Qureshi, City Engineer -Director of Planning MEMO DATE: September 24, 1971 MEMO NUMBER: CM #71-15 RE: Your Memo Regarding Complaint of Bill Hlavinka, 5923 Main Street - In 1965 after the tornado, when the new sewer service connection was made, it was connected to part of the old 4 inch pipe. In 1965 we had 1600 homes damaged or destroyed and with a limited staff it was impossible to cover all items of construction and keep proper records. We have no record of inspection on this work. The basic job of City inspection is to see that all work done meets minimum City Code requirements. Our City Code makes the home owner responsible for repair and maintenance of sewer service lines. A copy of that code section is attached herewith. With this background the City will have to make a determination whether this claim should be turned over to the City's insurance company for further processing. i NASIM M. QUR SHI, P.E. All water meters installed under the provisions of this chapter shall remain the property of the City of Fridley. They shall be repaired from time to time as is necessary to insure accurate measuring of the flow of water, except that whenever a meter has been damaged due to negligence on the part of persons other than employees of the Water Department, the owner, occupant or user of the premises or such other person desiring use of the water shall reimburse the Water Department for the expense of repairing any such meter. Upon failure to reimburse the Water Department within a reasonable time and upon demand therefor, the water service and supply to said premises may be shut off or discontinued as determined to be in the best interest of the City. 66.04. REPAIRS TO CONNECTION TAMPERING PROHIBITED CONSENT TO REGULATIONS METER READING AND PAYMENT FOR SERVICES 254 SUSPEND Sept. 30, 1971 OFFICE OF THE CITY MANAGER FRIDLEYV MINNESOTA September 23, 1971 MEMO TO: CITY ENGINEER SUBJECT: COMPLAINT OF BILL HLAVINKA, 5923 MAIN STREET On September 21, 1971, Councilman Liebl and T visited Mr. Hlavinka to discuss a complaint he had concerning his sewer line. Apparently after the tornado of 1965, it was necessary for Mr. Hlavinka to install a new lateral from his house to the street sewer line. The sewer connection was inspected by a_ma-n---he thDught;-was t3.:;(4,Iy-�s�' named Jensen for.the contractor who filled up the hole. From 1965 on, Mr. Hlavinka indicates he has hada constant source of problems with this sewer plugging up requiring him to rent sewer snakes and other equipment to clean out the sewer. Finally, recently he had a contractor dig up the line where it joins the street line, and he claims that the lateral pipe from his house was placed into a collar that was much too large for the pipe, and this then allowed sand, tree roots, etc. to enter the line thereby blocking the line where the lateral meets the street sewer line. He has the line and collar at his home and I inspected same. Mr. Hlavinka feels that the City was negligent in inspecting this when it was placed in the ground and wishes the City to reimburse him for approximately half of his bills and cost of the installation of the new line. This would amount to approximately $150. Mr. Hlavinka is preparing a written estimate of his bills which he will be bringing in shortly. Mr. Chesney talked to Mr. Hlavinka about this and explained to him that he believed this to be a problem of his plumbing contrator in making a faulty connection by possibly using misfitting parts. He stated that because of the cement surrounding the joint it would be impossible for an inspector to detect the use of these faulty parts. I would like you to thoroughly research this problem and give me your recommenda- tions on what the City's responsibilities were, and whether any liability exists, and whether this claim should be referred to our insurance carrier for disposition. You may want to go out and talk to Mr. Hlavinka and possibly take a picture of the sewer part which he is claiming was improperly fitted. According to Section 4715.2800 of the State Plumbing Code, a final inspection shall be conducted on the work authorized by this permit. As of this date the inspection has not been requested. The permit fee that was paid covers the inspection to make sure the work was completed according to the Code. We will keep your permit open for another 30 days and if we do not hear from you within this time to set up the inspection, we will mark the permit "no inspection called for by homeowner after notification" and take no further action.
