PUBLIC HEARING: CONSIDERATION OF VARIANCE REQUEST, VAR #95- 29, BY CLIFFORD AND MARY BOLTMAN: Per Section 205.07.03.C. of the Fridley City Code, to increase the maximum lot coverage from 25% to 28.7% to allow construction of a 22 foot x 26 foot addition, on Lot 14, Block 3, Melody Manor, generally located at 7301 Lyric Lane N.E. MOTION by Ms. Smith, seconded by Ms. Beaulieu, to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON IMCHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:00 P.M. Ms. McPherson stated the request is for 7301 Lyric Lane which is located at the intersection of 73rd Avenue and Lyric Lane. The request is to increase the maximum lot coverage from 25% to 28.7%. Located on the parcel is a single family dwelling with an attached garage. There is a deck currently located in the area of the proposed addition. Ms. McPherson stated the petitioners would like to add a 22 foot x 26 foot addition on to the rear of the dwelling which would include modifications to the kitchen, a first level mud room with washer and dryer, bathroom and a bedroom. In reviewing the request,. staff determined the existing lot area of the subject parcel was platted at 7,200 square feet which is less than the 9,000 square foot minimum required by code. Lot coverage is calculated at 25% of the lot area which is 1,800 square feet of building. The petitioner is requesting 2,040 square feet. If staff calculates 25% of 9,000,. Ms. McPherson stated staff has no recommendation because .the request is within previously granted requests. Mr. Kuechle asked if the 1,800 square feet would include the garage. Ms. McPherson stated lot coverage includes all structures on the site. Ms. Smith asked if variances of this nature had been granted in this neighborhood. Ms. McPherson stated variances had not been granted in this particular neighborhood. A variance was granted in the Riverview Heights neighborhood in 1990. Again, it was a function of the lot area of a smaller size lot. The petitioner wanted to put up a typical size addition. The variance was to increase the lot coverage from 25% to 28.7%. Ms. Smith asked if all the lots in this neighborhood were smaller. Ms. McPherson stated she thought the corner lots are smaller. The remainder appear to be average. Ms. Beaulieu asked if the code requirement at that time was that a lot could be less than 9,000 square feet. - Ms. McPherson stated the subdivision ordinance allows the City Council to approve plats with variations to the code. It may be that the subdivision had a variance for the lot area. Ms. Podshinski stated she is co-owner of the property. It is necessary to get living arrangements all on the same floor. That is why they are making the request to make the living space accessible on the same floor. Ms. Beaulieu stated that staff reported the addition ig to be 22 feet x 26 feet and that an addition of 16 feet x 22 feet would not require a variance. Ms. Podshinski stated a five -person family lives in the home. This arrangement will be for her parents to have an area in the back with a sitting area and a bedroom for privacy. An addition of 16 feet x 22 feet would not provide adequate space. He asked if the petitioner had considered the option of having the addition being 26 feet wide rather than 22 feet wide. Ms. Podshinski stated they had discussed this with the contractor. If they were to do this, they would lose one window in the upper bedroom and it would be more expensive to do that to allow for the slant in the roof. Ms. Beaulieu asked if there had been any comments from the neighbors. Ms. Podshinski stated the neighbors had been very supportive. Mr. Quam stated he lived across the street. He urged the Commission to approve the request. The Boltman's have lived there for many years. They are the finest people and he would like to see them stay there. They also have two outstanding young adults in their family. MOTION by Ms. Smith, seconded by Ms. Beaulieu, to close the public hearing. She asked the question because she felt that area was crowded. This is a corner lot. They have an unusual situation and she did not think the size of the variance request was out of line. They are talking about 240 square feet or a 3.7% increase. She would be inclined to vote for approval. Ms. Beaulieu agreed. The hardship seems to be the small lot area. She would vote for approval. Mr. Kuechle concurred. He does have a concern about crowding there. The amount of overage is not that much and to make the petitioner go down to a size that may not be as functional would be picky. He would recommend approval. SUMMARY OF ISSUES: The subject parcel was platted with a lot area below the 9,000 sq. ft. minimum As lot coverage is a function of lot area, the petitioner's permitted lot coverage is less than would normally occur on a 9,000 sq. ft. lot. The petitioner would be permitted to construct an addition 16 X 22' if the variance was denied. RECOMMENDED ACTIONS: The request is within previously granted variances. Located on the property is a single fannily dwelling unit constructed in 1961. The dwelling is 25' X44'. There is an attached single car garage measuring 16' X 24' also located on the property. REQUEST ANALYSIS: Section 205.07.03.0 of the City Code requires that not more than 25% of the area of a lot shall be covered by the main building and all accessory buildings. The public purpose served by this requirement is to eliminate the condition of overcrowding of residential areas. The subject parcel was platted in 1961 with a lot area of 7,200 sq. ft. Twenty-five percent of 7,200 sq. ft. equals 1,800 sq. ft. of building permitted. The petitioner is proposing 2,040 sq. ft. of building with the proposed 22' X 26 addition The minimum lot area required in a single family district is 9,000 sq. ft. Twenty-five percent of 9,000 sq. ft. equals 2,250 sq. ft. of permitted building coverage. This is well over the petitioner's proposed lot coverage. Because the lot coverage calculation is a function of a lot area, the need for a variance is not as a result of the property owner's actions. The petitioner does have an alternative to construct a smaller addition of 16 X 22' which would not require a variance. No other variances are required to allow construction of the addition as proposed. RECOMMENDATION The request is within previously granted variances, therefore staff has no recommendation regarding the request.
