PERKINS, 784-3461 Mrs. Perkins called me and indicated that she plans to do specialized baking j for a company. She has a permit from the state, but the permit requires approval by the City. The only activity outside the house that there will be would be three or four truck pickups per month. She has a commercial oven now. She talked to Steve Olson about it and his initial comments were that she could not do this in a residential area. She says she has looked at the home occupation section of the Fridley Code and her feelings are that her activities fall within the code. Please check with Steve and the Fire Department and any other people to provide her with appropriate information with a copy to me. Thank you for your assistance. NMQ/ms I talked to Mrs. P_e*i-h s on Wednesday October 13, 1982 and explained the city�s concerns about sanitation, healthy environment and commercial competition. While she was not happy with my explanation she indicated she would abide by our definitions and not operate a cake baking business from her home. Attached is Steve Olson's summary of our past and current philosophy pertaining to food preparation in residential districts. The fire department has no direct involvement in this item. Olson, Environmental Officer MM DATE: October 13, 1982 RBGAmIldG: Operating A Bakery In A I-1 District The home occupation definition in the Zoning Code states that "...a home occupption shall not be interpreted to include tourist homes, restaurants or similar uses..." In addition, the Uses Permitted in a IL-1 District does not include food establishments. Finally, Chapter 111 related to Licensing of Food Establishmen%s, requires that any food establishment in the City be properly licensed and it also states that "...no home prepared foods shall be kept or used in any food establishment.....". What does all this mean? Because of the requirement that no home prepared foods be used in a food establishment, this would require that the City license Mrs. Perkin's home as a food establishment so she can sell food to another food establishment. If we -license her home, than we would seem to be opening up a residential area to cormmercial development, and that is not a Permitted Use in the Zoning Code. Also, the City already licenses several bakeries as food establishments and these businesses have to provide all the facilities and improvements required in the Zoning and Food Codes and they have to pay taxes on oommercial property. Finally, from a public health standpoint, it is not a desirable situation to have a person preparing food for the public in a home where there isn't enough control over visitors or household pets. There have been several inquiries in the past about operating establishment out of a home and my response has been that it permitted. I feel that continuing this policy is the best available.
