Ms. McPherson stated the subject parcel is located at 5530 Matterhorn Drive which is located south of North Innsbruck Drive and also south of the Totino -Grace High School. The petitioner is requesting an increase of the encroachment of the deck.into the side yard from 3 feet to 10 feet and to reduce the minimum setback from 5 feet to 4 feet along the north property line. Located on the parcel is a single family dwelling unit with an APPEALS COMMISSION MEETING AUGUST 15 1995 PAGE 2 C attached three -car garage. The dwelling was constructed in 1977. Sometime after 1977, decks were added in the north side yard, west and in the alcove along the south side of the house. No permits are on file for the original deck construction. In 1995, the petitioner chose to reconstruct the decks and it was brought to the attention of the Building Inspection Department that one of the decks would need a variance. The petitioner has applied for the appropriate permits and has currently reconstructed the southerly and westerly decks. Construction had begun on the northerly deck prior to the building inspection becoming aware of the construction on the property. Separating the proposed deck from the property to the north is a 7 -foot high privacy fence and . a 4 -foot high hedge. Ms. McPherson stated the City has previously granted a•deck encroachment into the side yard from 3 feet down.to a 0 -foot setback from the property line; therefore, staff has no recommendation regarding the request. The request is within previously granted variances. Ms. Savage asked if staff had received any calls regarding this request. Ms. McPherson stated staff had not received any calls. The agenda packet included a letter from the adjacent property owner saying.they had no -objections. Mr. Zgutowicz stated that, basically, all they are doing is replacing an existing deck which was in terrible condition. They moved into the house in 1989. The deck was existing at that time and they are now replacing the existing deck as it was. They are making it stronger. The original deck.was virtually in disrepair. Their neighbor has no problem with the deck. The fence is 7 -feet high. They do not see each other. Ms. Savage asked if the new deck is the same size and of the same design. Ms. Zgutowicz stated yes. The other deck was rotting .and needed to be replaced. Mr. zgutowicz stated they did not let anyone go onto the deck. It was in bad disrepair. It had virtually no footings. Whoever built the original deck did an extremely poor job. They are trying to rebuild what was there before buying the house. They talked to the neighbors and they said it would look nice compared to what was there. Ms. Savage stated, if the size was reduced, a variance would -not # be needed.#' APPEALS COMMISSION MEETING, AUGUST 15, 1995 PAGE 3 C Mr. Zgutowicz stated the deck is only 10 feet by 12 feet. The 10 feet is from the house out. -If using the measurements out, he thought they would be well within the variance. He was told by staff they had to use the measurement from the other person's house. Something appears to be amiss but they have said they would live with it. Ms. Zgutowicz stated they did not take any additional liberties. All they are doing is improving what was there. They have pictures to prove how poorly constructed the decks were. They have made it safer. The deck is up and changing it would create a great expense. That would be a hardship. Mr. Zgutowicz stated, if they had to cut.it back, the deck would be virtually useless. There is plenty of room between their deck and the neighbor's deck. In addition, the fence is there. MOTION by Ms. Smith; seconded by Mr..Kuechle, to close the public hearing. The public purpose is being served. There is a fence. This is allowing the same amount of room as before. The encroachment falls within previously granted variances. Ms. McPherson stated the request is to reduce a sign setback/from the public right-of-way from 10 feet to 0 feet. The reques� is for 6400 Central Avenue which is between Mississippi Street and Rice Creek Road. Located on the subject parcel is Advance Companies, who currently have a small sign which is to ted in the public right-of-way and which was allowed by the ity Council to temporarily exist until the City Council could m e a decision about the Central Avenue corridor. The right -of -w along Central Avenue is 100 feet wide and does extend i, o the boulevard area. The petitioner is requesting th, he be allowed to install a new sign and is proposing to place the sign along the property line midway along the landscaped island in front of the company. Ms. McPherson stated the staff report reco ends that the, variance be denied as there are five alte atives for locating the sign in such a manner that /and et.the code requirements, as follows: 1. Create a landscaped islandarking area; however, this would eliminate one.oired parking stalls.in Alro front of the building. ' 2. If approved, the variance would allow construction of a 10' x IT deck on the side of the existing dwelling unit. SUMMARY OF ISSUES: Code Section 205.04.06.A(3) states: 'Decks, unenclosed porches, canopies and steps to building entrances may extend not more than ten (10) feet into any required front or rear yard setback and not more than 3' into any required side yard, provided they do not extend nearer than five (5) feet to any lot line." The petitioner could reduce the size of the deck to 9', thereby eliminating the second variance as a 9' deck would meet the 5' setback requirement. Without the variance, the petitioner would be limited to a landing and stairway into the dwelling unit from the side yard. Pubfic purpose served by this requirement is to maintain adequate open space between structures and to allow access and maintenance along common property lines. 2 The petitioner requests that a variance be granted to increase the encroachment of the deck in the side yard from 3' to 10', thereby reducing its setback from 5' to 4 from the side lotline. Located on the subject parcel is a single family dwelling unit with an attached three car garage. The dwelling was constructed in 1977. Sometime after the house was originally constructed, decks in the side and rear yard were constructed (see aerial photo). The file has no record of permits being issued for these decks. In • 1995, the petitioner applied for a building permit to reconstruct the decks, hence, the necessity for the variance request. Located on the property to the north, adjacent to the proposed deck is a single family dwelling unit, a T high board on board privacy fence and a 4' high hedge separates the proposed deck from the adjacent property. The maintenance of a 4' separation does provide adequate2 room for maintenance and structure separation purposes. The petitioner could reduce the size of the deck to 9' x,W, thereby eliminating the second variance which requires the setback to be 5' from the side lot line. The City previously approved requests to allow a deck to encroach to the property line in the side yard. The City also has approved variances for decks greater than 3' in width in the side yard. Both requests are within the limits of variances previously granted. Therefore, staff has no recommendation regarding this request.
