Dear Mr. Ryan:
Recently you inquired about a garage setback deviation at the property at
1001 Lynde Drive N.E. in Fridley. We have researched the situation and found
that the garage was built before Polk Street was platted. Therfore it is
considered a legal non-conformina use Under the non -conforming uses and
structures section of the Code it states that "whenever a lawful
non -conforming structure is damaged by fire, flood, explosion, earthquake,
tornado, riot or act of God, it may be reconstructed and used as before if it
is reconstructed within 12 months after such calamity except if the damage
to the building or structure is 50 percent or more of its fair market value -
as determined by the City, in which case the reoonstructicn shall be for use
in accordance with the provisions of this chanter
The Dresent Code calls for a setback of 17.5 feet from the side lot line on a
corner lot. The current garage appears to be 10 feet from the right of wav
Should the garaae be damaged bevond 50 percent of its value as previously
stated, it would have to be reconstructed at a setback which meets today's
Code.
