1. PUBLIC HEARING: CONSIDERATION OF VARIANCE REQUEST VAR #97-19
BY SCOTT & CONNIE MASICA:
Per Section 205.07.03.D.(2).(c).((3)) of the Fridley City Code, to reduce the
setback of an accessory structure on a comer lot from 25 feet to 20 feet to allow
the construction of an addition to an existing two -car garage on Lot 1, Block 3,
Lyndale Builders 6th Addition, the same being 1070 Lynde Drive.
MOTION by Ms. Beaulieu, seconded by Ms. Mau, to waive the reading of the public
hearing notice and to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M.
Ms. McPherson stated the variance request is to reduce the side comer setback of an
accessory structure from 25 feet to 20 feet. If the request is approved, a 16 -foot x 24 -foot
addition to the existing detached garage would be constructed.
Ms. McPherson stated the subject property is located at the southwest comer of Lynde
Drive and Fillmore Street. Located south of and directly adjacent to the subject parcel is
property zoned R-2, Two Family Dwelling. A duplex is located on the property.
Ms. McPherson stated the petitioners' dwelling was constructed in 1960 and the existing
garage was constructed in 1965 at a 20 -foot setback. The purpose of the code section is
to preserve off-street parking and to reduce line -of -site encroachment from the neighbor's
property. The petitioners have installed the garage slab and the first row of blocks for the
proposed addition. The garage, as well as the proposed addition, would face Fillmore
Street.

Ms. McPherson stated there. is adequate room for off-street parking. Typically, the City
requires that face-to-face parking stalls in a parking lot be 20 feet deep. The windows in
the adjacent duplex on Fillmore Street are on the second story. The duplexes are
constructed such that the garage is on the first level with living space above the garage.
There is little or no line -of -site impact from this request. The petitioners have also
constructed a privacy fence which also provides separation between the two uses. This
request is within previous approvals. The City has granted variances of this nature down
to 8 feet.
Ms. McPherson stated staff has no recommendation since this request is within
previously granted requests. Typically, for this type of request, staff stipulates a hard
surface driveway. However, the petitioners have already completed that particular part of
the project so a stipulation of that nature would be redundant.
Ms. Beaulieu asked, when the existing driveway was constructed, was the code
requirement then 20 feet?
Ms. McPherson stated she believed the code was 20 feet at that time.
Mr. Kuechle asked if there was a building permit when the garage was originally built.
Ms. McPherson stated, yes.
Mr. Kuechle asked the petitioners if they had any additional comments.
Ms. Masica stated if they were to push the garage back an additional 5 feet, that would
limit what little back yard they have. They thought that would obstruct more or look odd.
Mr. Kuechle asked how the slab came to be.
Ms. Masica stated this was their second attempt within a year to have the old concrete
driveway tom up. They had a new concrete driveway put in and then doubled in width
and to also have the garage slab. The first time this was done a floating slab was put in.
The contractor at that time evidently did not check the building code requirements for
putting an addition on a floating slab attached to something that had a foundation. They
did not need to pursue that any further because the concrete crumbled and washed away
in less than a year. They have fought with the concrete company who did supply a new
batch of concrete to replace the faulty concrete. They are still pursuing the contractor
whom they cannot at this time find. The concrete company put in another slab.
Ms. Masica stated her lack of communication with Mary over the phone trying to describe
what she needed, what required a permit and what did not, she thought that anything that
was concrete she could go ahead and do without the permit but that once they began
with the lumber they would need to get a permit. The same day she received a call
saying this was 5 feet too close. The same day, Mary called back saying the new
contractor wants to have the foundation inspected and for which the petitioners did not
have a permit. If they cannot get it done this week, the contractor will leave them until

April so they will be sitting with a mud driveway. She said she would take a chance, have
the footings and foundation put in and approved at each step of the way and the proper
driveway. If the request is denied, if nothing else, she would fill the blocks with dirt and
plant flowers. They went ahead, worked with staff through what they could, and are now
at this point.
MOTION by Ms. Beaulieu, seconded by Ms. Mau, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:42 P.M.
Ms. Mau stated she did not see a problem with the request. It would look strange to set
the addition back 5 feet more. As long as they have a driveway, it should be fine.
Ms. Beaulieu agreed. Staff reported there is no problem with off street parking or with the
line -of -site. The hardship is because of the comer lot having more restrictions. She
would be favor of approving the request.
Mr. Kuechle concurred. The request meets the spirit of the code. He would be inclined to
vote in favor of the request.
MOTION by Ms. Beaulieu, seconded by Ms. Mau, to recommend approval of Variance
Request, #97-19, by Scott and Connie Masica, to reduce the setback of an accessory
structure on a comer lot from 25 feet to 20 feet to allow the construction of an addition to

We are submitting a formal request(variance) to allow for a 3rd garage stall to be attached
to the existing 2 stall detached garage on the property (corner lot) of Lynde Drive and
Fillmore Street, at 1070 Lynde Drive Fridley Mn.
This requires a variance as, in the 1960's when the home and garage were originally built,
the building inspection sign off was incorrect regarding the setback of the garage from
Fillmore Street.
According to the City of Fridley ` Variance Conditions', we feel the following
conditions apply:
1) `Circumstances that do not apply to other property within the immediate area'; There
currently are several other homes within the area that have approximately the same
(setback) that we currently have on our existing garage. In addition, the new
townhomes located at the end of Fillmore Drive were granted a variance for a
reduction of driveway/garage setback for several units at Appeals meeting that I was
in attendance.
2) `Necessary for the preservation and enjoyment of property'; To date, we have
completed several projects to improve both the visibility and personal enjoyment of
our residence which includes extensive landscaping in the back yard directly to the rear
of the proposed addition and existing garage. Therefore, if we are required to
`setback' our new garage addition an additional (5) feet to meet current setback
requirements, it would greatly inhibit the amount of recreational space for our family.
3) `Unnecessary hardship'; Had we been aware that the original garage was not of legal
code, we would have exercised our right to an appeal in 1996 at the time we presented
a request for variance for a window addition. In addition to this, we have already
extended our driveway area with new concrete to allow for the space to drive into an
addition of a 3rd stall. This driveway restoration did not require a permit from the City
of Fridley.
4) `Detrimental to the property in the vicinity'; We believe that if we were forced to
setback the 3rd stall only of the garage, this would destroy the appearance of the entire
building structures on the premises. By granting the request, it in no way would be
