Ms. McPherson stated the petitioner is requesting a variance to reduce the side yard setback for an attached accessory structure from 5.0 feet to 2.0 feet. The request was published as 2.27 feet; however, staff received a verifying survey today from Kurth Surveying which does reveal that the accessory structure is actually 2 feet from the side lot line. If the variance request is approved, it will correct an existing nonconforming situation and allow the construction of an addition to the dwelling. Ms. McPherson stated the property is located at 409 Longfellow Street which is located in the northwest comer of the city. The subject property is located west of East River Road. The property is zoned R-1, Single Family, as are the surrounding properties. Located on the property is a single family dwelling measuring 24 feet x 26 feet, a 12 x 18 foot attached garage, and an 8 foot x 16 foot breezeway. APPEALS COMMISSION MEETING, OCTOBER 8,1997 PAGE 2 Ms. McPherson stated the existing dwelling was constructed before 1955 which is the year that the city started requiring building permits. The proposed 20 foot x 26 foot addition is for the dwelling portion of the structure. The garage itself will not be expanded. The zoning code prohibits the expansion of nonconforming units. A variance needs to be granted to make this structure conforming. Ms. McPherson stated this request is within previously granted approvals. The City has granted variances for expansions to single car garages to two car garages to 2 feet. The dwelling to the west of the subject parcel is located approximately 11 feet from the existing garage of the petitioner. The proposal by the petitioner is to gut the interior of the existing dwelling and add on an addition to make the bedrooms, living room, bathroom., kitchen and utility rooms larger. They will also be adding a dining and sun room as part of the proposed addition. Ms. McPherson stated that as the request is within previously granted approvals,. staff has no recommendation for the Appeals Commission and no suggested stipulations as a condition of approval. Mr. Kuechle asked that if, for example, they approved this variance and the house burned, would they then have to comply with the setback requirements or does the variance go with the property forever? Ms. McPherson stated the variance would go with the land unless the Appeals Commission stipulated otherwise. Mr. Kuechle asked if the petitioner had any additional comments. Mr. Ramsdell stated he planned to make the back part of the house longer because there is not much room in the front. The house is the same as when he bought it. Nobody has ever complained about it. Mr. Kuechle asked how long the petitioner has lived at this location. Mr. Ramsdell stated they have lived here for 49 years. He bought the house when he got out of the service. Now, after a lifetime of working, they have the chance and the money to fix it up. Mr. Connelly stated he is from Jim's Building Services. He has been working with Mr. Ramsdell and his daughter, Mary, on this addition. They have done a lot of design and redesign in order to take advantage of what they do have there. They are not expanding the garage or encroaching any further on the neighbors with the living space. On one side, they are within the setback requirements for the dwelling unit. The actual living space on the west side will not infringe either. They have done a lot of work on this and he hoped the Appeals Commission would approve the request. MOTION by Ms. Beaulieu, seconded by Ms. Mau, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:40 P.M. APPEALS COMMISSION MEETING, OCTOBER 8.1997 PAGE 3 Ms. Beaulieu stated the encroachment is an existing condition. It is interesting that they are not asking to expand the garage which is nonconforming. It is the house part which is conforming that they want to redo. She would be in favor because it is a pre-existing condition. She would consider a stipulation that, if the house was ever completely destroyed, the variance would cease to exist and a new structure would have to be conforming. Ms. Mau agreed because of the fact that they are not encroaching further than the garage. She would like to see a stipulation that, if any further development on that property takes place should anything happens to that dwelling, it would become conforming. Mr. Kuechle asked if adding this stipulation would confuse the issue. Ms. McPherson stated that assuming the Appeals Commission moves to approve the request, it would be a stipulation which is a condition of approval. It would be recorded against the property and would follow to future owners. It would not affect the petitioner needing to go to the City Council unless someone voted against the request. No construction has occurred to the dwelling since that time, other than obtaining heating, gas, and plumbing permits. The single car garage is not proposed to be modified through this construction. The proposed improvement to the dwelling will create larger bedrooms, a larger bathroom, rearranged kitchen and utility spaces, a larger living room, and add a dining and sun room to the rear of the dwelling. A gas fireplace is also proposed. The variance is requested in order to allow the expansion of a nonconforming dwelling. The dwelling is nonconforming in the fact that the garage is too closer to the lot line. Section 205.04.03.1 allows alterations to a building containing lawful nonconforming residential units provided that the alterations will not increase the size of the building. This proposal will increase the size of the building; therefore, the City must grant the variance to bring the property into conformance. The proposal does not increase the lot coverage over 25% and brings the dwelling up to the minimum 1,020 square foot floor area. The variance is within previously granted variances.
