Based on our discussion, and for your convenience, our planning staff reviewed addition/construction possibilities for your home. The purpose of this letter is to provide you with the findings from our discussion and to offer a few suggestions about future site development. We learned that your plat, Spring Brook Park, was platted in 1922. As such, it qualifies for special Fridley zoning consideration under a new Fridley law that was passed in 2000. In essence, the law states that lots recorded at the County, prior to December 29, 1955, can have as little as 5000 s.f. and be as narrow as 50' and can still be considered conforming. This is important, because prior to the 2000 law, people with non -conforming (small) lots could maintain their homes, but could not enlarge them. One question does remain regarding your lot. That is, what year was your 69' street frontage lot created? Though the underlying plat is 1922, it appears that a lot split must have occurred some time later. It may be that the 1970 Hoium and Associates survey that we are looking at was prepared as part of a lot split request. The lot split must pre -date December 29, 1955 to allow your lot to be conforming and to allow you to build an addition. Before you proceed with your project, we will do further research to determine the lot split history of your site. For discussion purposes, let's assume the lot is conforming, because the split occurred prior to 1955. With that assumption, we can focus on setbacks. We have prepared a sketch to illustrate what area of your lot is buildable. In the illustration you'll note that the yellow area is where additional living/garage space could be constructed. You'll also note that the Janet Leach April 10, 2002 PAGE 2 Brown shaded area is the area where the current home is, with the exception that the current garage and attached utility area (?) have been removed and relocated in front of the existing home. The reason for this bold suggestion is that there are two options if you choose to proceed. These are: 1. Apply for a variance to allow the garage to remain 3' from rear property line; or, 2. Remove the garage and connecting structural appendage to allow you to have a 17' rear yard, rather than a 3' rear yard. A variance would still be required under this option. Your request would be to allow a variance for a reduced rear yard from the required 26' to 17'. There is an important distinction between asking for a variance to 3' verses asking for one to 17'. They are both variance requests, however, 17' is within previously granted variance parameters for a rear yard, which increases your potential for receiving that variance. A 3' variance has not been granted for a rear yard. Due to the fact that there are alternatives it is unlikely that Council would approve a variance to that dimension. In this packet, staff has enclosed a variance application, a calendar of application deadlines, a list of items to include with your variance application and information on loan programs through the Fridley Housing and Redevelopment Authority (HRA). This information may provide you with additional alternatives as you consider moving ahead and possibly financing a new addition. If you are interested in applying for a variance, please also include a narrative of the physical characteristics of the land, that as you see it, make it essential that a variance be granted.
