On September 1, 2004 it was observed these building
code violations exist:
1) Two water heaters installed with no permit on file. Issues include but not limited to; no
licensed plumber/gas fitter installed the water heaters and improper venting, gas fitting,
plumbing and lack of combustion air per MN Plumbing Code Chapter 4715, MN and
Mechanical Code Chapter 1346.
2) Swimming pool and barrier/fence violations per Fridley City Code.
These issues must be addressed within 20 days from receipt of this letter and contact the
Building Inspection Division of the City of Fridley.

RE: First Notice of Noncompliance of the Fridley City Code at 4551-53 MAIN ST NE
Dear Mr. Yesnes:
In 1997 the City began a systematic code administration process in an effort to raise the level of
understanding about City ordinances. The purpose of this letter is to both inform you about certain city
codes relating to property conditions throughout the City and to ask for your assistance in resolving a code
issue. You may be unaware of the City's code requirements concerning Outside Storage and an Illegal
Structure. On a recent inspection in your neighborhood, the following was observed:
A stove/range in the front yard and plastic barrels shovels, lath, pails, tires, a walker, garden
tools DIywood car batteries antifreeze containers, guickrete bags, misc. building materials,
windows patio block concrete block inoperable snow blower, carpet, tams, parking lot bumpers,
oil pans roller assembly from a grocery store fence components and other misc items spread
throughout the side and rearay rds. Fridley City Code requires that all materials shall be kept in a
building or shall be fully screened so as to not be visible from any public right-of-way, except for
stacked firewood in the side or rear yard. Boats, non -motorized trailers, and utility trailers stored
in the side or rear yard are not required to be located on a hard surface drive (Zoning Code
205.07.06).
■ Black pool structure in the rear yard was never issued a building permit, nor does it appear to
meet setback requirements. Fridley City Code requires that all accessory structure over 120
square feet need to obtain a building permit. It also requires that all accessory structures be 3
feet from any rear or side yard property line. As a result, the black structure needs to be removed
as well as the items located inside the structure.
The next inspection in your neighborhood will be conducted on or about Saturday, November 09, 2004.

Dear Mr. Yesnes,
A letter was sent to you on September 21, 2005 requesting you supply documentation
from a Licensed Plumbing/Heating Contractor verifying the water/gas lines are not
interconnected between the upper and lower unit. The letter requested the
documentation be supplied by October 5, 2005. In addition there was also a failed
finding concerning water leaking into the interior of the refrigerator requiring repair and
reinspection.
Due to the fact documentation has not been supplied at this time verifying the correct
connections are in place for 4451 and 4553 Main St. and there has been no notification
concerning the refrigerator repair, the Section 8 Housing Assistance Payment for Owen
Osborne will stop effective October 31, 2005.
If you are able to supply the necessary documentation by October 31, 2005 and the
repair has been mode for the refrigerator, payment will resume. However, there may be
a delay with the ember rent check. Please feel free to call me if you have any

Dear Mr. Yesnes,
Thank you for your response regarding the Housing Quality Standards (HQS) findings. I
appreciate you acting quickly pertaining to the furnaces. However, as stated in the
letters sent to you on September 21, 2005 and October 6, 2005 it is necessary to supply
documentation from a Licensed Plumbing/Heating Contractor to verify the gas lines and
water lines are not interconnected. You can fax the necessary documentation to my
office at 763-502-4969 or send to the City of Fridley 6431 University Ave Fridley MN 55432
attn: Pat Wolfe. Without this information the stop payment will continue to be in effect
for October 31, 2005.
I will contact Owen to schedule a re -inspection for the refrigerator based on the
information you supplied regarding the completion of its repair.
Your letter referred to an early termination of the Section 8 lease. For purposes of
clarification, there is not a Section 8 lease in place. The lease in place is between you
and Owen Osborne. Section 8 staff did not ask you to accept an early termination of
the lease. I believe this request was made by Anoka County acting on behalf of Owen
Osborne. At this time I have not received a copy of a mutual termination between you
and Owen. Therefore I will assume he will remain until the end of his lease term unless a
mutual termination has been received. You have signed a Housing Assistance Contract
(HAP) contract with the Metro HRA. According to the HAP contract "Housing assistance
payments shall only be paid to the owner while the family is residing in the contract unit
during the term of the HAP contract. The PHA shall not pay a housing assistance
payment to the owner for any month after the month when the family moves out".
Hopefully this clarifies for you the responsibility of the Section 8 programs HAP payments.

To Whom It May Concern;
In reference to the October 6th letter, I had my heating
contractor verify that the two furnaces at the above
address are not connected.
I find the request to supply written documentation of same
as well as a short 14 day period to repair a minor
refrigerator issue (it is functional) to be an excessive
abuse of power and another example Of needlessly spending
landlord monies. If the city/Sect 8 wishes to send a
qualified inspector to verify that the furnace systems are
indeed separate, I am happy to provide access.
Furthermore, as I have been asked to accept an early
termination of the Sect 8 lease, I would respectfully
request that rent be paid as originally required for the
duration and all sides work toward an amicable conclusion.

Dear Mr. Yesnes,
I was recently contacted by Anoka County regarding the fact Owen Osborne has had
an excessively high heating bill resulting in his gas being shut off. Owen's gas has since
been turned back on at the expense of Anoka County. There is a concern Owen's gas
bill has included the gas for the upper unit 4553 Main St.
As noted by the Cities rental inspectors and Building Inspector in September 2004 one
gas line was servicing both water heaters. It appears this was corrected in November
2004, however it appears by the high gas bills Mr. Owen has received over the last year,
the gas service may again have been shared for both furnaces and water heaters. It
has been confirmed with Center Pointe Energy on September 20, 2005 the gas meter for
4553 Main St. has been shut off since June 2004.
The furnace room was inspected on Wednesday September 21, 2005 by me, Kevin
Hanson Building Inspector and Scott Hickok Community Development Director. It was
noted the hot water heater for the upper unit was off yet the hot water line was hot. It
appears the gas is somehow being shared or the water lines have -been interconnected
to enable hot water to flow to the upper unit. This is prohibited by the Section 8 Program.
It will be necessary to remedy the situation and documentation must be supplied by a
licensed plumber regarding the proper hook up for the water heater and furnace
without the use of shared gas or water supply.
If I don't receive the necessary documentation by October 5, 2005 Housing Assistance
Payments will stop effective October 31, 2005. Please feel free to contact me at 763-572-
3597 or Dale Ruedy with the Metro HRA at 651-602-1596. It was also noted the
refrigerator in 4551 Main St. is leaking into the interior of the refrigerator. This item is
considered a failed item requiring a repair and a reinspection no later than October 5,
2005 to assure p e t for October will be sent.

Dear Mr. Yesnes,
I received your Heating Contractors documentation; unfortunately the water valve
shut off made by the contractor will not suffice as a permanent repair. As stated
by the contractor in his letter and verbally during our conversation on October 24,
2005, the two water lines are soldered together. Without separating the two
lines there is no way to prevent the valve from being turned back on, thereby the
upper unit utilizing the lower unit's hot water.
As previously stated the contractor required to make the necessary repair, must
be a licensed Heating/Plumbing Contractor and licensed to work within the City
of Fridley. If you have any questions pertaining to whether your contractors are
licensed to perform work in Fridley please feel free to contact Mary Hintz at 763-
572-3605.
When the plumbing repair has been corrected please let me know so a re-
