GARAGE, GENERALLY LOCATED AT 6601 LUCIA LANE N.E. (WARD 2)

Mr. Hickok, Planning Coordinator, stated that staff was asked to
review the advantages and disadvantages of vacating 66th Avenue.
He stated that the disadvantages are that the vacation of 66th
Avenue would eliminate an access alternative to Lucia Lane should
the State or County construct a median in Mississippi Street. He
stated that in the event a median is constructed at a length that
limits turning movements to Lucia Lane, or to head east on
Mississippi Street from Lucia Lane, constructing a connection from
Pierce Street to 68th Place would be an alternative that would
allow residents to get back to Lucia Lane.
Mr. Hickok stated that another disadvantage is the land to the
north of Pierce Street is zoned for multi -family and the elimina-
tion of 66th Avenue would force traffic to use Lucia Lane alone
versus using 66th Avenue for east bound traffic. He stated that
the vacation of 66th Avenue would also eliminate a shorter right-
of-way and a lower street cost when comparing it to the Pierce
Street and Lucia Lane connection.
Mr. Hickok stated that another disadvantage is that utilities are
currently in place in the 66th Avenue alignment, and a right-of-
way allows for a combination of both street and utilities. He
stated that although an easement could be reserved, the right-of-
way is more efficient. He stated that the official mapping process
for the Pierce Street extension is far more lengthy than simply
installing the improvements to an existing right-of-way.
Mr. Hickok stated that the advantages of the vacation of 66th
Avenue are that it creates an interior lot for the petitioners, and
they could then construct a double garage without requiring a
variance. He stated that other advantages to vacation are the
adjacent property owners could continue to use the property
legally, it increases the tax base to the City, and eliminates the
potential of a future road too close to accessory structures.
Councilman Schneider was concerned about the construction and
length of a median that would block or limit access to this area.
Mr. Hickok stated that the right-of-way is in place for such an
improvement; however, the design and length of the median is yet
to be determined. He stated that from information he has received

from the County, this intersection improvement would not occur for
five to ten years.
Councilman Billings stated that staff was requested to review the
pros and cons of vacating 66th Avenue. He stated that staff states
that the County has plans to construct a median in the future. He
stated that.if this is the case, there would be public input, but
since Mississippi Street is a County road, the decision for the
design would be with the County Board. He stated that staff has
done a good job of reporting the advantages and disadvantages, but
it is up to Council to make a reasonable decision based on the
information available.
Councilman Schneider stated that his only point is that he
believes, generally, the County does listen to the Council and
would not try to block access to the neighborhoods. He stated that
it seems to him if greater than a 300 foot median was proposed, the
County would have to provide cuts, protected lane movements, or
signalization.
MOTION by Councilman Schneider to grant Variance Request, VAR
#95-31, to reduce the side yard setback from a street right-of-way
from 17.5 feet to .5 feet. Further, that this is an extremely
unique situation as the variance is to a platted, but yet unpaved
right-of-way and while there is a possibility in the future it
could be completed, it is almost conjecture. Seconded by
Councilwoman Jorgenson.
Councilman Billings asked what the largest variances granted in the
past for this type of situation were.
Mr. Hickok stated that there was a variance from 17.5 feet to 14.27
feet for a corner lot.
Councilman Billings stated that the Appeals Commission has unani-
mously recommended denial of this variance request. He stated that
he is unable to determine the hardship as required by the Minnesota
State Statutes.
Mr. Hickok said that State Statute requires a hardship related to
the physical characteristics of the land. He stated that in this
case, the petitioner desires to build at the location of an
existing garage.
Councilman Billings stated that he believes in the integrity of the
zoning ordinance and cannot support this motion.
Councilman Schneider asked how many variance requests the City
received for encroachment in the side yard.
Mr. Hickok stated that there were several, and all side yard
variances that were granted were in the range of about fifteen
feet.

Mayor Nee stated that Councilman Billings' point was well taken.
He felt, in practical terms, this was an extraordinary situation.
Councilman Billings stated that the only thing he finds unique
about this request is that, at this time, the street is
undeveloped. He stated that throughout the history of the City,
there have always been streets that were undeveloped. To grant a
variance adjacent to a street merely because it is undeveloped is
not the kind of thing he felt the City should be doing.
Councilman Schneider stated that there is an existing garage there,
and this is only a two foot difference against vacant property.
He stated that while he agrees that the integrity of the zoning
code is important, the petitioner is making effective use of the
garage now. He stated that the alternatives are costly, and it
does not make sense to not allow the variance. He stated that a
long-time resident wishes to improve his property, increase the tax
base, and this seems a reasonable tradeoff.
UPON A ROLL CALL VOTE TAKEN ON THE ABOVE MOTION, Councilman
Schneider, Councilwoman Jorgenson, Councilwoman Bolkcom and Mayor
Nee voted in favor of the motion. Councilman Billings voted
against the motion. Mayor Nee declared the motion carried by a
four to one vote.

a variance to reduce the side yard setback from 20 feet to 2.9 feet

to allow the construction of an 83 foot by 88 foot addition to the
rear of an existing industrial building at 5130 Main Street. He
stated that when originally constructed, this building wa less
than five feet from the lot line, and there were variances Vo allow
additions to this structure.
Mr. Hickok stated that the Appeals Commission recommen ed approval
of this variance with four stipulations which he outlined, as
follows: (1) the petitioner shall conduct soil bori gs in the area
of the addition if contaminated soil exists. All ntaminated soil
will be removed from the site prior to issua a of a building
permit; (2) the petitioner shall relocate th above ground fuel
storage tank in compliance with the Uniform F' a Code and all Fire
Department permitting requirements; (3) t petitioner and the
property owner to the north shall execute d record a maintenance
agreement against both properties to ens a proper maintenance of
both buildings; and (4) the shared driv way west of the addition
shall be designed in a manner that p ovides a safe passage and
distance between vehicular travel and he building addition. This
driveway shall be approved by City taff prior to issuance of a
building permit.
Councilwoman Bolkcom stated that yleist Central Environmental Consul-
tants submitted a letter dated ecember 27, 1995 responding to the
first stipulation regarding so 1 contamination. She felt that it
may be best for the petit'oner to discuss the soil borings
analysis, as they are in an dn-going program for monitoring pollu-
tion on the site.
Mr. Steve Schwartz, repre,,genting Dealers Manufacturing, introduced
Jeff Hanratty, Projectngineer, from West Central Environmental
Consultants.
Mr. Hanratty stated that 67 soil borings have been taken in the
last seven years.a stated that contamination below the ground
water table inter ace exists on the western half of the site,
including the pro osed building addition footprint. He stated that
ground waterco tamination exists from 30 feet to 70 feet below
land surface a cannot be excavated as noted in Stipulation No. 1
due to its de h and volume. He stated that, consequently, this
contaminatio will be treated using "in-place" methods.
Mr. Hanratt stated that in the past, degreasing solvents were used
for clean' g parts and dispersed into the sanitary sewer system
into a f1# waste trap which leaked. He stated that they are
proposin to use a pump out well and are in the process of getting
an indu trial waste water permit to contain the contamination to
their roperty. He stated that to address the soil contamination
and g ound water contamination on site, a remedial pump will be
inst led inside the building to treat the soil and ground water.
Mr. Schwartz stated that they would like the first stipulation
removed because they have done the soil borings on the property.
6601 Lucia Lane Sidevard Setback Variance
DESCRIPTION OF REQUEST:
The petitioners request that a variance be granted to reduce the side yard setback on a corner lot from
17.5 feet to .5 feet. If approved, the variance would allow reconstruction of an existing garage.
The property was granted a variance in 1965 to allow construction of the existing garage to 3 feet.
SUMMARY OF ISSUES:
The subject parcel is located at the intersection of 66th Avenue and Lucia Lane. The subject parcel is
located adjacent to the paper right of way of 66th Avenue, 66th Avenue is an unimproved street. The
petitioner has three alternatives which would meet the code:
1. Vacate 66th Avenue; 20 feet would accrue to the petitioner's property.
2. Locate the garage at the 17.5 foot setback.
Locate the garage 25 feet from the south property line and acquire an easement from the City
to drive on the 66th Avenue right-of-way.
The Council could choose to grant a variance to maintain the 3 foot encroachment.
The request exceeds all previous requests of this nature (five feet is the greatest variance granted).
RECOAMENDED ACTIONS:
As the request exceeds previously granted variances, staff recommends that the City Council deny the
request.
APPEALS COAMMSION ACTION:
The Appeals Commission voted unanimously to recommend denial of the request to the City Council.

Property Description and Dory
The subject parcel is located at the intersection of Lucia Lane and 66th Avenue, with 66th Avenue
unconstructed. Located on the subject parcel is a 20' X 40' single family dwelling unit built in
1964, and a 14' X 20' detached garage built in 1965. The petitioners are proposing to remove the
existing garage and construct and new garage 16 X M. In 1965, the City granted a variance to
the property owner to reduce the side yard setback from 14.27 (the distance of the dwelling to the
south property line) to 3' to allow construction of the garage. See attached zoning code section
from 1963.
Analys
Section 205.07.03.D.(2).(c).((1)) of the City Code requires that the side yard setback on the street
side of a comer lot shall not be less than 17.5 feet.
Public Purpose served by this requirement is to maintain a higher degree of traffic visibility and to
reduce the "line of sight" encroachment into the neighbor's front yard.
The petitioner is proposing to expand the garage to the south and east. This reduces the setback
from the three feet granted in 1965 to .5 feet. The petitioner could choose to expand the garage
to the north, thereby maintaining the existing encroachment.
The subject parcel is unique since it abuts an unimproved right-of-way. The dwelling on the
adjacent property to the south faces the same direction as the dwelling on the subject parcel. The
dwelling on the property to the rear faces Pierce street, so there is no "line of sight" encroachment
or traffic issues.
The fact remains, however, that the City could construct a street within the a 50 foot right of way
between Lucia Lane and Pierce Street. Sixty-sixth Avenue does exist between Pierce Street and
Channel Road to the east. If the variance were granted, and the street constructed, the structure
would be six inches from the right of way line, and 10 feet from the curb line.
The petitioner has the following alternatives to pursue in order to meet the code (see attached
drawing):
1. Vacate the 66th Avenue right of way between Lucia. Lane and Pierce Street. Twenty feet
would accrue to the petitioner's property, thereby eliminating the need for a variance. All
property owners abutting 66th Avenue would have to consent to the vacation. Staff
understands that there may be at least one owner who objects to this option

2. Locate the garage behind the house 17.5 feet from the property line. This would require
relocating the patio and existing garage slab. There is adequate room on the site to
accommodate this option.
3. Locate the garage behind the dwelling facing the south property line and 25 feet from the
property line; acquire an easement from the City to drive on the 66th Avenue right of way to
access the garage.
The Commission could also choose to grant a variance to maintain the existing encroachment of three
feet.
Recommendation
The request exceeds those previously granted. Staff recommends that the Appeals Commission
recommend denial of the request to the City Council.

SUBJECT: Disadvantages and Advantages of Vacating 66th Avenue between
Lucia Lane and Pierce Street
Staff met to discuss the disadvantages and advantages of vacating 66th Avenue
between Lucia Lane and Pierce Street adjacent to 6601 Lucia Lane N.E., property
owned by Anthony and Joyce Swanson, the petitioners for variance request, VAR
#95-31. We determined the following:
Disadvantages:
1. The vacation of 66th Avenue eliminates an access alternative to Lucia Lane
should the State or County construct a median in Mississippi Street. Staff has
contacted the County to get information regarding the possibility of a median at
Mississippi Street, east of Trunk Highway 65. The County lists the intersection
improvement as a 'mid range project' to occur five to ten years from now. The
exact length of a median has not been determined and could range from 300
feet to 780 feet.
In the event that a median is constructed at a length that limits turning
movements to Lucia Lane, constructing a connection from Pierce Street to
68th Place would be an alternative that would allow residents to get back to
Lucia Lane. The right-of-way would have to be acquired, or an 'official map'
adopted to reserve the right-of-way. A number of property owners are affected
and a detailed engineering study should be conducted to determine if the road
could be built.
2. The land to the north of Pierce Street is zoned for multi -family development.
The elimination of 66th Avenue would force traffic to use Lucia Lane alone
versus using 66th Avenue for east bound traffic.
3. Vacation of 66th Avenue eliminates a shorter right-of-way and a lower street
cost when comparing it to the Pierce Street and Lucia Lane connection.

4. Utilities are currently in place in the 66th Avenue alignment. A right-of-way
allows for a combination of both street and utilities. Although an easement
could be reserved, the right-of-way is more efficient.
5. The official mapping process for the Pierce Street extension is far more lengthy
than simply installing the improvements in an existing right-of-way.
Advantages:
1. Creates an interior lot for the petitioners. They could then construct a double
garage without requiring a variance.
2. The adjacent property owners could continue to use the property legally.
3. It increases the tax base to the City.
4. It eliminates the potential of a future road too close to accessory structures.
Partial Vacation
Staff believes that partial vacation of the street would also not be an advantage to the
City because of the reasons stated above.
Utilities
We have determined that a sanitary sewer line is located within the south 30 feet of
the right-of-way. This area would also be a logical location to 'loop" the water system
to improve pressure and quality. Staff requests that if the vacation is approved, a 30
foot drainage and utility easement be retained over the south 30 feet of the right-of-
way.
Recommendation
Based on the above analysis, staff recommends that the City maintain the right-of-way
at 66th Avenue. Staff will continue to look for garage alternatives to meet the
petitioner's needs. If the area is vacated, a 30 foot utility easement should be
dedicated.

If the vacation were to become final yet this year, the tax and value increases would
become effective for taxes payable in 1997. For pay 1997, the value and tax rates may
be different. The reason that the values are higher on Pierce is because land is worth
more, there, than on Lucia Ln. with its apartment traffic. The reason the increase is
less, on 6610 Pierce is because it's frontage is primarily on a non -improved street and

Mr. Hickok, Planning Coordinator, stated that this is a request to
allow a variance from the required setback of 17.5 feet to .5 feet

for a side yard on a corner lot adjacent to a public right-of-way.
He stated that the variance is requested to allow the reconstruc-
tion of a garage.
Mr. Hickok stated that the Planning Commission and staff reviewed
this variance request and determined that there are really three
alternatives. He stated that these alternatives are: (1) to
vacate the 66th Avenue right-of-way between Lucia Lane and Pierce
Street; (2) locate the garage behind the house 17.5 feet from the
property line; and (3) locate the garage behind the dwelling facing
the south property line and 25 feet from the rear property line and
acquire an easement from the City to drive on the 66th Avenue
right-of-way to access the garage.
Mayor Nee asked if 66th Avenue was closed if it would adversely
affect the traffic in the neighborhood.
Mr. Hickok stated that the potential for a street is debatable.
He stated that, at this time, it is landscaped property that is
being enjoyed by the property owners.
Mr. Flora, Public Works Director, stated that the right-of-way for
66th Avenue has been acquired to provide access between Lucia Lane
and Pierce Street. He stated that this provides the City
possibilities for future development.
Councilman Schneider stated that the only reason for the variance
is because of the platted right-of-way. He felt that if a street
has not been constructed in the last thirty years, it should
probably be determined if there is a need for the right-of-way.
He stated that he can see the need to continue Pierce Street in
order to open up possible development of lots in the future, but
he questioned if the 66th Avenue right-of-way was really needed.
Mr. Flora stated that the 66th Avenue right-of-way is another way
of distributing traffic if Pierce Street is opened. He stated that
if this right-of-way is vacated, it eliminates an option.
Mr. Hickok stated that if 66th Avenue was vacated the land would
be added to the four adjacent properties. This would increase the
value of these properties from $2,000 to $3,900, and increase taxes
in a range of $44 to $86 per year. He stated that for this
particular site, the value would increase by $2,700, and taxes
would be increased by $59 per year.
MOTION by Councilman Billings to table this variance request and
request staff to submit a report on the pros and cons of vacating
the 66th Avenue right-of-way. MOTION FAILED FOR LACK OF A SECOND.
Councilman Schneider stated that he did not feel the variance is
very significant. He proposed to grant the variance and, if the
City vacates the easement, the petitioner would accept it. He

stated that this right-of-way is being used now by all the adjacent
property owners, and it seems the right-of-way should be vacated
and added to the tax rolls.
MOTION by Councilman Schneider to grant Variance Request, VAR
#95-31, with the stipulation that should the 66th Avenue right-of-
way be vacated by the City, the petitioner agrees to accept this
parcel, maintain it, and pay taxes on it. Further, to direct staff
to report on the pros and cons of vacating 66th Avenue. Seconded
by Councilman Billings.
Councilman Billings stated that he has a problem of approving a
variance that is within six inches of the right-of-way. He stated
that a variance has already been granted for 14-1/2 feet. He felt
that this would be setting a dangerous precedent. He stated that
it seems highly unlikely that the street will ever by constructed.
If the street is vacated, the variance would not be necessary. He
stated that if, in fact, the street is needed, a variance would
have been approved which is greater than any in the history of the
City when there really is not a hardship involved. This would be
in violation of the spirit and intent of the State statute. He
stated that he would vote against the variance because if the
street is not vacated and constructed at some future date, the
garage would be too close to the street.
Councilman Schneider stated that the garage has been there for 25
years, and the street has not been constructed. He stated that the
alternate location for the garage places it immediately behind the
house, and the driveway would have to be much longer. He stated
that the options are not very practical, and he did not feel there
would be a pressing need to construct this street.
Mr. Swanson, the petitioner, stated that if he built the garage in
the back, his neighbors would only have a view of the garage
instead of the trees. He stated that if he rebuilds the garage
where it is now located, he is still twelve feet from the right-
of-way. For the two foot variance, he would be ten feet from the
right-of-way. He did not feel that there would be that much of a
difference between ten or twelve feet.
Mrs. Swanson stated that these buildings have been in existence on
Lucia Lane over thirty years, and they wanted to improve their
property and construct a new garage.
Councilman Schneider asked if all four property owners must agree
to a vacation.
Mr. Hickok stated that the vacation policy for alleys has been to
have one hundred percent in support for a vacation. He stated that
staff viewed this as being similar to an alley vacation.
Councilman Billings stated that the most important question is
whether adjacent property owners are in favor or opposed, but the

vacation is at Council's discretion. He stated that the policy,
in particular to vacation of alleys, is that the City wanted one
hundred percent participation because that is an access to a
particular property. He stated that in this particular instance,
it is not that critical because access to these properties would
not be affected.
MOTION by Councilman Billings to table Variance Request, VAR #95-31
until the Council meeting on January 8, 1996. Seconded by Council-
man Schneider. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.

analysis of the pros and cons of vacating 66th Avenue and to
present a report to the Council prior to the Council meeting of

14. RESOLUTION NO. 91-1995 ADOPTING A DRUG AND ALCOHOL/POLICY
TESTING ACT AND RELATED REGULATIONS:
Mr. Hunt, Assistant to the City Manager, stated tat in 1988, the
Federal government passed a Drug Free Workplac ct that led to a
policy for all City employees that was approv by Council in May,
1993. He stated that in February, 1994, a ew set of regulations
were initiated for the Transportation S ety Act that included
municipalities. He stated this means at employees who drive
large trucks, drivers of buses which ransport sixteen or more
passengers, or drivers of trucks any size that transport
hazardous materials are subject to ese regulations. He stated
that the City is.required by law o have a policy covering these
kinds of occasions. He reviewed a six different kinds of tests.
Mr. Hunt stated that cities c choose to implement the regulations
individually or join a con rtium administered by a third party.
He stated that he is re ommending that the City enter into a
service agreement with err Transportation Services, Inc. doing
business as Metro -Test to administer the City's. participation in
their consortium. H stated that the City Attorney has reviewed
the agreement wi Kerr Transportation Services, Inc. and
recommends that a rovision be added that specifies this service
agreement is co ected to our policy. He stated that there is no
reference as to ow much insurance Kerr Transportation should carry
which should Irobably be included. He stated that there also is
some langua that is apparently omitted under Item 10, Indemnifi-
cation, wh ch should be inserted. He recommended that the resolu-
tion be a opted to approve the agreement and that the City Attorney

Ms. McPherson stated the request is for 6601 Lucia Lane which is
located in the northeast corner of the city. It is located at the
intersection of Lucia Lane and 66th Avenue. What is unique about
this intersection is that 66th Avenue is actually not constructed
between Pierce Street and Lucia Lane. The petitioner's property is
adjacent to a "paper" right-of-way. The property is zoned R-1,
Single Family Dwelling, as are all the surrounding parcels.

Ms. McPherson stated the petitioner is requesting a variance to
reduce the side yard setback on a corner lot from 17.5 feet to 0.5
feet. Currently located on the property is a single family
dwelling unit and a detached single car garage. The existing
garage measures 14 feet x 20 feet. The petitioner is proposing to
construct a garage 16 feet x 24 feet. The property did receive a
variance in 1965 in order to reduce the side yard setback from
14.27 feet, the distance of the dwelling to the south property
line, down to 3 feet to allow construction of the existing garage.
Ms. McPherson stated, as staff analyzed the request, there are
potentially three options the petitioner could pursue which would
avoid a variance request. The ',first would be to vacate the
adjacent right-of-way of 66th Avenue. In order for that to be
accomplished, all property owners abutting the right-of-way would
need to agree to the vacation, Staff understands from a
conversation the building official had with the petitioner that
there may be at least one property owner who would object to this
particular option. The second option would be to relocate the
garage toward the back of the property and 17.5 feet from the south
property line which would then comply with the code requirements.
The third option would be to relocate the garage to the rear of the
property facing 66th Avenue and acquiring an easement from the City
to drive on 66th Avenue in order to access the garage. The third
option would allow the petitioner to be in code compliance should
66th Avenue ever be constructed. The Commission also has the
option of granting the variance to maintain a distance of 3 feet.
Ms. McPherson stated the request as presented exceeds similar
requests which were previously granted. Staff, therefore,
recommends denial of the.request.
Ms. Smith asked where the driveway currently exists.
Ms. McPherson stated the current driveway extends from Lucia Lane,
parallel to 66th Avenue, to the existing garage.
Mr. Kuechle asked if the petitioner needed a new variance request
for the 3 feet.
Ms. McPherson stated yes. This is because the petitioner is
expanding the line of encroachment.
Mr. Kuechle asked how much property the petitioner would gain if
they vacated the right-of-way.
Ms. McPherson stated that according to staff's review of the plat,
the petitioner would acquire an additional 20 feet. The entire
right-of-way is 50 feet in width., When the area was platted, the
petitioner's lot is in one plat, and 20 feet of the street right -

of -way came from this plat to the north. An additional 30 feet
came from the plat to the south.
Mr. Kuechle asked if it was correct that, unless all the property
owners adjacent to the right-of-way agree, the right-of-way cannot
be vacated. Can the City Council override this?
Ms. McPherson stated the City Council could choose to vacate the
street over the objection of the adjacent property owner. It has
been the Council's policy to require unanimous approval by the
abutting property owners prior to approving a vacation.
Mr. Kuechle asked if this request would go to Council regardless of
the Appeals Commission's decision.
Ms. McPherson stated yes. All requests where staff recommend
denial go before the City Council.
Ms. Savage asked if the City would be giving up the road if the
vacation were approved.
Ms. McPherson stated yes. If the City were to vacate this right-
of-way, that would eliminate the City's option of ever completing
the street.
Mr. Kuechle asked if there was an interest in doing that.
Ms. McPherson stated not to her knowledge. It is, however, a
potential future option.
Mr. Kuechle stated it does not appear there is any property along
there that could be subdivided or better developed. -
Ms. Savage stated, in looking at the area, it does not look like it
would be made into a street.
Ms. McPherson stated this is correct, but the fact remains that the
possibility still exists.
Dr. Vos asked if there was any history of why this was not made a
street.
Ms. McPherson stated she did not research that item.
Dr. Vos stated the third alternative proposed by staff essentially
says the petitioner has to come and ask for a right-of-way to go
along the side. The property to the east has an attached garage.
The one to the south also has an attached garage so it would be in
an awkward position. He understands the house is 14 feet from the
side yard so that is in nonconformance as well.

Ms. McPherson stated yes.
Ms. Savage asked the petitioner to discuss the hardship and his
reaction to the alternatives proposed by staff.
Mr. Swanson stated the existing garage is falling apart underneath.
When the garage was built, it was built directly on a slab. The
slab is cracked and the wood is rotting at the bottom. In order to
repair it, they would need to lift up the garage and remove the
bottom. The garage they have is too small. The request is for 2
feet so there will still be some distance away from the property
line. If the street were put in, they are still 10 feet away from
where the street would be. He was also under the impression that
all property owners needed to agree to remove the street.
Ms. McPherson stated the City's policy to vacate the street has
been that all property owners must agree. She did not know the
City's policy in terms of installing the street.
Mr. Swanson stated the street goes nowhere. He was told by City
staff that, if the City gave the property back, he still could not
build anything on it. There will always be a right-of-way down the
center and they will always have to maintain that right-of-way.
Their neighbor to the south has a beautiful garden there, and there
is no way he would give a variance for that property. He did not
think 2 feet was such a big deal.
Ms. Savage asked if any of the neighbors objected.
Mr. Swanson stated he did not object. However, the taxes would go
up in excess of $90 per year. Others use the right-of-way now, but
do not have to pay taxes. They don't want the property on their
tax roles because they have free use of the property now. He did
not think the City would ever put a street in there. The street
runs only one block.
Dr. Vos stated there are some access problems. If he turned down
Lucia Lane, he cannot go east.
Ms. Swanson stated Lucia Lane is only a two -block street which
exits out to Highway 65. It only goes to Pierce. They maintain
the right-of-way and leave it open for walkers. Their neighbor
uses the area for gardens, etc., but does not want the property put
on his taxes.
Dr. Vos asked the petitioner why they propose to expand to the
south rather than to the north.
Ms. Swanson stated they have a cement patio with an awning and a
deck at the back of the house. They are trying to work with what

they have.. They are trying to go with a new structure to replace
a deteriorating structure.
Mr. Swanson stated there are also existing shrubs there.
Ms. Savage asked if any neighbors opposed their plan.
Ms. Swanson stated they do not oppose. She has talked to several
of them personally.
Ms. Savage asked if any of the three alternatives would work.
Mr. Swanson stated if he cannot get approval for 2 more feet, he
will probably raise the existing structure and rebuild the bottom,
put blocks under it so it does not rot. In 1965, they put the
lumber down and bolted it directly to the cement. He would prefer
to have a bigger garage with a new roof and have enough space for
his equipment. This will still be a single car garage but
measuring 16 feet x 24 feet.
Ms. Swanson stated rather than having to tear everything out and
move it they want to expand their garage by 2 feet on one side and
4 feet on the back.
Dr. Vos asked, if the street were installed, how far would it be
from the curb to the garage.
Ms. McPherson stated the City typically builds 30 foot wide
streets. Assuming it was centered in the right-of-way, there would
be 10 feet on either side. The proposed structure would be
approximately 10.5 feet to it feet from the curb. As it currently
exists, there would be approximately 13 feet.
Mr. Swanson stated he did not think the City would ever put a
street in there. He was under the impression that if one owner
said no, they could not it.
Dr. Vos stated that is different than vacating. A vacation says
that you are willing to put the area on your property and on the
tax roles. That is different than saying we need a street for
public safety, etc. If the street were vacated, the property would
eventually pay taxes. If the street were installed, the owners
would be assessed for curb, etc.

think being at 10 feet or 12 feet makes that much difference.

Mr. Kuechle stated he would recommend denial of the request. Even
though it is only 2 feet, it means we are granting a variance to
0.5 feet from the right-of-way. This is something that has not
been done before. The vacation needs to be further investigated.
What is happening here is the property owners enjoy the property
rights that they would as owners but do not own it. The petitioner
should check out whether or not the taxes really amounts to $90.
If the value of the property is $4,500, that figure seems high.
He would recommend denial of the request.
Dr. Vos stated this is tough because, when you have a street that
may not be there, it is hard to talk about a variance because there
is no property next to it. There is no neighbor there being
affected. He does not want to set a precedent but thought the City
Council needs to solve the dilemma.
Ms. Smith stated this is an unusual situation. She would be
inclined to approve the variance but she has a problem with setting
a precedent.

Request, VAR #95 -31, -by Anthony Swanson, to reduce the side yard
setback from a street right-of-way from 17.5 feet to 0.5 feet, to
