He asked that the Councilmen give some thought to seeking a person to serve -the Second Ward and this should be done with diligence and careful screening. This person must be honest, sincere, dedicated and willing to serve to the best of his/her ability. This person must be willing to.work for all the people in the City of Fridley. He suggested that the Councilmen consider some recommendations and the Council could meet in executive session. BERNARD HEILLE, 1418 MADOW40OR DRIVE: COMPLAINT ON CONTRACTOR, ED CRIES: NOTION by Councilman Breider to receive the communication from Mr. Bernard Heille, 1418 Meadowmoor Drive concerning his dissatisfaction in the completion of his home by Mr. Ed Chies, dated April 3, 1972 and refer the letter to the City Administration to follow through and report back to the Council. Seconded by Councilman Utter. Upon a voice Vote, all voting aye, Mayor Liebl declared the motion carried unanimously. Mr. Heille said his motive was personal satisfaction, and if a home owner cannot receive any satisfaction -from his builder; he would like to know how and why a builder like this cava operate in such a manner and continue to carry a license to build in the City of Fric,ey. Mayor Liebl said that he was fully aware of the trouble Mr. Heille has been having and that when this colitvaactor comes before the Council in the future, the Council will consider his application carefully. When a man signs a con- tract, he must live up to it. Mayor Liebe, weed the letter aloud from Congressman Frenzel regarding a CATV Information Center in Washington D.C., and said that no matter what the Council did bast year, it is our responsibility to follow up and obtain additional infomation. A motion was made a few months ago and it is possible to amend .the ordinance if there is new information or it seems necessary. the more the Council knows about CATV, the more competent a decision can be made by the Council. COMMUNICATIONS: RICE CREEK WATERSHED DISTRICT: APPOINTMENT TO ADVISORY COMMITTEE: MOTION by Councilman Mittelstadt to receive the communication from the Rice Creek Watershed District signed by W.L Goyer, President, dated March 16, 1972. Mayor Liebl said he would like to recommend Councilman Utter to serve on the Advisory Committee. MOTION by Councilman Mittelstadt to concur with the recommendation of the Mayor and nominate Councilman Everett Utter to serve on the Advisory Committee of the Rice Creek Watershed District., Seconded by Councilman Breider. Councilman Breider asked that a letter be directed to the Locke Lake Home Owners Association informing them of the formation of the 1tice Creek Watershed District. They may have interested members that would like to serve on a committee. Mayor Liebl agreed they may be of service, however, he would like to have an elected official on the committee to report back to the Council. Councilman Breider agreed and said his only point was that he would like to have as many people as possible -that live along the waterway be involved. The City Attorney suggested that the City make available to the Watershed District all the technical data we already have compiled along with the problems specific to Fridley. Mayor i ebl iequested that the City Manager attend, at least the first meeting, along with Councilman Utter. THE VOTE UPON THE MOTION, being a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. RESIGNATION, SECOND WARD COUNCILMAN ROBERT KELSHAW: Mayor Liebl read the letter of resignation aloud, serving notice that his resignation is effective April 1, 1972. MOTION by Councilman Mittelstadt to receive the letter of resignation from Second Ward Councilman Robert Kelshaw dated March 29, 1972. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. , Mayor Liebl requested that a Certificate of Appreciation be prepared and sent to Robert Kelshaw for his service to the community. He said he was very sorry to see him go, and that he always found him a conscientious individual. He asked that the Certificate be sent to him along with the Council's good wishes in his new endeavor. Fridley, Minnesota 55432 Re: 1418 Meadowmoor Terrace N.E. Dear Sirs: An inspection was made of the above structure on April 7, 1972 following a complaint from Mr. B. K. Heille, owner of the dwelling. The following Code violations were noted: A. Our records indicate that no rough in or final inspection was called for or made. B. Exterior; 1. Water is entering this structure at various spots, apparently due to inadequate caulking or sealing of the basement and bedroom windows and plate on foundation wall. 2. At the northeast house corner some siding and corner metals were missing prior to owner moving in. 3. The east side of the garage service doorframe is loose from unknown causes, but could be from not being adequately fastened resulting in damage to frame and door. 4. The step at the garage service door is partially broken out resulting in hazardous tread. C. Interior; 1. Bridging in basement not all nailed. 2. Fire hazard exists at south end of kitchen cabinet soffit since a large hole was left open. The owner complains that the cold air from the attic comes down into and past the cabinets. 3. Bathtub and tile corners need sealing to keep structural members dry. 4. The electrical circuit roughed in for the range hood terminates in open wires. The Electrical Inspector is contacting the electrical contractor about this. D. Garage; 1. Bottom plate on exterior garage walls not adequately fastened to masonry. The owner also indicated the following complaints on workmanship that are non -violations of our Code; leaking bath trap is a maintenance problem after 2 years, loose paneling, hole in screen, keys for the garage door, missing locks on interior doors and apron and back door concrete landing settlement should be resolved between the present owner and Mr. Chies who was represented as the owner on the building permit. The owner also indicated Mr. Chies was represented as the owner at the time of closing. Mr. Heille stated he was given a $300.00 credit to complete the unfinished items on the dwelling at the time of closing. Please feel free to contact us if you have any questions on this matter. Would you please have a Building Inspector review the file on this home to see if it passed inspection and if any deficiencies were noted. Have other complaints been received on Mr. E. Chies concerning the quality of construction. When does his contractors license come up for renewal. This appears to be essentially a private matter between Mr. Heille and Mr. Chies to arrive at an equitable solution on Mr. Heille's complaints; however, I believe the City should be aware of the complaint, and if it is not resolved, take that into consideration the next time Mr. Chies renews his license. Perhaps one avenue Mr. Heille may want to investigate is the small claims courtwhere minor claims can be heard without the use of an attorney. Heille 1418 Meadowmoor Drive Fridley, Minnesota 55432 Dear Mr. Heille; This is in response to your letter of April 3, 1972, to the Mayor and City Council regarding some complaints you had with the builder of your home, Mr. Ed Chies. On April 7, 1972, Mr. Clarence Belisle, Building Inspector, inspected your premises and today, by letter, advised Mr. Chies of the dificiencies that were noted in the inspection. I am attaching a copy of Mr. Belisle's letter for your information. As noted in Mr. Belisle's letter, Mr. Chies has 30 days after receipt of the letter to correct the deficiencies or the matter will be turned over to the City Attorney for legal action. Also as noted in Mr. Belisle's letter, there are certain items that are complaints of workmanship and are not violations of our code. These items are a private matter for you and Mr. Ohies to work out an agreement upon. if you are unable to reach an agreement, you may want to consider filing a claim in conciliation court. Information on procedures for doing this can be secured by contacting Mrs. Cass Saefke, Deputy Clerk of the Court, at the Fridley Civic Center, telephone number 560-3450, extension 37. The City of Fridley will continue to insist upon the correction of deficiencies which are in violation of our code. After the 30 -day waiting period, the Building Inspector will again inspect your home to see if the deficiencies have been corrected, and if they have not been, he shall turn this matter over to the City Attorney for action. Fridley, Minnesota 55432 Re: 1418 Meadowmoor Terrace N.E. Dear Sirs: An inspection was made of the above structure on April 7, 1972 following a complaint from Mr. B. K. Heille, owner of the dwelling. The following Code violations were noted: A. Our records indicate that no rough in or final inspection was called for or made. B. Exterior; 1. Water is entering this structure at various spots, apparently due to inadequate caulking or sealing of the basement and bedroom windows and plate on foundation wall. 2. At the northeast house corner some siding and corner metals were missing prior to owner moving in. 3. The east side of the garage service door frame is loose from unknown causes, but could be from not being adequately fastened resulting in damage to frame and door. 4. The step at the garage service door is partially broken out resulting in hazardous tread. C. Interior; 1. Bridging in basement not all nailed. 2. Fire hazard exists at south end of kitchen cabinet soffit since a large hole was left open. The owner complains that the cold air from the attic comes down into and past the cabinets. 3. Bathtub and tile corners need sealing to keep structural members dry. 4. The electrical circuit roughed in for the range hood terminates in open wires. The Electrical Inspector is contacting the electrical contractor about this. D. Garage; 1. Bottom plate on exterior garage walls not adequately fastened to masonry. r. The owner also indicated the following complaints on workmanship that are non -violations of our Code; leaking bath trap is a maintenance problem after 2 years, loose paneling, hole in screen, keys for the garage door, missing locks on interior doors and apron and back door concrete landing settlement should be resolved between the present owner and Mr. Chies who was represented as the owner on the building permit. The owner also indicated Mr. Chies was represented as the owner at the time of closing. -- Mr. Heille stated he was given a $300.00 credit to complete the unfinished items on the dwelling at the time of closing.
