SUBJECT: Consider Approval of Hold Harmless Agreement
for Placement of an Accessory Structure in a
Drainage and Utility Easement at 7536 McKinley
Street N.E.; Brian Kovar
The City issued a building permit to allow the construction of a
12' x 16' detached accessory building on the above referenced
property. The property owner constructed the forms for the slab
5' 6" from the rear lot line and 3' from the side lot line in
conformance with the setback requirements. A 6' utility easement
is located parallel to the rear lot line, therefore the proposed
accessory structure encroaches into the easement.by 611. A footing
inspection prior to the pouring of the slab revealed the
encroachment.
In checking the site survey, it was discovered that the surveyor
omitted an additional 10' easement parallel to the side or south
lot line on the property survey. The proposed accessory structure
encroaches into this easement by 71. There are no City utilities
within the easement. Staff has contacted each of the utility
companies to ensure that there are no conflicts if the structure
encroaches into the easement. NSP and Minnegasco do not have any
objections to the City entering into the attached hold harmless
agreement with the owner, Brian Kovar. Nortel Cable and U.S. West
Communications have yet to respond.
Recommendation
Staff recommends that the City Council approve the execution and
recording of the attached hold harmless agreement with Brad Kovar,
pending notification by the remaining utility companies.

of July 28, 1993.

MOTION by Councilman Sch ider to adopt Resolution No. 56-1993 to
set the public heari for September 13, 1993. Seconded by
Councilwoman Jorgensoif. Upon a voice vote, all voting aye, Mayor
Nee declared the 74on carried unanimously.
6. APPROVE HOLD HARMLESS AGREEMENT BETWEEN THE CITY OF FRIDLEY
AND BRIAN KOVAR FOR THE PLACEMENT OF AN ACCESSORY STRUCTURE
IN A DRAINAGE AND UTILITY EASEMENT AT 7536 MCKINLEY STREET
N.E.
Ms. Dacy, Community Development Director, stated that this property
is located on the west side of McKinley Street and zoned R-1. She
stated that there is an existing single-family home on the site and
a six foot drainage and utility easement along the west side. She
stated that the petitioner is proposing to construct a 12 foot by
16 foot detached accessory building. Ms. Dacy stated that through
the building permit process, it was determined there was a ten -foot
easement along the south property line, and this proposed building
would encroach into the easement by seven feet. She stated that
there are no City utilities within the easement. Staff contacted
each of the utility companies to ensure there are no conflicts if
the structure encroaches into the easement.
Ms. Dacy stated that Northern States Power and Minnegasco do not
have any objections to the City entering into a hold harmless
agreement with the owner. Nortel Cable and U.S. West
Communications called and said that they did not have any adverse
comments. She stated that staff has no objection to the
encroachment, and she would recommend approval of the hold harmless
agreement.
Mayor Nee stated that the hold harmless agreement assumes the City
may need the easement at some future date. Constructing the
building on the easement is contingent on the property owner
entering into the hold harmless agreement.
MOTION by Councilman Schneider to authorize the Mayor and City
Manager to enter into the hold harmless agreement to allow the
Ms. Dacy stated she assumes that 69th Avenue wo d be used to exit
onto University Avenue, or 73rd Avenue could b used to go east to
Central Avenue or west to University Avenue r ther than north into
Melody Manor.
Councilman Schneider asked if there is n estimate on how many
persons would attend this sale.
Mr. Ronald Stelter, representing Fri dly Chevrolet, stated it is
expected that several hundred peopl would attend.
Councilwoman Jorgenson stated tha she attended the sale sponsored
by Sam's Club. There were a to of people, but the traffic was
very controlled.
Councilwoman Jorgenson stated hat one of the stipulations was that
the cars for the sale be st et operable and not be leaking fluid
excessively. She asked if his may be a problem.
Mr. Stelter stated that/at the Planning Commission meeting the
question was raised if tAis sale would involve junk vehicles. He
stated that this would of be the case, and the vehicles would not
be leaking fluid. He itated that they hope to have three hundred
to four hundred carsYom four different manufacturers. They would
be moving them on thsite beginning the Friday before Labor Day.
MOTION by Council an Schneider to grant Special Use Permit,
SP #93-13, with t following stipulations: (1) the vehicle sales
will occur no mor than once per year for no more than three days
over the Labor Da weekend; (2) the use of streamers, pennants, and
flags is prohi ted; (3) the petitioner shall comply with the
temporary sign rdinance for all temporary signs on the property;
(4) the petitioner shall obtain a temporary building permit and
shall comply ith Article 32 of the Uniform Fire Code; (5) the
portable to'lets shall be handicapped accessible; (6) the
petitioner all provide a traffic management person to properly
control tr ffic on site and to prevent problems occurring on
69th Avenu , the University Avenue frontage road, and to direct
unnecessa traffic away from the residential neighborhood; (7) the
particip ing dealerships shall apply for and receive the
appropr' to City licenses; (8) there shall be no test driving of
cars i the residential neighborhood located south of 69th Avenue
and in Locke Park; (9) barricades shall be placed at the entrance
to t e neighborhood on 69th Avenue and on 71st Avenue. The
barr'cade at 69th Avenue shall include a sign with the language
"Re idential Area, No Exit"; (10) the cars for the sale shall be
st eet operable and shall not be excessively leaking fluid; and
( ) the special use permit shall be reviewed by the Planning
mmission prior to the next sale. Seconded by Councilwoman
orgenson. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.

7. APPROVE LICENSE AGREEMENT FOR ACCESS TO THE ANOKA COUNTY
TAXSYS SYSTEM:
Mr. Pribyl, Finance Director, stated that approval of this
agreement would allow the City access into the County's tax ystem.
He stated that this has been in the City's goals and obje ives and
now is available to connect into the County's system. He stated
that there would be no cost for connecting the first it, and any
other connection would cost $50.00 each. He state that at this
time the City is considering only this one conne ion, so there
would be no cost involved.
MOTION by Councilman Schneider to approve thod license agreement
for access to the Anoka County TAXSYS s stem. Seconded by
Councilwoman Jorgenson.

from the Parks and Recreat' n and Planning Commissions, as well as
the Council, to comply ith the City Code prior to the City
removing a diameter tree on City -owned property.

satisfactory performance and compliance with the belo stated stipulations. The surety bond or check shall
be kept active until the completion of work and/or expiration of permit and can only be released by written
notification of the City after a satisfactory final inspection has been performed by the City.
2. All access and street frontage of the land alteration site must be controlled by a fence, a minimum of four (4)
feet in height. All entrances must have gates that are capable of being locked.
3. Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or demolition
wastes will be permitted as fill unless a demolition landfill permit is first obtained from Anoka County.
4. Operations shall be limited to daylight hours and shall not interfere with the health and safety of surrounding
residents and the premises shall be maintained at all times so as not to create a nuisance.

5. Any explosives used must be done so in accordance with Chapter 212, subsections 212.07.5A, .5B, .5C, .51),
and .5F. of the Fridley City Code and any other applicable standards, e.g. Federal, State, Industrial, etc.
6. At the end of each season's operations and no later than the last day of December each year, the site is to be
left in a neat and orderly condition, with maximum slopes of 2:1 with no overhang or vertical banks and with
a level bottom.
7. On the Friday of each work week, or when required by the City, material from this operation that is found to
exist on City streets shall be cleaned to the City's satisfaction by the applicant.
8. Upon completion of land alteration operations, the land must be left according to the plans and contours
submitted with this application and planted with suitable vegetation to prevent erosion.
9. Upon completion of land alteration operations or expiration of this permit, an inspection will be made by the
City of the premises and adjoining streets. Any damage found to have been caused by these operations will
be corrected by the applicant upon notification by the City.
