Dear Mr. Todd:
On Tuesday, July 10, 1984, another inspection was made of the above noted
property, after we received a call from the neighbor to the south. He is
still not satisfied with the excavating done on the lot and feels that if any
erosion occurs next to his yard, he may lose his retaining wall. We would
suggest that more fill be placed adjacent to his lot.
The rest of the banks look acceptable. Some erosion control and silt control
device must be installed that has the approval of the City Engineering
Department. Contact Mark Burch, Assistant Public Works Director concerning
this matter.
The storm sewer repair, if done, has not yet been approved by the City.
Contact Rusty Silseth, Sewer Foreman, concerning this matter.
There is still some debris in the southeast corner of the lot to be removed.
Some sort of ground cover should be established to control future erosion.

Ms. Sue Williams called and complained that Keith Harstad in May started a house
construction on Matterhorn Drive just west of their home. He has made no serious
attempt to retain the soil erosion from the construction site into the pond.
She said there is some kind of broken storm pipe and the City staff has not been
response at all on her complaint.
Please look into the matter, take appropriate action and advise me.

Construction commenced on this Matterhorn property in early May. After the excavation
was completed, the home owner was directed to move out of the state, and therefore
construction stopped. The heavy rains in the latter part of May and the first part
of June allowed some of the excavated material to enter the detention pond that is
located between this property and Mrs. Williams property.
We were working with the contractor to either complete the construction, or return
the site to it's original condition. Because of the large amount of rain which had
occurred during this period, nothing was done except placement of straw bales along
the property time.
Since that time the owner has returned to the cities and construction has restarted.
The footings for the home are completely poured and the external walls are now in
the process of being formed. Once these walls are completed,ibtcontractor will
clean up the site and repair the storm sewer that was broken during the excavation
process. I and Darrel Clark have discussed these problems with Mrs. Williams and
her husband on numerous occassions since the end of May.

RE: Ponding silt at 5555 Matterhorn.
Dear Mark:
I visited the subject site this morning and found that very little silt has
washed into the pond. I walked out 6 - 10 feet and in a large part of the
area there is only peat and leaves and dead branches next to the shore.
The silt was mostly stopped by our hay bales. There is one area of about
10 square feet or so in a little bay that has some silt. We will clean
it out insofar as possible; then we will -out new hay bales in the areas
that may wash.
I respectfully submit that you should allow the owners to proceed with
landscaping as soon as possible to prevent further washing.
The pond has absolutely not been affected by our construction. I welcome
you to meet me there and look at it if you would be available.

SUBJECT: Water in Basement
Ms. Castaneda, 5555 Matterhorn Drive, contacted me on Friday,
September 16, 1994 about her continuing problem of water in her
basement. She is convinced it is as a result of the runoff from
the vacant property to the south of her property. She has had long
time code enforcement complaints about the length of weeds on the
property. Because the adjacent property is very steep, the runoff
from the property tends to erode the soil around the side of her
home.
She advised me that she was retaining an attorney and an -,architect
to prepare potential legal action against the neighboring property
owner and the City. I advised her that any written documentation
proving that the water in the basement is the result of the
neighboring property must be provided, if the City is to prosecute
any claims against the neighboring property owner. I indicated
that our evidence, to date, would not be able to support such a
claim.
She expressed her frustration with having to pay for the attorney
and architect or other individuals necessary to prove her case.
She also told me about a meeting with Jim Brindley from the Sewer
Department. I did not understand the total aspects of this
conversation, but she reported that he advised her that a retaining
wall is necessary.

Dear Mr. Castaneda:
The City of Fridley Planning and Legal staff have thoroughly reviewed your letter dated June 20,
1995. Our research has indicateed that abatement services for the location in question have been
ordered periodically over the past several years. During these abatements, all reasonably
accessible areas of grass and rank vegetation that exceed ordinance requirements have been cut,
and all non -biodegradable litter and refuse materials have been removed. City code violations
have routinely and consistently been enforced at this location.
Should you choose to pursue this matter further, please be informed that the City of Fridley policy
is not to intervene in civil disputes between private property owners. Therefore, the only
responsibility the City has regarding this dispute would be to continue the normal procedures
regarding complaints of litter, junk or weeds on vacant land. As with any potential ordinance
violation, definitive evidence illustrating that violation must be produced if a complaint is made.
If you desire any further clarification on this issue, please call me at 572-3595. The City of
Fridley appreciates your concern about this matter, and would like to thank you for the time and
effort you have put forth.

Dear Ms. Reach:
Thank you for the opportunity to discuss your retaining wall plans with our staff,
last Friday. From that discussion and site visif, I now understand clearly your
dilemma. At some time in the past a retaining wall was constructed between your
home and the neighbor's home at 5555 Matterhorn. The retaining wall was
constructed prior to your owning the house at 5567 Matterhorn and now is in need
of repair.
Our understanding from your discussion is that you have approached the neighbor
regarding a joint repair/rebuilding of the retaining wall and the neighbor is not
interested in a retaining wall repair or replacement project at this time.
Knowing this, you have determined that you will take the necessary steps to
replace only your portion of the retaining wall, leaving the wall on the property at
5555 Matterhorn intact.
The City's position on this matter is that this is truly a matter between private
property owners. The City cannot intervene with a remedy.
The City staff has, however, alerted you that there are precautionary steps that
you must take if you are going to remove a portion of the wall.. You should at
minimum: A) have a professional survey of the property prepared to assure that
you only impact the structure on your property, B) have a structural engineer
prepare a plan not only for the new retaining wall, but also a plan to assure that no
detrimental impacts to the integrity of the adjacent properties retaining
wall/driveway is sustained, due to your reconstruction.

On Thursday of this week you asked if I could prepare a copy of the original
building permit paperwork for the home at 5555 Matterhorn. Enclosed is a copy of
that information. You had also asked if a deck permit was on file. You believe that
the deck may have been constructed too close to your joint lot line. There is no
permit on file for a deck in this location. Our building inspection staff will be
investigating this matter further.

performed at the aforementioned project. Based on my visual review, my opinions and
comments are as follows:
1- The repair of the ridge beam and installation of joist hangers were being
performed in general compliance with my specifications and drawings
("Restoration of Fire Damaged Roof Framing at 5555 Matterhorn Drive in
Fridley, Minnesota", Sheets S 1 through S3 by Cyrus Consulting, Inc., dated
June 23, 1999).

9. The nail sizes for the hangers shall be in accordance with the reconunendations of
the hanger's manufacture. USP recommends 16d nails for header connection nails
and 10d-1.5" for joist connection nails.
10. Notify the engineer (rain. 48 hours advance notice) for the final review of the
repaired members prior to the installation of the roof sheathing.
