Note to File: Re: VAR #08-04 — Wesley Grandstrand at 5431 Madison Street From: Stacy Stromberg After further review of this variance request at a DRC meeting, Staff determined that a variance was not required. The property was granted a variance in 1967 to allow the garage to be setback 3 ft. from the north property line, so the setback standard has already been determined on this property. The property owner wishing to construct an addition to the east side of his existing garage expanding the existing 3 ft. setback from the north property line. Since the existing request is within previously granted dimensions on this property as a result of the 1967 variance that was granted, staff made a policy decision to not require the petitioner to get another variance for the proposed addition. Reason for Variance: The City of Fridley Building Inspections Department advised me that the proposed 12' x 24' garage addition that I submitted for permitting can not be approved without going through the Variance Process. The explanation given for needing to apply for a Variance is as follows: The side yard width of a corner lot shall not be less than seventeen and one-half (17.5) feet. 2. The existing Accessory Building (garage) is considered a non -conforming structure because the existing building is located closer to the side yard property line than the allowable side yard setback. The existing garage that was constructed with City of Fridley approval by Variance in 1967 is located 3' from the side yard property line. The Fridley City Code allows up to twenty-five (25%) of the area of a lot to be covered by the main building and all accessory buildings and a private garage, not to exceed one - hundred (100%) percent of the first floor area of the dwelling unit or a maximum of one - thousand (1000 SF) square feet. Strict enforcement of the city code causes an "Undue Hardship" because I can not build (expand) the maximum size garage allowed by Section 205.07, Paragraph B (1) of the Fridley City Code. My Lot is approximately 11,100 SF (slightly larger than .25 acre) and covered with approximately two thousand one hundred fifty (2,150 SF) square feet of existing main and accessory building. Request: Allow request to construct a 12' x 24' addition directly to the East side of the existing garage and grant a three (3') setback from the North property line consistent with the Variance approved by the City of Fridley in 1967 for construction of the original garage. Narrative Description of Proposed Building: A 12' deep x 24' wide addition to East side of existing garage. This garage expansion will be constructed of materials consistent with the existing dwelling unit and accessory building. These materials include masonry foundation on concrete strip footings, conventional wood frame structure, stucco exterior wall finish, prefinished fascia and soffit and laminated asphalt shingle to match existing.
