walls, retaining walls, cribbing, dams, or other protective items.
[ ] Calculations for and approximate quantities of excavation and/or fill
required.
[ ] Signed statement from the property owner accepting responsibility for the
operation and granting permission for land alteration/mining operation.
[ ] Statement to be attached to deed advising of potential need for soil tests
prior to any construction on lots where additional fill material has been
placed.

STIPULATIONS
READ BEFORE SIGNING APPLICATION
1. A surety bond or certified check in the amount of $----. (5% of value
of work to be completed) must be submitted after approval of application and
prior to any work commencing. 9bis bond or check is to ensure satisfactory
performance and compliance with the below stated stipulations. The surety
bond or check shall be kept active until the completion of work and/or
expiration of permit and can only be released by written notitication of the
City after a satisfactory final inspection has been performed by the City.
2. All access and street frontage of the land alteration site must be controlled
by a fence, a minimum of four (4) feet in height. All entrances must have
gates that are capable of being locked.
3. Only rocks- sand, gravel, dirt, or similar natural earth fill is permitted.
No conprete, asphalt, or demolition wastes will be permitted as fill unless a
demolition landfill permit is first obtained f ram Anoka County. .
4. Operations shall be limited to daylight hours and shall not interfere with the
health and safety of surrounding residents and the premises shall be
maintained at all times so as not to create a nuisance.

5. Any explosives used must be done so in accordance with Chapter 2120,
subsections 212.07.5A, .54 .5C, .5D, and .5F. of the Fridley City Code and
any other applicable standards, e. g. Federal, State, Industrial, etc.
6. At the end of each season's operations and no later than the last day of
December each year, the site is to be left in a neat and orderly condition,
with maximum slopes of 2:1 with no overhang or vertical banks and with a level
bottom. ,
7. On the Friday of each work week, or when required by the City, material f rom
this operation that is found to exist on City streets shall be cleaned to the
City's satisfaction by the applicant.
8. Upon completion of land alteration operations, the land must be left according
to the plans and contours submitted with this application and planted with
suitable vegetation to prevent erosion.
9. Upon completion of land alteration operations or expiration of this permit, an
inspection will be made by the City of the premises and adjoining streets.
Any damage found to have been caused by these operations will be corrected by
the applicant upon notif ication by the City.

SUBJECT: Authorization for an. Easement Encroachment for
5460 Matterhorn Drive-N.E.
Staff has received -a request to construct a 10' x 121 'utility shed
within the ten foot utility easement located along the west lot
line of Lot 2, Block 5, Innsbruck North Addition, the same being
5460 Matterhorn Drive N.E. The shed would encroach into the
easement by approximately seven feet. The petitioner has already
installed a concrete pad for the utility shed as indicated on the
attached site plan. We have contacted the utility companies and
their responses are as follows:
1. NSP has overhead lines and. -some underground facilities located
along this easement area.
2. US West Communications has an underground line located within
this easement along the westerly property line. Mr.
Rosendahl, representing US West Communications, was not able
to pinpoint the exact location of the underground wiring, and
recommended that the petitioner contact Gopher State One Call
to locate the utility line.
The City Council has previously authorized easement encroachments
with the provision that the petitioner execute a hold harmless
agreement which releases the City from liability should the City
or any utility company have a need to utilize the easement. Staff
recommends that the City Council permit the easement encroachment
with the following two stipulations:
1. The petitioner shall execute the attached hold harmless
agreement releasing the City from liability.
2. The petitioner shall contact Gopher State One Call to identify
the existing underground utilities.

encroaches upon the easement held by the Grantor; and
THEREFORE, it is agreed by and between the parties as follows:
1. The Grantor hereby agrees to permit the placement of the
Grantee's accessory structure within the utility easement and
which accessory structure is owned by the Grantee on the above
described property.
2. That the Grantee acknowledges that the Grantor may from time
to time need to utilize the easement. The Grantee agrees to
hold the Grantor harmless for any damages which may be
incurred by the accessory structure due to the Grantor's
exercise of its rights within the easement area.
3. The Grantee further agrees that in consideration of the
Grantor permitting the subject accessory structure to remain
upon the easement that the Grantee agrees that they shall not
upgrade, expand, or make additions to the subject accessory
structure. The Grantee further agrees that they shall not
place any additional structures within the subject easement
area. Notwithstanding this language, the Grantee acknowledges
that they shall have an obligation to maintain the structure
in a reasonable fashion.
4. This agreement shall be binding upon both parties and upon
their assigns and transferees.

Hages.
3. The Hages further agree that in consideration of the City
permitting the subject accessory structure to remain upon the
easement that the Hages agree that they shall not upgrade,
expand, or make additions to the subject accessory structure.
The Hages further agree that they shall not place any
additional structures within the subject easement area.
Notwithstanding this language, the Hages acknowledge that they
shall have an obligation to maintain the structure in a

8. APPROVE EASEMENT ENCROACHMENT AGREEMENT FOR 5460 MATTERHORN
DRIVE:
Ms. Dacy, Community Development Director, stated that this request.
is to allow the construction of a 10 foot by 12 foot utility shed
within the ten foot utility easement located along the west lot
line of Lot 2, Block 5, Innsbruck North Addition at 5460 Matterhorn
Drive. She stated that the utility companies have been notified,
and Northern States Power and U.S. West have indicated they have
no problem with the encroachment. Ms. Dacy stated that the City
has not received a response from Minnegasco or Nortel Cable. She
stated that the petitioner is being requested to contact Gopher
State One Call to identify the existing underground utilities. She
requested that Council approve the encroachment and request a hold
harmless agreement.
Councilman Schneider asked why Gopher State One Call was not
I ontacted before the Council takes action on the request.
Ms. Dacy stated that, in retrospect, it may have .been better; but
the City wanted to go directly to the utility companies in order
to process the request as soon as possible. She stated that
Mr. Hage wanted to construct the shed before the winter season.
Mr. Gregg Herrick, Assistant City Attorney, stated that the hold
harmless agreement states if there is any problem with assessing
the easement, the shed would have to be dismantled at the
homeowner's expense.. He stated that the homeowner is also
responsible for rebuilding the shed.
Mayor Nee asked if the shed could be moved to the east five feet.
Mr. Hage stated that he has a very small back yard, and landscaping
has been installed in that area.

encroachment agreement for 5460 Matterhorn Drive with Mr. and
Mrs. Hage, as shown on the drawing submitted by Suburban

stipulations: (1) the petitioner shall execute A hold harmless
agreement releasing* the City from liability; and (2) the petitioner
shall contact Gopher State One Call to identify the existing
underground utilities. Seconded by Councilwoman Jorgenson. Upon
a voice vote, all voting aye, Mayor Nee .declared the motion. carried
unanimously.
9. RESOLUTION NO. 88-1992 RENAMING VIRON ROAD TO HIGHWAY 65 EAST
SERVICE DRIVE:
MOTION by Councilman Schneider to adopt Resolution No. -1992.
Seconded by Councilwoman Jorgenson. Upon a voice vote, 1 voting
aye, Mayor Nee declared the motion carried unanimously.

Ms. Dacy, Community Development. Director, st ed that in 1991, the
council reviewed a potential ordinance r garding mother-in-law
apartments in an R-1 district. She stat that at that time, it
was determined that all parties in olation of the current
ordinance would be given three years to ring their properties into
compliance. She stated that the Cit Y has been working with the
owners of the above two properti and recommended the Council
approve the rental licenses with e.stipulation that the property
owners must convert these st ctures back into single family
residences or cease operating uplexes by May 6, 1994.
Ms. Dacy stated that the p operty owner at 541 53-1/2 Avenue has
agreed with the stipulat' n and will comply. However, the owner
at 4042 Main Street has t indicated he would comply, but is aware
of the deadline and th t court action would be taken after May.6,
1994'.

Dear Sirs:
On February 16, 1996, you were left notice by the City of Fridley
Building Division that a building permit needed to be obtained for
the interior remodeling work you were performing at the above noted
address. On Tuesday, February 20, 1996, you were informed in person
and asked once again to obtain the building permit and submit
construction plans. Work was allowed to continue on your assurance
of compliance. On February 23, 1996, a stop work order was posted
on the residence at 5460 Matterhorn Drive NE as you failed to apply
for the building permit.
We will expect you to correct this violation on or before March 8,
1996 and a special investigation fee will be added equal to the
permit fee. If the permit is not obtained by March 8, 1996, this
matter will be turned over to the City Prosecutor for his legal
consideration.
