C-3, Mr. Flora, Public Works Director, stated this is a request for a variance to reduce the required rear yard setback for one-quarter of the lot depth (34 feet) to 26 feet to allow construction of an attached garage, 32 x 24 feet, at 711 Marigold Terrace. He stated the petitioner stated a three oar garage is needed to house three cars. Mr. Flora stated if the petitioner were to build a detached garage, he would not need a variance, however, he prefers to attach it to his present house with a new room to be provided between the existing house and the new garage. Mr. Flora stated the Appeals Oomission was split on whether or not this was a self-imposed hardship and it was a split vote on their rec mendation for approval. Mr. Day, the petitioner, stated the reason he designed it in this manner was because he didn't have enough roam on the side to build an attached garage the size he wished. He stated he wanted a triple garage for their three vehicles. He stated, with the shape of the lot, the only way to build a garage that large is to the rear cf the property and he would like to attach a new addition to include a dining and recreation roan between the existing structure and new garage addition. Mayor Nee asked why the neighbor, Mrs. Trowbridge, was opposed. Mr. Flora stated Mrs. Trowbridge didn't know if this addition would affect the resale value of her home. She also stated she didn't want to be the cause for denial of this variance request. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.07.3D.3a, requires a rear yard depth for the main building of not less than twenty-five percent of the lot depth with not less than twenty-five feet permitted or more than forty feet required. Public purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the neighborhood. B. STATED HARDSHIP: "We need a three car garage to house 3 cars; 2 are driven everyday and the third car is a classic that needs indoor storage." C.
