Ms. Dacy, Community Development Director, stated that this is a
request for a special use permit to allow a third accessory
building over 240 square feet at 157 River Edge Way. She stated
that located on the site is the petitioner's single family home and
an attached one car garage. She stated that in 1984 a special use
permit was granted for a second accessory structure.
Ms. Dacy stated that the Planning Commission recommended approval
of this special use permit by a 4 to 1 vote with two stipulations,
which she outlined.
MOTION by Councilman Fitzpatrick to concur with the recommendation
of the Planning Commission and grant Special Use Permit, SP #91-08,
with the following stipulations: (1) variance request, VAR $91-18,
shall be approved; and (2) the structure be located within two feet
of the location shown on the plan. Seconded by Councilman
Billings. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
MOTION by Councilman Schneider to receive the minutes of the
Planning Commission meeting of July 10, 1991. Seconded by
Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor

Ms. Dacy, Community Development Director, stated that the
petitioner is requesting a variance to reduce the side yard setback
from 10 to 6 feet to expand the living area above his garage. She
stated that staff recommended denial; however, the Appeals
Commission recommended approval of the variance request. She
stated that the Commission felt this was a unique situation since
the proposed addition was above the garage, there was still 11 feet
of space between this structure, and the neighboring property to
the west.

Councilman Schneider was concerned if this was encroaching into the
side yard and if there are code requirements for a fire wall. He
wanted to make sure that the Building Department was aware of this
encroachment.
MOTION by Councilman Schneider to concur with the unanimous
recommendation of the Appeals Commission and grant Variance
Request, VAR #91-16. Seconded by Councilwoman Jorgenson. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.
B. VARIANCE REQUEST, VAR #91-17, BY SAMIR AWAIJANE, TO ELIMINATE
THE REQUIREMENT FOR A SIX INCH CONCRETE CURB IN THE AUTOMOTIVE
STORAGE AREA; TO REDUCE THE HARD SURFACE SETBACK FROM THE

recommendation and deny both Variance Requests under VAR #91-17.

Suburban Consumer Advocates for the Handicapped for $1,000 was

Mr. Barg stated that it is re ested the Council consider adopting
this resolution in order that agreements may be entered into with
the agencies receiving fundi g.
Ms. Sue Jackson, Vice-Chaig an of the Human Resources Commission,
stated that all agencies pplying for this funding had to meet the
requirements of the Fede al Disability Act. She stated that there
are some new agencies d programs which have not been funded in
the past. She stated that the goal is to get programs off the
ground rather than to be their sole support.
Councilman Billingsreferred to the $1,347 to the Fridley School
District for the s er adventure program and asked if this was the
same program the ity1s Recreation Department was funding.
Mr. Burns, City manager, stated that it is not the same program as
the program sp sored by the City.
Ms. Jackson tated this program is an enrichment program that
addresses t needs of students and children. She stated that the
funds will a used to pay the fees for the classes if there are
students w o cannot afford this program such as those from lower
income f milies. She stated that certified teachers and
speciali is are involved with the program.

Ms. Dacy, Community Development Director, stated that on

the p itioner at that time, Randy Anderson, did not follow through
with a survey and sold the property in its entirely the current
owner, Mark Akbari. /
Ms. Dacy stated that at the end of May, Mr. AkbFecording
' was attempting
to convey one-half of this unit and property another person;
however, staff would not authorize the deed for since the
stipulations of the lot split approval were n t completed.
Ms. Dacy stated that Mr. Akbari has subm' ted a certificate of
survey and compliance with the lot split co a requirements, and the
legal descriptions match the lot split ,approved in 1985. She
requested that Council consider this re olution to allow the lot
split with the stipulation that a $75 .00 park fee be paid and
submission to the City of a declar ion of covenants for the
property.

if another fee should be collecte
Ms. Dacy stated that the vote i 1985 was unanimous, there were no
questions or comments from the Public, and the Planning Commission
had recommended approval of t e lot split.

10. AUTHORIZATION TO BACK 1987-1989 COMMUNITY DEVELOPMENT
BLOCK GRANTS:
MOTION by Councilwoma Jorgenson to authorize $11.69 in unused
1987-1989 Community D velopment Block Grant Funds to be turned back
to Anoka County. Se nded by Councilman Fitzpatrick. Upon a voice
vote, all voting ye, Mayor Nee declared the motion carried
unanimously.

Mr. Flora, is Works Director, stated that on the 73rd Avenue
street widen'.g project there was some poor soil which had to be
removed to rovide a suitable base for the street. He stated that
it is requ ted that Council approve this change order to cover
these cost .
MOTION b Councilman Billings to authorize Change Order No. 1,
Street provement Project No. ST. 1991 - 1 & 2, with W.B. Miller,
Inc. in/the amount of $6,904.00. Seconded by Councilman Schneider.
Upon voice vote, all voting aye, Mayor Nee declared the motion

A. STATED HARDSHIP:
"Need space - my husband is in desperate need of an office."
The petitioners are requesting a variance to reduce the side yard setback
from 10 feet to 6 feet to allow construction of additional living space
above their garage. The property is Lot 14, Block 1, Amber Oaks Addition,
the same being 5985 McKinley Street N.E.
Site
Located on the property is a single family dwelling unit with a tuck -under
two car garage. The property is zoned R-1, Single Family Dwelling as are
the adjacent properties.
Analysis
Section 205.07.03.D. (2). (a) of the Fridley City Code requires a side yard
setback of 10 feet between any living area and side property lines.
Public purpose served by this requirement is to maintain a minimtm, of 20
feet between living areas in adjacent structures and 15 feet between
garages and living areas in adjacent structures to reduce exposure to
conflagration of fire. It is also to allow for aesthetically pleasing open
areas around residential areas.
The petitioners are proposing to enlarge an existing storage room located
above the garage to be used as office space. The adjacent garage is 5 feet
from the property line, creating a separation of 11 feet between the two
structures. The petitioners could enlarge the space by approximately 5
feet without requiring a variance. Wille the room would not be as large
as proposed, it would be adequate for a small office. The petitioners have
reasonable use of the property and could possibly convert other rooms in
the house for the required office space.
Recommendation
As the petitioners have reasonable use of the property, staff recc mmends
that the Appeals Commission recc mwnd to the City Council denial of the
variance request.

request to the City Council.
City Council Reccapendation
Staff recommends that the City Council deny the request as the petitioner

Ms. McPherson stated the property is located on McKinley Street at
the end of the cul-de-sac. The property is zoned R-1, Single
Family Dwelling, as are all adjacent properties. The petitioner

is proposing to expand an existing storage area located above the
two -car, tuck -under garage of the single family home. The
expansion is proposed to be used as office space. By expanding the
storage area to the wall of the garage, the required living area
setback is reduced from 10 feet to 6 feet. The adjacent garage to
the west is 5 feet from the property line, so 11 feet would be
maintained between the two structures.
Ms. McPherson stated the space as it currently exists could be
expanded approximately 5 feet without requiring a variance. While
the room would not be as large as proposed, it would be adequate
for a small office. The petitioners have reasonable use of the
property and could possibly convert other rooms in the house for
the required office space.
Ms. McPherson stated that as the petitioners have reasonable use
of the property, staff recommends that the Appeals Commission
recommend to the City Council denial of this variance request.
Mr. Thomes showed the Commission members a picture of the house.
He stated this is a small scale building project. The expansion
of the storage space into a small office will all be done
internally. The exterior of the house will not change in any way
and nothing will be visible to the neighbors. He stated he will
put a small window at the rear.
Ms. Thomes stated that regarding staff's statement about the
possibility of converting other living space in the house to office
space, there really are no other spaces. There are two small
bedrooms on the second floor, a larger bedroom downstairs, with a
large living room. The house is very open. The only way to add
space would be external construction or expanding this area over
the garage.
MOTION by Ms. Smith, seconded by Ms. Beaulieu, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE
DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:45
P.M.
Ms. Beaulieu stated this proposal sounds like a clever idea to use
empty space. She stated that since the exterior of the house will
not be changed at all, it seems like a wise use of space.
Ms. Smith stated this is an impeccably kept -up piece of property.
There really is no other way to expand so she would vote in favor
of the variance.
Mr. Kuechle stated he would concur as long as there are no windows
other than those in the rear. Visually, there will be no changes
to the house.

MOTION by Ms. Smith, seconded by Ms. Beaulieu, to recommend to City
Council approval of variance request, VAR #91-16, by Tamara and
Charles Thomes, per Section 205.07.03.D. (2) . (a) of the Fridley City
Code, to reduce the side yard setback from 10 feet to 6 feet, to
allow the construction of an addition on Lot 14, Block 1, Amber
Oaks, the same being 5985 McKinley Street N.E.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE
DECLARED THE MOTION CARRIED UNANIMOUSLY.
Ms. McPherson stated this item will go to City Council on July 22,
1991. ,
2. CONSIDERATION OF VARIANCE REQUEST, VAR 91-17 BY SAMIR
AWAIJANE, 7570 INC.:
Per Section 205.17.05.D (3) of the Fridley City Code, to
eliminate the requiremen for a 6 -inch concrete curb in the
automotive storage area;
Per Section 205.17.05.D.(5 .(a) of the Fridley City Code, to
reduce the hard surface se ack from the public right-of-way
from 20 feet to 10 feet;
To allow general improvement of the property, on that part of
the East 46 acres of the We t 1/2 of the Northwest 1/4 of
Section 12, T-30, R-24, Anoka ounty, Minnesota, described as
follows: Commencing at a poin on the West line of said East
46 acre tract distant 623.5 fee South of the Northwest corner
of said East 46 acre tract; the ce South along the West line
of said East 46 acre tract 161.feet; thence East parallel
with the North line of said Ea-
46 acre tract 538.98 feet,
more or less, to the Westerlyfight-of-way line of State
Highway No. 65; thence Northerly long said Westerly right -of
way line 161.63 feet, more or les , to the intersection of a
line drawn from the point of begin ing and parallel with the
North line of said East 46 acre t ct; thence West parallel
with the said North line 538.73 fe t, more or less, to the
point of beginning, the same being 570 Highway 65 N.E.
Ms. Dacy stated the property is locate\aa
and adjacent to
Highway 65, north of Fridley Terrace MobilPark and south of
Lampert Lumber. The property is zonedLight Industrial.
Lampert Lumber is zoned M-1, Light Industris all the vacant
property to the rear. The mobile home pzoned R-4, Mobile
Home Park.
Ms. Dacy stated the request is for two vs: (1) To reduce
the parking setback from 20 feet to 10 fe(2) the concrete
curb requirement around the hard surfaceg area be waived.
The petitioners want that requirement waing the south edge
and westerly edge of the parking area.
