It was brought to this departments attention and verified through an onsite inspection on April 29,.1974 that the refuse storage area at the above site was being maintained in violation of the Fridley City Code, Section 113, Waste Disposal. The inspection on that date found a mattress and bedspring deposited on the ground adjacent to the refuse container. Furthermore the bulk type refuse container did not have a lid on it. An inspection of the adjacent areas forces me to -conclude that items are blowing or otherwise scattering about the area. Therefore, this department will remind you as a property owner in the City of Fridley of your obligation to prevent refuse from littering adjacent property. I am writing in regard to the extreme difficulty we are having with keeping trash and garbage from being deposited in our backyard by the tenants of two apartment buildings immediately behind the property we are renting, We 'dill have lived here for three years this May and each year the problem gets worse. I would appreciate it very much if you would look into the matter and see if anything can be done. I cannot believe that, as a renter of property that just happens to be at the back of two apartment buildings. I have to look any longer at my neighbors' inconsiderate attitude. The enclosed map briefly describes the situation. The difficulty is with keeping trash out of the nary band of yard between �, ve of trees and the south property line. Uhen we rented this prepert landlord. Mr Low Hedlund of 532D Russell Ave N. Minneapolis, told us that it would be our re.. sponsibility to keep this strip of land picked up. At first we didn't think Biu:a of much of it; we didn't think it would be difficult at all to keep this strip mewed and policed. We were not prepared for what actually occurred. Picking up involves more than just rounding up stray rubbish from the dumpster; it involves removing old hires, baby crib springs, old oil filters and cans, spare and junked auto parts of every description, entire sacks of garbage deposited 100 feet away from the dumpster, and the usual line up of busted glass, old boards, nails, you name it. When we brought this matter up to the attention of Mr Hedlund we were told that he was aware of all this (obviouslyi) and that nothing could be done. The best we could do, he informed us, was to keep it neat back there so that people wouldn't mistake it for a junkyard and would stop leaving their debris there. And we did. We even had a vegetable garden back there. But it seemingly did little good. The following yearAwe renewed the battle. (N1A� 14� Thi s time the vegetable garden was overrun by the children living in the apartments and the trash problem inoreased. The Fridley police told us that we could put up Vo Trespasslang Signse and they would arrest anyone who trespassed; that is, if we could catch them and hold them til they arrivedt We didn't see what relationship $hat had with the trash but at least„we thought, it would keep the strap kids out of the garden. We knew were up against something when the signs were torn downt (loq %57 Last SpriI got desperate for a solution and spent one entire afternoon trying to hammer out a solution. My landlord refuses to build any kind of a fence or barrier. The police referrred me to the city (Fridley) environmentalist. He toad me there was nothing he could do unless I could actually catch someone in the act of throwing rubbish on my property. I reminded him of something Mr Hedlund had mentioned to uss supposedly, the owners of the apart- ments are rewired to maintain three Demsy D mpsters with lids in an enclosure that surrounded them on three sides. 'khan I told the environmentalist of this fact and that the only thing we had ever seen back there was a lidless dumpster In a falling down tw -aided barricade, he simply shrugged his shoulders. My argument that it was no one spodific tenant, but the entire population aided and abetted by owners who weren't doing their duty because the city environ- mentalist wasn't enforcing the law fell on deaf ears. Our conversation ended when he reminded me that it was my duty under the law to keep the place clean and that if I didn't, they'd fine at The City Engineer overheard our "conversation" and thought he had a solution. According to Fridley ordinance, when an RA or R-2 property (Residential single unit or duplex) is alongside an R.3 property (the apartments), the owner of the R.3 property must put up a six foot high barrier along that lino. We thought to had the problem solved. You can imagine our shock and dismay at finding out that our back yard is zoned commercial, negating the ordinance' 's off ectf Apparently, from letters on file at City Hall which I have seen and read, Mr Hedlund owned the property the 76 station is on and the empty lot between it and the apartments. Nhen he sold it to nitre Ail Co. Urden 76's predecessor, the property, including our back yard, was zoned commerbial because pure Ail was going to put a little grocery store next to the station and use our backyard as a parking lot. I asked Mr Hedlund if he would give me permission to have the property rezoned if I would do the necessary work and put up the necessary fees. He refuses. since apparently the property is worth more commercial. A former neighbor of ours speculates the entire area on the map may one day be com- mercial so Mr Hedlund doesn't want it rezoned. And Mr Hedlund has only helped no once to clean up the . mess in our rented backyard= the extent of his aooper- atL*n goes no fbrther. And about the only result I have to show for my efforts is the fact that my neighbor, Joe Branco. got the apartment owners to build a fence between his property and thei.rst a handsome fence I saint they mould continue clear across the back of my propertyl ,So here it is, our fourth spring here. As the enclosed pictures indicate, I'm looking at a monsiderable mess new that the snow has melted. (mese were taken two weeks ago, during our first warm spell) our first robin appeared this morning along with a line of trash that is disgusting to say the least. A vegetable garden is out of the question. I`ve done everything I can to solve the problem on my own but apparently I haven't got the clout you people have. Evidently when these buildings were built permits called for only one parking place per unit. There- fore we have only 64 parking places. We have asiigned these one to each unit. All areas around us are posted no parking on the street. Our residents have approached us asking us to be spokesmen for them in an attempt to get some relief on the parking situation. As you are aware, Polk Street, Lynde Drive and Hillwind Drive are all posted with "No Parking" restrictions; thereby eliminating any on -street parking pro- visions. Due to the fact that all three of the above referenced streets are of the minimal 30' face of curb to face of curb, on -street parking can not be provided while still retaining two-way traffic. You had suggested making Lynde Drive a one-way street thereby, providing suffi- cient width for both on -street parking and the one-way lane designation. In reviewing this recommendation, it has been determined, as seen by the attached sketch, that if Lynde Drive were designated as one-way, in the eastbound direc- tion, it would restrict access to the apartment complex from southbound Central Avenue. Apparently, Mr. Gilstad owns a vacant lot directly north of Moore Lake Apartments (995 Lynde Drive N.E.), and he has experienced a problem with apartment residents throwing trash and other materials over the fence onto his property. Upon inspection, I observed no problems on the Moore Lake Apartments side of the fence, but there was an assortment of materials and debris on Mr. Gilstad's property. I spoke with on- site manager, Judy Clemons, regarding the illegal dumping issue. Ms. Clemons stated that she has worked hard to maintain their property, but she has no control over tenants' actions. I instructed Ms. Clemons to maintain their property and advised her to inform her tenants concerning the criminal nature of illegal dumping. (See attached letter for further information.) The problem experienced by Mr. Gilstad is criminal in nature and should be addressed primarily through law enforcement channels. I have advised Mr. Gilstad to contact the Fridley Police Department to report and pursue such incidents. I will continue to work toward appropriate maintenance of the Moore Lake Apartments property. I have indicated that they may be held responsible for debris and materials thrown over the dwmpsters to the Gilstad property, and they have indicated that they will attempt to periodically clean this area. Concerning the enclosures, Mr. Bucklin has agreed to install a concrete block enclosure at the existing dumpster location. MAs work should be completed by July 31, 1992. 4. Abatement. Mr. Gilstad has requested that the City work with all property owners involved to clear the site and assess the cost based on the amount of land owned by each. Staff will attempt to work with the property owners to clean up and maintain their respective areas. The adjoining property to the north has a considerable depression as well as a number of large trees which need to be removed and the area filled for proper access and drainage. Option 1 addresses a uniform slope from the east to the west and a retaining wall along the northerly curb line to provide for a relatively level parking and driving area. This option costs approximately $103,000. Option 2 considers a two tiered parking area by constructing a retaining wall along the existing parking area and leveling the new parking area and driveway to the north. This option costs approximately $100,000. Option 3 is cutting and filling the area in an attempt to slope the parking and driveway as minimally as possible. The estimated cost for this is $75,000. In all options, the drainage for the additional parking is maintained on site and then conveyed to the Hillwind storm sewer system. Based upon the information available, the additional 36 ft of property would provide for a 12 -ft driveway around the area and a 36 ft area for two diagonal parking spaces. If additional driveway width is required, it will be necessary to acquire additional area for the increased width.
