Ms. Stromberg stated that the petitioner's summary of hardship reads: "The deck needs to be built on the south side of the house because the driveway is on the north side of the house, there are no bedrooms on the east side of the house and it would allow a second entrance/exit to the home." Ms. Stromberg stated that the property is zoned S-1, Hyde Park. The existing home was built in 1989. City Code states that decks shall not encroach more than 3 feet in the side yard and it also requires 5 foot setbacks between accessory structures and the property line. Due to the configuration of the home, the petitioner is seeking a variance to allow the deck in the side yard of the property. In 1996, the previous owners of the property were granted a variance to the exact dimensions as the petitioner is requesting for the construction of a 10 foot by 26 foot deck. It- That structure was never constructed. The only difference between the two variances is that the petitioner is requesting that the deck be 8 feet shorter than the previous variance granted. Ms. Stromberg stated that staff has no recommendation as similar variances have been granted in the past. A variance was granted in 1996 for this property to the exact same dimensions. There was also a variance granted in 1997 at 5555 Matterhorn Drive. That variance was granted to increase the encroachment of a deck in the side yard from 3 feet to 8 feet and to reduce the setback of a deck in the side yard from 5 feet to 2 feet. Ms. Stromberg stated that if the variance is granted, staff recommends the following stipulation: 1. The deck shall not be converted to an enclosed porch without the approval of a variance. Ms. Jackson asked if there were any comments from the neighbors. Ms. Stromberg stated no comments were received from the neighbors. Mr. David Brown, petitioner, stated they are planning on putting a door adjoining the deck, and they need room to put furniture on the deck. Dr. Vos asked if it would be 10 feet wide and 8 feet long. Mr. Brown stated that is correct. Ms. Jackson asked how high it would be off the ground. Mr. Brown stated that he thinks it would be 3 or 4 feet. Ms. Jackson asked if he knew what rooms of the neighbor's house overlooked his yard. Mr. Brown stated that he believes there is one bedroom, but he has never been in there. Dr. Vos stated that a fence surrounds the home. Mr. Zinter stated that a six foot fence would be installed on the south side. Is that parallel to the other fence? Mr. Brown stated that is correct. They were going to do that on the front side of the deck also. Dr. Vos asked if it would be coming out straight from the side of the house. Mr. Brown stated that it would come right out from the back. Dr. Vos asked if there was a height you could have in the front yard for that. Ms. Stromberg stated that it would be 4 feet in the front yard, but different on the side yards. MO_ by Ms. Jackson, seconded by Mr. Zinter, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON VOS DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:38 P.M. 4 APPEALS COMMISSION MEETING, JUNE 12, 2002 PAGE 3 Mr. Zinter stated that with the previous approval and the layout of the deck, he does not see a problem with this. Ms. Jackson stated that addressing the safety issue, the second exit from the house is important. The neighbors do not have an objection and this is a good thing. Dr. Vos stated concurred. He was involved in the discussion with the previous petitioner for the same house. The house on the south side was discussed and there was not a problem then, and there is not a problem now. MOTION by Mr. Zinter, seconded by Ms. Jackson, to approve VAR #02-10 with the following stipulation: 1. The deck shall not be converted to an enclosed porch without the approval of a variance. This property is zoned R--1, single family, as are all su ounding properties. The existing home and single stall garage were built prior to 1949. ANALYSIS AND CODE REQUIREMENTS The property is zoned S-1, Hyde Park and is located and fronts on Main Street, south of 61St Avenue. The original home was built pre -1949 and a garage permit was issued for a 16 foot by 20 foot garage in 1956. The original home was demolished after condemnation by the City in 1966. The existing 28 foot by 36 foot home was constructed in 1989. There isn't a permit on file for the 22 foot by 22 foot existing garage. Existing Home and Detached Garage City Code states that decks shall not encroach more than 3 feet into the side yard. It also requires a 5 foot setback between attached accessory structures and the property line. Due to the configuration of the inside of the home the petitioner is seeking a variance to allow the deck in the side yard of the property. City staff has received no comments from neighboring property owners.
