agreeing to do all work in strict accordance with the City Ordinances and ruling of
the Department of Buildings, and hereby declares that all the facts and representa-

Section} 2. The Inspector of Buildings shall, before issuing any permit
for the erection of'any building or structure, or for any addition to
any existing building or structure, or for any alterations or repairs
to.any existing building or structure, upon application therefor, require
the payment by the applicant for such permit of fees to the amount herein
below set forth and in the manner herein provided to -wit:
2.1. For any such permit for the erection of any fire -proof building,.other
than a garage, warehouse, factory or grain elevator, or for the erection of
any -fireproof addition, for similar occupancy, to any existing.building
shall be at the rate of $1.40 for each one thousand cubic feet, or fraction
thereof, in such cubical contents.
2.2. For any such permit for the erection of any fireproof garage; were
house, factory or grain elevator; or for the erection of any fireproof
addition for 'similar occupancy,' to any existing building shall be at. the
rate of 1.25 for each one thousand cubic feet, classified as "fireproof"
by Section 502 of the Minneapolis Building Code.

2.3. For any such permit for the erection of any non -fireproof building
other than a garage, warehouse, factory or grain elevator, or any non -
fireproof addition, for simUar occupancy, to any existing building.
Permit $1.00 for each one thousand cubic feet.
GARAGES
2.4. For any such permit for the erection of any non -fireproof garage,
warehouse, factory or grain elevator, or for the erection of any non-.
fireproof addition, for similar occupancy, to any existing building #r
for each such building or addition. Ninety Cents for each one thousand
cubic feet or fraction -thereof, in the cubical contents thereof with a
minimum of $4.00.
.For the purpose of computing fees for building permits the cubical contents
of any building or addition to.a uniform height throughout by multiplying
the ground area covered from a point six.(6) inches below the floor line of
the basement or cellar to the average height of the upper surface or to the
average height of -the roof surface of the main gable of a pitched -roof.
2.5. For repairs or alterations to an existing structure, the fee shall"be
at the rate of $3.00 for each Five Hundred Dollars ($500.00), or fraction
thereof in the cost of all proposed work.
2.6. In nocaseshall the fee charged for any permit as set forth in
Sectim-2' be less than $4.00.

THE MINUTES OF THE BOARD OF APPS MEETING OF 1972
The meeting was called to order by Chairman Minish at 7:30 P.M.
HOMERS PRESENT: Minish, Crowder, Harju, Sondheimer, Wahlberg

MOTION by Harju to approve the minutes of the June 27, 1972 umating as written.
Seconded by Crowder. upon a voice vote, there beiM no vWs, the motion carried
unanimously.
Mr. h Mrs. Kothman dere present to present the west. A sMtcb of the proposed
addition and general layout of the existing dwelling wea shown to the Board.
Chairman Mintsh explained this request bad been tabled to allow the K+othmns to
come up with a more definite plan.
Mr. Kothman said he has more or less the same pian but it is more specific. He
said as far as the looks of the house, they feel this is the gest way to go ( 5
feet from the property line),
Mrs. Rothman said if they move the addition over 5 feet to meet the Cods, they
wouldn't have room to get into the family room from the existias doorway. She
said with the existing house layout. this to the only way to add on.
Mr. Canton, 402 Longfellows, adjacent property ownew,, came forward and said he
had no objection to the additUa. In fact, he would like to see the addition put
on. He said his garage is 10 feet from the Uses and as long an he lives there
he will not be adding onto the garage. He said he uses it for storage of his
% equipment now, and hia cam he pis in his new SamMe.
Chairmen finish stated that if his house was sold.. the could be Built am
to be within 5 feet of the fins.

be moved if the addition was moved over 5 feet.

Seconded by Sondheimer. Upon a voice votes there being no nays, the motion
carried unanimously.
Firs. Wahlberg said she is bothered by the closeness of the structuress but since
the not garage on the adjoining lot is quite large and that house could be built
on without coming toward the adjoining property line, she could vote in favor
of the variance.
Mr. Harju said the Hoard should not be looking at the lot next door but just on
this lot. The Kothmans could change their plan to ret the Coda.
Fft. Crowder stated his position hasn't changed since the last -

N by Crowder to recommend to the City Councils approval of the variance
with the following stipulations The addition will conform to all the necessary
fire protections not only on the west wall but also on the south wall.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley will
meet in the Council Chamber of the City Hall at 7:30 P.M. on Tuesday, June 27, 1972
to consider the following matter:
A request for a variance of Section 45.053, 4B,
Fridley City Code, to reduce the side yard
setback adjoining living area from 10 feet to
5 feet to allow the construction of a 14 foot by
22 foot addition onto the back of a non -conforming
dwelling located on Lots 30 and 31, Block 2,
Spring Brook Park Addition, the same being 386
Longfellow Street N.E., Fridley, Minnesota. (Request
by Mr. Bruce Kothman, 386 Longfellow Street N.E.,
Fridley, Minnesota.)
Anyone who desires to be heard with reference to the above matter may be
heard at this meeting.

Mrs. Wahlberg said she had to agree. She felt a variance from 300 square feet to
700 square feet was quite a lot of leeway on a variance..
Chairman Minish said he agreed with the Board. He added this billboard is goir43
to the Planning Commission for a Special Use Permit and if the Special Use permit
is approved by Council, the Council could still grant the variance in square
footage.
MOTION by Wahlberg to recommend to the City Council denial of the variance,
Seconded by Crowder. Upon a voice vote, there being no nays, the motion carried
unanimously.
TION by Wahlberg, seconded by Crowder, to waive the reading of the public hearing
notice. Upon a voice vote, there being no nays, the motion carried unanimously.
Mr, & Mrs, Kothman were present to present the request. A verifying survey of the
lot and pictures of the dwelling were shown to the Board.
A letter o£ no objection from Mr. A. Canton, adjacent neighbor, was received in
the mail.
NOTION by Crowder to receive the letter of no objection from Mr. A. Canton,
Seconded by Wahlberg. Upon a voice vote, there being no nays, the motion, carried

Mr. Kothman stated he wants to add on a 14 by 22 foot addition onto the back of 00
house. The house is 5 feet from the property line instead of the required 10 foot
• and Mr, Kothman explained he wants to follow the house line. He said to set the
addition in the required 10 feet would leave 5 feet of dead space.
VX, Kothman explained Mr. Canton has an attached garage that would be 15 feet from
their addition. He said the addition will be used for a bedroom and a family room.
lie Will also be putting a fireplace in the basement under the addition, ate said he
hn@ 4 children and they need the additional room but he does not want to ruin the
appearance of the house.
, Harju stated that the Board requires fireproofing on anything closer than lA
feet to the property line. He asked Mr. Kothman if he had planned to put ony
Windows on the addition wall facing the Cantons.
Mrs, We 1berg added that the fireproofing would have to continue a guud the corner
of the addition also and this might eliminate the windows that Mr. Kothman bad
planned to install,
', Kothman said he did plan on putting in 1 window on the wall facing the CantQqv
and also now on the back of the addition.

Nr. Belisle said the window would have to be ruled out because of the Fire Codi: as
e window has little fire rating. He added that 10 per cent of the floor area is
to equal the light area provided.
There was a discussion on the possible placement of the windows and the fireplace
chimney.
Mr. Belisle stated Mr. Kothman could move the addition in 5 feet and basically
do what he wants.
Mr. Kothman did not have an exact location for the windows or the fireplace.
Mr. Crowder said it sounds like some of the things that the Board discussed, like
fireproofing and light area, are new to Mr. Kothman. He added that if Mr. Kothman
wanted to talk these items over with his wife, the Board could table the item
until the next meeting when he would have a definite location for the windows and
definite plans for what he will be doing.
Hr. Kotbman said he understood what was involved.
Mr. Crowder said the neighbor does have 2 garages but the one that is attached
could legally be added on another 5 feet. The neighbor shouldn't have any reason
to build toward the lot line but granting this addition could restrict him.
NOTIQN by Crowder to recommend to the City Council approval of the variance with
the following stipulation: The addition will conform to all necessary fire
protection, not only on the west wall but also on the south wall.
Mrs, Wahlberg said she would like to see the item tabled to see if Mr, Kothman
can cope up with a plan to conform more to the Code.
Mr. Harju stated he felt the hardship is the need for additional space and the
layout of the house makes it the most feasible plan but you can draw up different
Flans to meet the Code. The plan that meets the Code might not have everythJug
the person desires but it would meet the Code.
Kra, Wathlberg added the neighbor does have the right to also tear down the existing
ggrage and build closer to the line.

The City Engineer said the location of this proposal is just west of the
troLcks next to the bridge south of I. 694. Midland Cooperatives objected to
the signs, and the Board of Appeals recommended denial, they feel there are al-
ready too many signs along the freeway. They would be like the other bill-
boards along'the freeway. Mayor Liebl asked if Fridley got any taxes froa4
theee billboards. The City Engineer replied that the City gets a licggsp
fee for the signs.
