Poole of 7619 Meadowmoor Drive. On June 27, 1985 Mr. Poole was issued two complaints: failure to license his dogs and not having a kennel license. Ordinance 101, Animal Control, of the Fridley City Code defines a kennel as "ark► place where three (3) or more dogs or three (3) or more cats or ary combination of three (3) or more dogs and cats are kept on the same premises". Mr. Poole has three dogs and two cats. - Chapter 101 also dictates that a kennel license is required for the above condition and then only in appropriate zones. Mr. Poole lives in an R-1 zone. Chapter 205 allows for kennels only in C-2 and C-3 zones, and only with a special use permit. Mr. Poole came in on July 10, 1985 to register his dogs and was told he could only register two dogs. He also received an application for a kennel license at that time. The usual procedure in such cases is to dery the license and to inform him that he is in violation of Ordinance 101 of the Fridley City Code and that he will have to reduce the number of animals in his dwelling to the allowed number. Since this is the first time this problem has surfaced, we recommend that Mr. Poole be instructed to obtain 2 licenses for two of his animals and await clarification of this ordinance. We also recommend that the Community Development Commission review this policy and clarify the intent for possible changes to our code. JLR/dm M-85-66
