VAR #96-14, BY LAUREN_ CE & KAREN RUSSELL: Per Section 205.04.06.A.(3) of the Fridley Zoning Code, to increase the encroachment of a deck into the required side yard from 3 feet to 7 feet and to reduce the side yard setback from 5 feet to 3 feet to allow construction of a 10 foot by 26 foot deck in the side yard on Lots 20 & 21, Block 8, Hyde Park Addition, the same being 6015 Main Street N.E. MOTION by Ms. Savage, seconded by Dr. Vos, to waive the reading of the public hearing notice and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:57 P.M. Mr. Hickok stated the Mr. & Mrs. Russell request that a variance be granted to increase the encroachment of a deck into the side yard from 3 feet to 7 feet and to reduce the side yard setback from 5 -feet to 3 feet. Mr. Hickok stated there was no clear hardship. The petitioner's request is to build a deck 10 feet by 26 feet on the side of the house. ,The code does require that a deck not extend more than 3 feet into the side yard or closer than 5 feet to the property line. The public purpose served by this is making adequate open space between structures and to allow access for maintenance along common property lines. The petitioners do have two alternatives which would not require a variance. One alternative is to construct a deck 6 feet in width adjacent to the side of the dwelling and the other is to construct a 3 -foot walkway along the side of the dwelling and construct a larger deck off the rear of the dwelling. Mr. Hickok stated that because this request is within previously granted variances, staff has no recommendation. However, the Appeals Commission chooses to approve the request, staff recommends one stipulation: 1. The deck shall not be converted to an enclosed porch without the approval of a variance. Dr. Vos asked the distance between the property line to the 4-plex dwelling to the south. Mr. Hickok stated there is less than 5 feet from the edge of the overhang to the house to the south tQ the lot line. APPEALS COMMISSION MEETING, JUNE 26. 1996 PAGE 15 Dr. Vos asked if there is any concern for fire. Mr. Hickok stated the State Code requires nothing less than 6 feet between residential dwellings. At 3 feet, if this porch area was ever enclosed, there would have to be a fire wall separation. Ms. Karen Russell, 6015 Main Street, stated they also own the 4-plex to the south, and they plan to construct a privacy fence between the two properties. She believed the privacy fence mitigates any encroachment issues. Ms. Russell stated the dining room is on the south side of the house where they are proposing to build the deck. The back of the house is 1 1/2 stories so there is no way to build a deck there, and the bedrooms are at the back of the house. The dining room is already built with a. header for a door. She stated she did not believe the deck would be 26 feet long; it may be shorter than that. Ms. Russell stated they are also intending to move the garage from the back yard and attach it to the north side of the house, so a deck could not be built on that side of the house either. MOTION by Ms. Savage, seconded by Ms. Beaulieu, to close the public -hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 9:08 P.M. Dr. Vos stated this variance request is similar to requests they have granted in the past. He would vote to approve the variance. Ms. Savage agreed. She stated there is not really a hardship, but she could understand the petitioner's desire to build a deck. She did not think the deck would have any adverse impact to the surrounding area. It is a fairly minimal variance request and similar requests have been granted in the past. Ms. Beaulieu also agreed. Ms. Savage asked Ms. Russell if she had any objection to the stipulation recommended by staff. Ms. Russell stated she did not. Side Yard Deck Variance DESCRIPTION OF REQUEST: Laurence & Karen Russell request that a variance be granted to: a. Increase the encroachment of their deck into the required side yard from 3 feet to 7 feet; b. Reduce the side yard setback of a deck in the side yard from 5 feet to 3 feet. There are two requirements within the same code section. If approved, the petitioners would construct a 10 foot by 26 foot deck on the subject parcel. The Russells have not begun construction of their deck. HARDSHIP STATEMENT: No clear hardship was stated, other than the homeowners, desire to: "Build a deck 10 feet by 26 feet on the side of house." SUMMARY OF ISSUES: Section 205.04.06.A(3) requires decks to extend not more than 3 feet into any required side yard. This code section also states that decks are not to extend nearer than 5 feet to any lot line. Public purpose served by this requirement is maintain adequate open space between structures and to allow access and maintenance along common property lines. The petitioners have two alternatives which would not require a variance: (1) Construct a deck 6 feet in width adjacent to the side of the dwelling; and (2) Construct a 3 foot walkway along the side of the dwelling and construct a larger deck off the rear of the dwelling. A four-plex, owned bythe petitioner, is located adjacent to this proposed deck. The request, however, is within previously granted variances. RECOMMENDATION: The variance is within previously granted requests, therefore, staff has no recommendation. Page 3 DEVELOPMENT SITE REQUEST The petitioners request that a variance be granted to: a. Increase the encroachment of a deck into the required side yard from 3 feet to 7 feet; b. Reduce the side yard setback of a deck in the side yard from 5 feet to 3 feet. Both requirements are within the same code section. If approved, the petitioners would construct a 10 foot by 26 foot deck south of and attached to the home at 6015 Main Street N.E. SITE DESCRIPTION/HISTORY The subject parcel is located on Main Street south of 61st Avenue and is zoned S-1, Hyde Park A permit was issued in 1954 for a 4 foot by 8 foot utility room addition to an existing dwelling. In 1956, a 16 foot by 20 foot detached garage was constructed. The original building was demolished after condemnation by the City in 1966. In 1989, a building permit was issued to construct a 28 foot by 36 foot dwelling. There is no permit in the file for the 22 foot by 22 foot garage indicated on the site plan. ANALYSIS Section 205.04.06.A(3) requires decks to extend not more than 10 feet into any required front or rear yard setback and not more than 3 feet into any required side yard, provided they do not extend nearer than 5 feet to any lot line. Public purpose served by this requirement is maintain adequate open space between structures and to allow access and maintenance along common property lines. The petitioners proposed toconstructt a 10 foot by 26 foot raised deck along the south side of the dwelling. The petitioner has two alternatives which could be pursued which would not require variances. Reduce the width of the deck to 6 feet which would comply with both the encroachment and the setback requirements of the code section; or 2. Construct a 3 or 4 foot wide walkway along the side of the house leading to a deck in the rear yard. The request, however, is within previously granted variances. A reduction in side yard setback from 10 feet to 3 feet would be required. RECOAUdENDATION: The variance is within previously granted requests; therefore, staff has no recommendation.
