He indicated that his neighbor to the west, John Pollard, 1385 Skywood Lane, Northeast, had raked a substantial quantity of leaves on to the property between the Engebretson and Pollard properties. If you will note, the City of Fridley has some property between the two (2) residences which probably was to be used for a street easement. There is also property owned by the State of Minnesota which is adjacent to both properties and outside of the noise barrier on Interstate 694. Mr. Engebretson objected to the deposit of the leaves on the property owned by the City and State citing that they were a nuisance. I suggested to him that if some arrangement could be made between himself, Pollard, and his neighbor to the south that perhaps the City would agree to vacate this property and allow it to be divided between the three (3) residences, subject to whatever easements the City needs for utility purposes. I am asking you to inspect the area between in regard to the leaf problem and other maintenance problems and to give me your opinion as to what the City should do regarding the property that they have in this area. We do have City Ordinances that could be used to stop the dumping of leaves onto City or State right of way. In researching the status of Johnson Street, I was able to find that on November 10, 1969 the City Council held a Public Hearing for the vacation of Johnson Street. Mr. Pollard did attend this Hearing and stated that he did not want anymore land and that he objected to the City vacating the street. Therefore, the City Council only vacated the portion south of Skywood Lane. If the street were vacated, it would go totally to Mr. Pollard's property since it was dedicated from that parcel at the time his lot was platted. We would have to retain a utility easement since we do have a 14 inch watermain running down the Johnson Street right of way.
