who are driving, and he
has a boat that he wants to put in the back of the garage along with two vehicles in the
garage. Two cars would be parked in the driveway so that everything is off the street.
This is better for plowing the street. He would put in a new concrete driveway for off
street parking.
Mr. Christiansen stated he talked to the neighbors to the south, east ,and across the
street to the west, and they have no problems with the request and no negative
comments.
Mr. Kuechle stated he would like to add one stipulation that the petitioner complete a hard
surface driveway by October 1 of next year.
Mr. Christiansen stated they would like to have the driveway in this year weather
permitting. Otherwise, they will put in the driveway the first thing next spring.
Dr. Vos stated the neighbor at 290 Longfellow Street is to the east of the petitioner. Will
the garage come to their back yard?

Mr. Christiansen stated they have a privacy fence in the back yard. This neighbor has tall
pine trees in the backyard. They may be able to see some of the roof but that should be
all.
Dr. Vos asked the height of the garage.
Mr. Christiansen stated it would be shorter than the house. The garage has 9 -foot side
walls for a 10 -foot ceiling on the inside of the garage. The front will have an 8 -foot garage
door. This will stay within whatever rafters will be needed for a 9 -foot side wall. There will
be one course of block to get a longer life out of the garage.
MOTION by Mr. Jones, seconded by Ms. Mau, to close the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:00 P.M.
Dr. Vos asked that if this was not a comer lot, what would have to be the setback?
Mr. Hickok stated the setback would be 35 feet.
Dr. Vos stated he thought this was an unusual shaped lot. It is a long way to East River
Road. There is a service road in between. It is pretty well screened. It is only a comer of
the garage that encroaches. He thought it met the spirit of the code. He would vote in
favor of the request.
Ms. Mau agreed. The neighbors have no problem with the request. Her only concern
was for the neighbors. This does show a hardship because of the shape of the lot.
Mr. Jones stated he has no problem with the request. His main concern was for the
neighbors. From the aerial photo, it shows this would not be infringing on the back yard
as much as he originally thought. Since the neighbors do not have a problem, he would
vote in favor.
Mr. Kuechle concurred. If the Commission votes no, the petitioner will have a single car
garage encroaching more than the new structure. He would vote in favor of the request.
MOTION by Mr. Jones, seconded by Dr. Vos, to recommend approval of Variance
Request, VAR #98-27, to reduce the side yard setback on a comer lot from 30 feet to 25
feet to allow the construction of a new garage on all of Lots 1, 2, and 3, except the East

following stipulation:

On September 9, 1998, the Fridley Appeals Commission officially approved your
request for a variance, VAR #98-27, to reduce the side yard setback on a comer lot from
30 feet to 25 feet to allow the construction of a new garage on all of Lots 1, 2, and 3,
except the East 95.5 feet, Block 3, Spring Brook Park, the same being 300 Longfellow
Street, with the following stipulation:
1. The petitioner shall provide a hard surface driveway by October 1, 1999.
You have one year from the date of the Appeals Commission action to initiate
construction. If you cannot begin construction in time, you must submit a letter
requesting an extension at least three weeks prior to the expiration date.

BY MIKE CHRISTIANSEN:
Per Section 205.07.03.D.(2).((2)) of the Fridley Zoning Code, to reduce the.side
yard setback on a comer lot from 30 feet to 25 feet to allow the construction of a
new garage on all of Lots 1, 2, and 3, except the East 95.5 feet, Block 3, Spring
Brook Park, generally located at 300 Longfellow Street.
MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading of the public hearing
notice and to open the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:50 P.M.
Mr. Hickok stated the variance request is for the property at 300 Longfellow Street. The
parcel is at the comer of East River Road and Longfellow Street. The request is to
reduce the side yard setback for a garage on a comer lot from 30 feet to 25 feet from the
property line.
Mr. Hickok stated the lot is an unusual shaped lot with the northerly property line 133.5
feet and the southerly property line 61.8 feet. A single family home with a garage is
located on the lot. The existing garage is to be demolished with a new garage
constructed in the same location but set back further. The setback comes across the
front southerly comer of the garage so that a triangular portion of the garage requires a
variance.
Mr. Hickok stated the lot was split in 1963 creating a smaller lot condition for this property.
The remaining lot has an odd shape but at one time it had an additional 95 feet to the
east. As a result of that lot split, there is limited area for a garage to be located. The
code is specific as to comer lots and setbacks. This area south of the home is about the
only area where a garage could be located. As staff seeks to work to eliminate variances
wherever possible, they asked about a diminished size for the garage. The petitioner
feels they need the additional depth to meet their needs.

Mr. Hickok stated similar variances have been granted in the past. The garage will be set
back as far as possible to meet the rear yard setbacks. Since this is within previously
granted variances, staff has no recommendation.
Dr. Vos asked if staff had received any comments from the neighbors.
Mr. Hickok stated they had not received any comments. He talked with the petitioner
about that also, and he believed the petitioner had received only positive responses.
Mr. Kuechle asked how wide the boulevard is in that area.
Mr. Hickok stated there is a very large boulevard dimension. East River Road is to the
west with a frontage road and a very wide right-of-way. There is an additional 7.5 feet to
the lot line Inside the curb line.
Mr. Jones asked from which point is the setback measured.
Mr. Hickok stated they take the dimensions from the true property line.
Dr. Vos stated this means there is 7.5 feet of additional green space.
Mr. Hickok stated this is correct.
Mr. Christiansen stated he has been a resident here for about 24 years. They have
wanted a garage ever since they moved in, and they are now getting around to doing it.
He provided some pictures of the property. They have two boys who are driving, and he
has a boat that he wants to put in the back of the garage along with two vehicles in the
garage. Two cars would be parked in the driveway so that everything is off the street.
This is better for plowing the street. He would put in a new concrete driveway for off
street parking.
Mr. Christiansen stated he talked to the neighbors to the south, east ,and across the
street to the west, and they have no problems with the request and no negative
comments.
Mr. Kuechle stated he would like to add one stipulation that the petitioner complete a hard
surface driveway by October 1 of next year.
Mr. Christiansen stated they would like to have the driveway in this year weather
permitting. Otherwise, they will put in the driveway the first thing next spring.
Dr. Vos stated the neighbor at 290 Longfellow Street is to the east of the petitioner. Will
the garage come to their back yard?

Mr. Christiansen stated they have a privacy fence in the back yard. This neighbor has tall
pine trees in the backyard. They may be able to see some of the roof but that should be
all.
Dr. Vos asked the height of the garage.
Mr. Christiansen stated it would be shorter than the house. The garage has 9 -foot side
walls for a 10 -foot ceiling on the inside of the garage. The front will have an 8 -foot garage
door. This will stay within whatever rafters will be needed for a 9 -foot side wall. There Will
be one course of block to get a longer life out of the garage.
MOTION by Mr. Jones, seconded by Ms. Mau, to close the public hearing.

Dr. Vos asked that if this was not a comer lot, what would have to be the setback?
Mr. Hickok stated the setback would be 35 feet.
Dr. Vos stated he thought this was an unusual shaped lot. It is a long.way to East River
Road. There is a service road in between. It is pretty well screened. It is only a comer of
the garage that encroaches. He thought it met the spirit of the code. He would vote in
favor of the request.
Ms. Mau agreed. The neighbors have no problem with the request. Her only concern
was for the neighbors. This does show a hardship because of the shape of the lot.
Mr. Jones stated he has no problem with the request. His main concern was for the
neighbors. From the aerial photo, it shows this would not be infringing on the back yard
as much as he originally thought. Since the neighbors do not have a problem, he would
vote in favor.
Mr. Kuechle concurred. If the Commission votes no, the petitioner will have a single car
garage encroaching more than the new structure. He would vote in favor of the request.

Request, VAR #98-27, to reduce the side yard setback on a comer lot from 30 feet to 25
feet to allow the construction of a new garage on all of Lots 1, 2, and 3, except the East

DESCRIPTION OF REQUEST:
Mike Christiansen has requested a variance to allow the reduction of the side yard setback for an
accessory building on a comer lot from 30 feet to 25 feet to allow the construction of a new garage.
SUMMARY OF ISSUES•
Section 205.07.03.D. (2c) ((2)) of the City code states that no accessory building on a corner lot
shall be closer to said side street than 30 feet.
The applicant is proposing to construct a 23' x 36' (828 S.F.) garage in the side yard, and replace
his present 14' x 24' (336 S.F.) garage which has only a 13' setback. The new garage would be set
back from the street an additional 12 feet (total setback 25 feet).
HARDSHIP STATEMENT:
A lot split in 1963 reduced the easterly side of this lot by 95.5 feet creating limited garage
expansion.
PREVIOUSLY GRANTED VARIANCES:
This request is within previously granted variances. In August of 1998, the City approved a
variance on a comer lot accessory structure from 25 feet to 17 feet at 1027 Mississippi Street.
Also, in 1994 a similar situation was approved at 8041 Riverview Terrace NE.
RECOMMENDED ACTIONS:
Staff has no recommendation since this is within the parameters of previously granted variances.

The original house was built in 1963, the garage was built in 1967 and has a 13 foot setback from the
street.

This request is within previously granted variances. In August of 1998, the City approved a variance

ANALYSIS:
Section 205.07.03.D (2c) ((2)) of the City code states that no accessory building on a comer lot shall be
closer to said side street than 30 feet. The applicant is requesting a setback of 25 feet. The house
meets City code setback requirements and the proposed garage will be setback five (5) feet further than
the house itself. What creates the variance need is the unusual angle of the East River Road (or
westerly) property line.
The present garage structure has a setback of 13 feet. The proposed garage would have a 25 foot
setback. The code requires a 30 foot setback on this accessory use on a corner lot. Due to the angle of
the property line, only the southwest corner of the proposed garage would not meet the setback
requirement.
An additional impact on this unusual shaped parcel was the sale of the easterly 95.5 feet of property
back in 1963. This created a limiting 61.8 foot southerly lot line to work within.
RECOMMENDATION:
Staff has no recommendations since this variance is within the realm of previously granted variances.
