NOTICE OF PUBLIC HEARING
e is hereby given that the Appeals Commission of the
conduct a public hearing in the City Council Chambers
Avenue Northeast at 7:30 P.M. on Tuesday, March 11,
e following matter:

Consideration of a variance request pursuant
to Chapter 205 of the Fridley City Code, to
allow a dwelling destroyed.by fire to be
constructed on the same foundation, with.a 2
foot cantilever, which will reduce the
required front yard setback from 35 feet
to 33 feet; on Lot 13, Block 8, Donnay's
Lakeview Manor, the same being 5750 Madison
Street N.E., Fridley, Minnesota.
Notice is hereby given that al'. persons having an interest therein will be
given an opportunity to be heard at the above.time and place.

only a recommendation from the Appeals Commission.

5750 Madison Street N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4A, requires a front yard setback of not less than
35 feet.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right of way and also for
aesthetic consideration to reduce the "building line of sight" encroachment
into the neighbor's front yard.
B. STATED HARDSHIP:
Home destroyed by fire and wants to rebuild on same foundation with
a two foot cantilever.
C. ADMINISTRATIVE STAFF REVIEW:
If the neighbors have no objection to this variance being granted, the
staff has no stipulations to recommend to the Board if approved.

I -1s. Gabel asked the petitioneer i:Ir. Colstrom to step forward.
Mr.. Plemel questioned if the home was totally destroyed? -
Mr. Colstrom stated that yes, it had to be torn down.
Ms. Gabel questioned when did this fire happen?
Mr. Colstrom stated that it happened February 16th, and the
fire is still under investigation. I -ie further stated, that they
were.on vacation at the.time of the fire.
Mr. Colstrom stated that he would like to peat a two foot
cantilever both in front -md in the back to give them more space.
Ms. Gabel noted that it had a detached garage', she questioned
if the fire got the garage.
Gir. Colstrom stated that no the garage was not damaged.
I-ir. Kemper questioned what type of driveway they have, and if
it was damaged by any of the fire fighting equipment?
Mr. Colstrom stated ths.t they have an asphalt driveway, and no,,
it was not damaged.
Mr. Pl.emel stated -that it* appeared that every house was setback
35 feet.
Mr. Kemper questioned what size the foundation was?

tier. Colstrom stated that it was 25 X 40 feet, and he believed
that was the outside dimensions.
bfr. Kemper questioned if he was proposing to makea building
that would be .4.0 X 29 feet?
Mr. Colstrom stated that would be approximately the size. He
stated that he was not..going to go the full with.of the building
with the overhang. He stated that what he would like to do,
would be to go a foot out, for about one-half the house,
and go out.about two feet on the bedrooms, and the same two
feet on the back wall.
Mr. Kemper questioned if it was a.three bedroom home originally?
Mr. Colstrom stated.that he believed that was what they called
it, but they used the one room 'as a dining room that was a.
walk through. H -e stated.that it was a Donnay house. He stated
they would like to open it up and have a kitchen, dining room,
and family room combination.
Ms. Gabel questioned how many bedrooms did they plan to have
then with this extra room?
Mr. Colstrom stated that he was going to make provisions for
two bedrooms in the front, and a bedroom in the back, and a
bath, but that it would be just one bedroom in the front. He
stated that_. he. would ask the contractor to frame in for a second
door, but they would gust sheetrock over it, so if in the future
there would be need they could just cut out the sheetrock, and
put in a doom.
Mr. Kemper questioned if the bath was presently in the front?
Mr. Colstrom stated that yes it was.
Ms. Gabel questioned if that was the only bath in the house?
Mr. Colstrom stated that no,. there was another bath in the
basement, and they planned to move that to the rear. He'further
stated that he would like to raise it up one course of block, and
that presently it was about 7 1/4 feet high.
Mr. Kemper questioned if this was basically the same -plan that
they orginally had with the doors in the salve placeand the
stairs in the same place?
Mr. Colstrom stated that yes it was, the front and back doors,
and. stairs would stay the satme, the only basic difference would
be to move the bathrooms.
- 1,11r... Kemper questioned if they would use 2 X 4 or 2 X 6 walls?
Mr. Colstrom stated -it would be 2 X 4 walls.

IvIs. Gabel questioned if Mir. Colstrom had talked to any'of the
neighbors about this?
Iv1r. Colstrom stated that he has talked to just one, and that
one didn't know what a cantilever was. 'i.Ir. Colstrom stated
that he felt -this one neighbor probably had mentioned it to
others though.
Ms. Gabel stated that irlrs. Simon S:nith, of S730 Madison Street
N.E. must have called, because she said they have no objection
to the two foot variance.

After much discussion about how the hardship is stated, the
Commission members stated that that hardship should also include.
'getting the most room for the -money, and make it.more esthetically
pleasing'. °

do the building?
14r. Colstrom stated that a contractor would do all the work,
except the electrical, which he himself would do.

:Ir. Barna stated that he could.see the reasons for Mr Colstroms
wanting to build I larger house, and save the footings,
though the hardship, is rather vague,. it is still legible,
and understandable.

request pursuant to Chapter 205 of the Fridley City Code, to
allow a dwelling destroyed by' -fire to be constructed on the

4. OTHER BUSINESS a
1,11s. Gabel stated she would like something done, so that the
Commission did not -feel .that they had -to search out the real.
hardship' in requests for variances.
,." Plc -mel questioned 11,11r.I:ioravetz if the form spells out
that a. hardship t7Just be defined.
Mgr. Moravetz stated that he would review and revise the variance
application form to clarify specific hardships.
&r. Kemper suggested that they should maybe state that the
petitiorieer must show a definite need, rather than just a desire.
Discussion ensued on ways to change the form to clarify hard-
ship.
Mir.. Netager stated that he would .like to recoritmend that the
form be redesipzed so that there would_be a block that would
define the variance request, and -)nother block that would
define the hardship, and then a breif statement, or instructions
that would indicate that you must show more than just a desire
to request a variance, but that you must show a definite need.
