The Appeals Commission reviewed the variance request at its October 11, 1994 meeting. The request is in two parts: 1. To reduce the parking setback from the public right-of- way from 35 feet to 20 feet. 2. To reduce the setback of a parking lot from the property lines from 10 feet to 5 feet and 0 feet. The variances are in response to Section 205.07.01.C.(7).(a) of the Fridley City Code, which allows as a special use off-street parking for adjacent uses in the R-1, Single Family Dwelling district. RECOMMENDATION The Appeals Commission voted unanimously to recommend approval of the request to the City Council with the following stipulations: 1. The subject parcel is zoned R-1, Single Family Dwelling. REQUEST• The request is in two parts: 1. To reduce the parking setback from the public right of way from 35 feet to 20 feet. 2. To reduce the setback of a parking lot from the property lines from 10 feet to 5 and 0 feet. The City acquired 5720 Polk Street as part of the Polk Street reconstruction project in 1992. Polk Street's designation as a Minnesota State Aid Street required its reconstruction to meet certain standards. This required the City to acquire additional right of way which then adversely impacted the subject parcel due to the location of the original dwelling on the parcel. The City demolished the original dwelling and reconstructed Polk Street. The lot, minus the right-of-way for the reconstruction, totals 16,500 square feet. The City is proposing to convey 5,705 square feet to the petitioner for the parking lot expansion, subject to the variance, special use permit, and lot split approvals. To the south of the City's parcel are the Moore Lake Apartments. This apartment complex has experienced a number of parking problems in recent years. Tenants from the apartment building end up parking on Lynde Drive especially during the evening Staff Report VAR #94-26, by David Stewart Page 2 hours, because the parking lot is full. The City Council will not remove the "no parking" signs on Lynde Drive because of safety issues. According to the petitioner, about 8 - 15 cars end up parking on Lynde Drive. The petitioner and the City have evaluated a number of options to resolve the problem. In an effort to eliminate on -street parking on Lynde Drive, the City has agreed to pursue selling a portion of the property to the petitioner for additional parking. The HRA may provide a low- interest loan to the petitioner to accomplish the parking lot expansion. The remaining portion of the City's lot will be sold as a buildable lot. In addition to this variance request, the petitioner is also requesting: ♦ a lot split, to split off the south 35 feet of the subject parcel. ♦ A special use permit is also required to allow automobile parking for an adjacent use on property zoned R-1, Single Family. ♦ The petitioner is also rezoning the parcel to the west as a result of negotiations with the owner, Mr. Gilstad, to allow an easement for snow storage and dumpster placement. These items will be reviewed by the Planning Commission on October 19, 1994. ANALYSIS• Section 205.07.0l.C.(07).(a) of the City Code allows off street parking for an adjacent use if a special use permit is issued. This section of the code requires parking setbacks of 35 and 10 feet. Public purpose served by this requirement is to limit visual encroachment into neighboring sight lines, and to allow for aesthetically pleasing open areas adjacent to public right-of- ways, and to provide adequate space for screening of parking areas from adjacent use. Public Right -of -Way The petitioner requests that the parking setback from the public right of way be reduced from 35 feet to 20 feet. The standard parking setback from the public right of way is 20 feet in commercial and industrial districts. The redesigned parking area will provide 18 spaces if the variance is granted. Ten existing 8C Staff Report VAR #94-26, by David Stewart Page 3 spaces will be removed. If it is not granted, only 12 spaces will be provided. Granting the variance would not adversely impact the adjacent property's site lines, as the proposed parking area would be lower than a dwelling constructed on the remnant portion of 5720 Polk Street. It also does not impact site visibility, as there will not be an exit from the parking area directly onto Polk Street. The existing apartment building to the south is set back 20 feet from the property line. The City granted a similar variance (to 25.5 feet) in 1992 for 910 and 950 Lynde Street to allow the expansion of a parking lot for automobile parking for an adjacent use. Expanding the parking area to the west is not possible since the property owner (Gilstad) does not want to convey additional property. If the variance is granted, the petitioner should be required to install landscaping to screen the parking area.from the street. ** Stipulation ** The petitioner shall install landscaping along the street as indicated on the plan developed by staff including the following elements: 1. 2 - Nanking cherry 2. 6 - Maney juniper 3. 8 - Isanti Dogwood 4. 14 - "Miss" Rim Lilac 5. Weed Barrier 6. 311 Rock Mulch 7. vinyl Edging Because of the change in elevation, there will be a retaining wall along the north lot line. Concrete bumpers should be installed two feet in front of/along the wall. All other expanded parking areas shall be lined with concrete curbing. ** stipulation ** The parking lot perimeter, except for the area next to the retaining wall, shall be lined with six-inch concrete curbing in accordance with Fridley Engineering specifications. setback from Adjacent Lot Lines The petitioner requests that the setback from the adjacent lot lines on the west and north be reduced from 10 feet to 5 feet on the north and to 0 feet on the west. The petitioner will be storing snow on the property to the west owned by Mr. Gilstad. The purpose of the setback requirement is to provide adequate screening of the parking lot from adjacent uses. Adhering to the Staff Report VAR #94-26, by David Stewart Page 4 from adjacent uses. Adhering to the setback requirements would prevent installation of the parking lot to code standards. Further, lot area taken from the City lot would necessitate the removal of the large tree on the lot and reduction of the lot width below the minimum lot width. Reduction of the setback would not create traffic or visibility conflicts with adjacent uses. The City has granted similar requests in the past. Proper screening by the use of a fence and landscaping should be provided. The fence should be six feet in height up to 35 feet from the Polk Street lot line in order to provide sight distance for a new home on the City's lot. ** stipulation ** The petitioner shall install a six foot high board on board screening fence constructed of treated wood parallel to and 2 feet from the north property line. The fence height shall be reduced to four feet at a point 35 feet from the Polk Street lot line. Engleman Ivy shall be planted 2 feet on center on the north side of the fence. RECOMMENDATION/STIPULATIONS: The request does not have an adverse impact on adjacent properties. The request will resolve a long-standing parking problem. Staff has no recommendation regarding the request since it is within previously -approved requests. If the Appeals Commission recommends approval, staff recommends the following stipulations: 1. Ms. McPherson stated the variance request is for 5720 Polk Street which is generally located west of Polk Street and north of the Moore Lake Apartments. The subject parcel is zoned R-1, Single Family. The property to the west is zoned C-1, Local Business, APPEALS COMMISSION MEETING. OCTOBER 11 1994 PAGE 2 and the property to the south is zoned R-3, General Multiple Family Dwelling. Ms. McPherson stated this request is in two parts and is part of the multiple development applications by the petitioner. The first request is to reduce the parking setback from a public right-of-way from 35 feet to 20 feet. The second request -is to reduce the setback of a parking lot from the property line from 10 feet to 5 feet on the north and 0 feet on the west. Ms. McPherson stated, in conjunction with this request, the petitioner is also processing a lot split, a special use permit, and a rezoning request. This .is part of a general development plan for this area of the City. The City acquired the parcel at 5720 Polk Street, also known as the Branco property, in 1992 as part of the Polk Street reconstruction project where the street was widened. The City.decided, due to the location of the existing dwelling on the.parcel, that it would acquire'the entire parcel, demolish the existing dwelling.,. and then resell the property as a buildable lot once the.street reconstruction was completed. At the same time, -the petitioner indicated a need for additional parking. The complex has experienced a number of parking problems in.recent.years. The tenants from the apartment complex park on Lynde Drive in the evening hours after the parking lot for the apartment complex becomes.full. The City Council is not willing to remove the no parking signs on Lynde Drive because of safety -issues. The.petitioner has indicated that approximately 8-15 parking spaces would alleviate the safety concerns and the need for tenants to park on Lynde Drive.'.The City_has.agreed to assist -the petitioner in attempting to partially resolve the parking issue, hence the need for the lot split. The City would be splitting the south 35 feet of the Branco property and selling it to the petitioner for the construction of parking spaces. Ms. McPherson stated the petitioner has negotiated with the adjacent property owners to further pursue additional parking. The petitioner negotiated with Mr. Gilstad, whose.property is directly west of the Branco property, to obtain an easement for snow storage.purposes along the north property line, which would alleviate and improve the parking situation during the winter. As a result of these negotiations, the petitioner will be rezoning Mr. Gilstad's property from C-1, Local Business, to R-1, Single Family Dwelling. Ms. McPherson stated the first part of the request is to reduce the parking setback from the public right-of-way from 35 feet to 20 feet on the property adjacent to Polk Street. The standard setback from the public right-of-way is 20 feet in commercial and industrial districts. As proposed, the parking area would provide 18 spaces if the variance is granted. 10 existing spaces would be removed; a net gain of 8 which is the minimum needed to improve the parking situation on the property. If the variance is not granted, only 12 spaces would be created. Granting the variance would not adversely impact site lines or adjacent property. The area in which the parking area is to be constructed is lower than the remnant piece to the north. The existing apartment is also set back at 20 feet as opposed to 35 feet which is the setback from the public right-of-way for a building. There will not be an exit to Polk Street from the parking spaces so there is not a concern from a traffic visibility standpoint. Ms. McPherson stated the City has granted similar variances for the properties at 910 and 950 Lynde Street, directly across the street from the subject parcel, to allow the expansion of the parking lot for the use by the Hillwind Office Center. There is not an opportunity to expand the parking area to the west-,on.the_ adjacent property although those -properties are vacant. The owners are unwilling to sell additional property to the petitioner. Ms. McPherson stated, if the Commission chooses to grant the* variance, staff has developed a landscaping plan.to provide screening which is required from the public right-of-way.. In addition, there will be a retaining wall constructed five feet - from the property line. Staff is recommending that, in front of the retaining wall, curb stops be placed two feet in front.of the retaining wall. to prevent.cars from parking and hitting the: } retaining wall. In all other areas. of the parking, the typical B6-12 concrete curbing would be required to be installed by the petitioner. In addition, the parking area is to be paved in accordance with the engineering standards of the City. Ms. McPherson stated the second part of the variance is to reduce the setback from the adjacent lot line from 10 feet to 5 feet along the north property line and to 0 feet along the west property line to allow access and maximize the amount of parking available on site. To the west, the petitioner has obtained a snow storage easement along the north property.line. The dumpsters will not be relocated, but will remain.where they are presently located on the site. OCTOBER 11 1994 PAGE 4 Ms. McPherson stated, by not granting the variance, additional property would need to be conveyed to the petitioner by the City which would then reduce the buildable area on the property to the north. Conveying additional property would reduce the lot to below the minimum lot width requirements of the City. Reduction of the setback does not create any traffic or visibility conflicts with adjacent uses. This parking area is below the elevation of the remnant piece. Staff has indicated that proper screening of this parking from the proposed single family dwelling to the north should be provided by a fence and landscaping. Ms. McPherson stated that the request does not have an adverse impact on adjacent properties and the request will help to resolve a long standing parking problem. Ms. Savage asked if the large tree located on the property would be affected. Ms. McPherson stated it would not be affected. The tree is north of the proposed parking area. Ms. Smith asked, if the request is approved, would the lot size of the remnant be 77 feet by 140 feet. APPEALS COMMISSION MEETING. OCTOBER 11 1994 PAGE 5 Ms. McPherson stated yes. Mr. Stewart, Managing Partner of Moore Lake Apartments, stated the building was constructed in the late 1960's to early 1970's when the requirements for cars was less. There are spaces for 70 cars for 64 units. Things have changed. Most people now have two cars, and this has created serious problems for the tenants. It became serious about 1 1/2 years ago. The partnership invested about $200,000 in the property to upgrade it which resulted in a better grade of tenants. They have about 95%-980 occupancy, and many tenants have two cars. If they have guests, they have no place to park. Our managers will be up in the early hours of the morning to find a place for tenants to park. Mr. Stewart stated, about 1 1/2 years ago, the City removed on - street parking and that really presented a problem. He appeared before the City Council and asked that tenants be allowed to park on the street and they would monitor. He believes there have been a few problems with the City. He..was not sure if the City would take this away or let them have it. It has provided parking for guests for residents and for some of the tenants themselves. Without additional parking, -the apartment complex is landlocked and has no place to expand. That is the only property we have access to. From an economical point of view, a lack of parking has a negative effect on the type of tenant we can attract. Ms Savage •asked if the petitioner had any problems with -the stipulations as recommended by staff. Mr. Stewart stated he had discussed with City staff to provide concrete curb. They are going to resurface the entire lot. Water drains to the north. If they are to put curbing to the _north, this,would catch water rather than allow it to go down. The parcels are.waterretention areas. Ms. McPherson.stated the curbing is only for that strip of land conveyed from the Branco property.. Mr. Stewart stated he than had no problems with the stipulations. Councilperson Jorgenson has visited the site. They have had a good response from the neighbors. The buildings look better and the type of tenants are better. Problems have disappeared from the site. They have had good cooperation from the City. Mr. Stewart stated the existing parking area which is immediately north of the apartment building is so narrow that, in the summer, they can get about eight cars there but they must back in and must be small. In the winter, because of the plowing problems,. they have to take snow all the way to the far western edge to dispose of it. It is very inconvenient and difficult. NOTION by Mr. Kuechle, seconded by Ms. Smith, to close -the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:52 P.M. Mr. Kuechle stated he was in favor of recommending approval. The petitioner has made a good case for the parking. It is in keeping with the efforts of the City to upgrade the apartment stock, keep them well maintained and in good repair. The City -is saying there is no parking on Lynde Drive. It seems they could not do much but recommend approval. Ms. Smith agreed. Ms. Savage agreed. It indicates in the..reports there is no adverse effect. It seems -to be a positive step. At the time the structures were built, 64 parking spaces were required. Current code requirements would dictate installation of 109 spaces; therefore, 39 spaces are required if the parking lot were to meet today's standards. If a 35 foot strip was acquired from the Gilsted, the Union 76, and the City's property to the north, 48 net additional spaces would be provided for a total on the site of 120 spaces (see attached site plan). A fence and new dumpster enclosures will be required because of the expansion. If the City Council chooses not to include the City's property, 16 spaces would be subtracted, leaving a total 104 spaces, 5 short of the current requirements. Dave Stewart and Carol Lee Zinter on a number of occasions have indicated that about 15 to 20 additional parking spaces is needed to resolve the parking problems they have observed on the property. Adding the 70 existing parking spaces to the perceived need for 20 equals 90 spaces. Therefore, at least 14 to 30 additional spaces would be provided under either expansion option. Project Costs The Engineering Department has calculated an estimated project cost. In some areas along the property line, there are holes up to 6 to 8 feet. Because of the amount of filling required along the property line and the change in elevation, a retaining wall would be necessary. The cost to construct the additional parking area as shown on the attached site plan and is estimated to be $103,000. This does not include the platting costs necessary to divide the 35 foot strip from the adjacent properties. All of these properties are Moore Lake Apartment Parking Problem February 4, 1994 Page 2 Torrens, and a plat would be required by Anoka County. Because of the number of ownerships, title issues, and surveying involved, $5,000 to $7,000 would probably be necessary to accomplish the subdivision. If 16 spaces were subtracted from the City's property, some savings would occur in the asphalt and concrete curb costs; however, most of the cost for the project is as a result of the amount of fill needed on the Gilsted and Union 76 property. Subdividing 35 feet from the City's property would not affect the buildability of the property. The remaining dimensions would be approximately 77 feet by 140 feet. We will be prepared to discuss this issue with the City Council at Monday night's meeting. MOTION by Councilman Schneider to authorize parking on the north side of Lynde Drive until May 1, 1994, with the condition that the owners and/or managers of Moore Lake Apartments work with City staff to develop an alternative solution to the parking problems without relying on on -street parking. Further, that staff submit a written.report on this progress to Council by March 15, 1994. Seconded by Councilwoman Jorgenson. Councilman Billings asked what has changed now that Council should authorize parking on Lynde Drive. He stated that there obviously was a good reason for not allowing parking on the street. Councilman Schneider stated that the reason for the motion is that the owners have made a substantial investment in the property to create a better neighborhood. He stated that he is sympathetic that the owners will not be able to retain the tenants if there is not parking. He stated he trusts that Mr. Stewart is willing to work on a solution to this problem. Councilman Billings stated that because he is unable to reconstruct the circumstances that parking was not allowed on Lynde Drive, he would be willing to support the motion for temporary removal of the "ono parking" signs. He stated that once May 1 comes, he will be much more concerned with whether or not parking is allowed on Lynde Drive. Councilman Schneider stated that he shares Councilman Billings concern. If May 1, 1994.comes and the situation is exactly where it is today, then Mr. Stewart has a problem. He stated that he wished to request the Council to lift the parking ban on Lynde Drive to ease some of these parking problems. Mr. Stewart stated that he would like to know how to proceed to get this matter on the agenda, as it is an emergency situation. He stated that they are involved in an improvement project for the apartment complex, and the apartments are one hundred percent occupied. He felt that if the problem was not resolved, they would be losing good tenants. Mr. Stewart stated that he met last summer with members of City staff, Barb Dacy and Steve Barg, as well as the owner of the property immediately behind the apartment complex to discuss acquiring this property; however, that did not materialize. TO REDUCE THE SETBACK OF A PARKING LOT FROM THE PUBLIC RIGHT-OF-WAY FROM 35 FEET TO 20 FEET, AND TO REDUCE THE SETBACK OF A PARKING LOT FROM THE WEST AND NORTH LOT LINES FROM 10 FEET TO 0 FEET AND 5 FEET, GENERALLY LOCATED AT 5720 POLK STREET N.E. (WARD 2): Mr. Hickok, Planning Coordinator, stated that this variance request is to reduce the parking setback from the public right-of-way from 35 feet to 20 feet and to reduce the setback for a parking lot from the property lines from 10 feet to 0 feet and 5 feet. He stated that the variance is requested in conjunction with the expansion of the parking lot at the Moore Lake apartment complex. Mr. Hickok stated that the Appeals Commission has recommended approval of these variances with three stipulations and staff concurs. Councilwoman Jorgenson stated that the management of the Moore Lake apartments has been wonderful with the enforcement of the parking. She stated that one concern of residents is that they would like the on -street parking removed. Mr. Stewart stated that he would like to request that Council extend their parking privileges through the winter months until they can construct the parking lot. He stated that it is the process which they must go through which has caused some delays. Mr. Burns, City Manager, stated that Council may want a report from the Public Works and Police Departments to determine if there have been any problems with the on -street parking. 9. ESTABLISH A PUBLIC HEARING FOR JANUARY 9. 1995, TO CONSIDER SURPLUS AND AUTHORIZING THE SALE THEREOF: MOTION by Councilman Schneider to set the public hearin on this item for January 9, 1995. Seconded by Councilwoman Bolcom. Upon a voice vote, all voting aye, Mayor Nee declaredZthemion carried unanimously. Councilman Billings pointed out that it woulbly be the middle of March before this process is comp eted, so no action could betaken by the owner of the Moore Lake apartments until this is completed. 10. _AWARD 1995 CORRIDOR MAINTENANCE CONTRACT PROJECT NO. 275: s Mr. Burns, City Manager, stated that the City has been pleased with the contractor for the corridor maintenance project, and staff recommends the extension of thi3/contract for 1995. He stated. that the contractor has agreed to she same amount as the 1994 bid with the addition of a 6.5 1 rc t sales tax.
