Mr. London said the recreation building would be located in the quadrominium and townhouse area. The building will have a game room, party room, meeting rooms, saunas and an outside swimming pool. Mr. Zeglen inquired how many units would be sharing this facility. Mr. London said he thought about 300 units. Mr. Simoneau asked who would be responsible for the maintenance of the building. Mr. London said the Association would be responsible for the maintenance and the policing of the area. Mr. Lindblad asked how they would know how much parking was needed. Mr. London said there will be many walkways to the area. They prefer not to'have a large blacktop parking lot as it would spoil the aesthetics of the area. Mr. London said more parking could be provided in Phase III if they have to have additional spaces. I Mr. Tonco asked if the recreation room will be the same motif as the townhouses. Mr. London said the exterior will be rough sawn cedar with a brick front and a roof of asphalt shingles, the same as the townhouses. Mr. Tonco asked about the storage and disposal of trash. If 300 units are using the building there will be a need for a method of taking care of the trash. Mr. London said there didn't seem to be any specific location on the plan as presented for this facility. He would check on it. Mr. Tonco said if they had to go to outside storage it would have to be a screened storage area. Mr. Tonco asked about security lights. Mr. London said the lighting plan was complete for Phase II but this building was in Phase III and the lighting plan hadn't been completed. He was sure the area would be well lighted. MOTION BY Tonco to recommend to the City Council approval of the request to construct a recreation building with a swimming pool with the following ..stipulations: 1. This includes a three car garage that will be used as the sales office. Mr. Boardman said the driveway should be 22 feet wide. The driveway on the property should be 25 feet wide. He said it seemed to him that they were required to submit a bond to cover the removal of the building if necessary. The Capp Home will be a permanent building with a full base - went. Councilman Breider asked what would happen to the structure if it was no longer used as a model home. The City Attorney said that it could not be used as a residence, but it could become a law office or a doctor's clinic etc. Councilman Breider asked what it would Look like. Mr. Bob Schroer brought a picture forward and said it is their "Shenandoah" model they will be using for the model home. It will have a triple garage that will be used for the sales office. The home will be finished inside, but not furnished, MOTION by Councilman Breider to concur in approval of the plans for the model, home by Capp Homes with the Subcommittee's stipulations. WHEREAS, the Owners are responsible for the maintenance and upkeep of the common areas, streets and utilities in the Innsbruck North Townhouse complex located between North Innsbruck Drive and I. 694 within the City of Fridley; and WHEREAS, the Owners have requested the City to provide for maintenance of the sanitary sewer system within the townhouse complex, specifically, a periodic cleaning (flushing) of the sanitary sewer laterals; and WHEREAS, the Owners acknowledge that the sanitary sewer system within the townhouse complex is privately owned by the Owners and is not the responsibility of the City; and WHEREAS, the City recognizes that though the townhouse complex sanitary sewer system in under the jurisdiction of the Owners, the City can provide a service to the Owners, if proper compensation is provided for the ser- vice; and WHEREAS, the City does provide various services to the residents of the City of Fridley if proper compensation is provided to cover expenses; and WHEREAS, the City finds that it is in the public interest, welfare and convenience to the people of the City of Fridley to cooperate with residents to provide services where possible. NOW, THEREFORE IT IS AGREED AS FOLLOWS: 1. The City will annually clean (flush) the sanitary sewer laterals within the townhouse complex, as noted on attached Exhibit A. 2. The Owners will pay to the City $500 annually which will cover the City's expenses in cleaning (flushing) the sanitary sewer laterals. The cleaning (flushing) operation shall consist of the following: The cleaning of approximately 6325 feet of eight inch privately owned sanitary sewer lines once a year by utilizing one heavy equipment operator and one light equipment operator to operate the City's flexible hi -velocity jetting machine to force water through the sewer lines forcing debris to manholes at which point any debris would be removed. Agreement -2- Innsbruck North Townhouses Association/City of Fridley 3. The Owners allow the City the use of all streets and common ground areas within the townhouse complex for necessary access to the private sanitary sewer system. 4. The Owners hereby relinquish the right to any claim or liability against the City for any damages that may occur to the sanitary sewer system or streets and common grounds of the townhouse com- plex in the course of the maintenance operation, provided however, that the City shall use reasonable care in protecting the sanitary sewer system, streets and common grounds of the townhouse complex from such damages. 5. This agreement is in effect upon execution by both parties; and shall remain in effect from the date above first shown, except that the said contract shall renew itself for an additional period of twelve months unless one of the parties has given a ninety (90) days written notice of intent to terminate prior to the end of the twelve month period. I would have the following comments: 1. The only service which we will obtain from the City of Fridley is an annual "flushing" of our sewer system. The Board of Directors and maintenance committee of the Association should be sure that they understand what "flushing" is and determine .that that is sufficient maintenance for the sewer system. In that regard, if this has not been done before, is a more extensive procedure required before we get on an annual schedule? I assume that the maintenance committee and the Board have determined that the $500 fee is reasonable. 2. The Agreement does not give any indication of the term, i.e. one year, five years, etc. If this has been discussed with the City and a term has been agreed upon, the Agreement should specify that term. Without specifying the term, I believe that the Agreement would be from year to year. Therefore, the City could, raise the cost each year. In negotiating this matter, however, it may be that if you do not bring up the question, it would take the City a while to realize that in- flation applies to their services. 3. The provision releasing the City from liability for any damages that may occur to the sewer system or streets or common grounds is a broad release provision. If the nature of' the maintenance operations makes damage likely, you should consider the risk/reward aspects of this release from liability. On April 5, 1991, this individual showed me areas covered with dog feces and accessory structures which could benefit from some minor maintenance. On April 9, 1991, I sent letters to four property owners (see attached list) for piles of dog feces scattered across the areas near their units. While this may come under "common area maintenance", I felt that the problem was clearly attributable to the units in question. While at the site, I advised the complainant that I had not observed any maintenance problems related to accessory structures (primarily garage doors) which were significant enough to warrant action under Fridley Zoning Code's maintenance section. However, I stated that I would bring this to the attention of the property management, and that is the reason for notifying you. If you have a policy regarding the manner in which such items are maintained, you may wish to inspect and address this issue. Fridley City Code does require that all the sidewalks be kept clear of snow and ice, and it is my understanding that this maintenance is the responsibility of Innsbruck North and not the individual residents. In addition, I was told that there is an area of brush located between Meister Road and East Bavarian Pass. Upon inspection, I observed what appears to be a small tree that has been chopped up and left in a low area approximately behind 5516 East Bavarian Pass. It is my understarkbng that such work requires a permit from the Department of Natural Resources (DNR) , and I have been advised by John Flora, Public Works Director, that the City has not received information from the DNR indicating that you have obtained a permit. If you are performing such treatment on these ponding areas, it is nperative that you cease this work innnediately until you have obtained a permit frown the DNR. In addition, I wish to confirm our discussion regarding the need to resolve two other maintenance issues on the Innsbruck North property. First, painting should be completed as soon as possible on those buildings upon which work was begun late in 1993. Second, there is an area of fencing located along the pathway near 5401 North Brenner Pass which should be removed from this location. Mark Kvalheim of Bailey Enterprises informed me that his company's contract with Innsbruck North Townhouses does not require maintenance of these walkways. I am aware that efforts have been made to provide sand and de-icing material to the residents for their own use in spreading on walkways adjacent to their residences. However, it appears that some homeowners are either not aware of the maintenance requirements expected of them, or choose not to act to clear their walkways of ice. The City's concern is that someone be appropriately be maintaining these walkways to prevent a serious health and safety hazard, and others visiting Innsbruck North.
