Fridley, Minnesota,55421 Dear Mr. Flora: I am writing to you in regards to our phone conversation on August 6, 1986 about the encroachment of the building we are doing onto a utility easement in the Innsbruck North Townhouse Development. Attached is the survey of the building of how it lays on the lot, and you can see it covers four inches of the utility easement. According to the City of Fridley, L am not allowed to build on an easement until the city has vacated that easement. Darrel Clark (building inspector) felt that I could go ahead and build the building while the vacation request was going through the city. I have someone scheduled to move in on October 1, and if I couldn't start the building right away, the buyer would back out. In our conversation on August 6, we agreed that I could go ahead with the construction of the building as it is shown on the survey, before the easement has been vacated. If for some reason, the vacation does'not go through, I am responsible for doing whatever is necessary to move the building out of the easement. Sincerely, DARREL A.
