Fridley, MN 55432 Dear Ms. Russell: Thank you for your letter dated October 11, 1988 regarding the potential development of the property legally described as Lots 20 and 21, Block 8, Hyde Park which is located adjacent to your property (Lots 18 and 19, Block 8, Hyde Park). As you are aware, these lots are zoned S-1, Hyde Park Neighborhood, a special zoning district enacted by the City Council in 1978. The following describes the background and history of these lots' and describes the intent and purpose of the S-1, Hyde Park District. Also provided is a description of the rezoning process if you wish to pursue an application. Your letter stated that the structure was destroyed in a tornado in the early sixties. Our files contain copies of correspondences from the City of Fridley Health Department in 1965 notifying the property owner that the existing structure was unfit for human habitation and the City was initiating condemnation proceedings. On March 29, 1966 the City requested a contractor to demolish the dwelling and clear the premises. Given this correspondence, it can reasonably be assumed that the property was cleared in 1966 and has remained vacant. In 1978, the City Council enacted the S-11 Hyde Park Neighborhood district. Enclosed are the Planning Commission and City Council meeting minutes which will give you a feel for the intent of the district and the feelings of the neighborhood at that time. It appears that the intent of the district was to encourage a single family residential character while recognizing that a number of nonconforming uses existed i.e. multiple family dwellings and scattered commercial buildings. In order to preserve the rights of the existing uses, the ordinance was drafted to allow for reconstruction of existing uses if completely destroyed. Karen Russell October 31, 1988 Page 2 However, development on vacant lots is restricted to single family dwellings (ordinance enclosed). Because the property, Lots 20 and 21, has remained vacant since 1966 and because the ordinance was passed in 1978, any new development on the property must be a single family dwelling. Since 1978, there has not been any rezoning cases in the neighborhood where a property owner wishes to rezone a vacant property to another zoning district. In order to construct a multiple family structure on the property, you would need to file a rezoning application to R-3, General Multiple Dwelling district. Because the record indicates that the intent of the Council action and neighborhood desire is to create a single family orientation in the neighborhood, City staff's initial evaluation is that the rezoning would not be recommended for approval. Although I recognize multiple family dwellings exist around the property, recommending approval of the rezoning would be contrary to the intent of the S-1 district to create a single family neighborhood. However, you have the right to pursue a rezoning application if you wish. You may also want to contact other property owners in the neighborhood to gain their reaction. Given a history of significant neighborhood involvement, the City Council will be looking to the neighborhood for input on the rezoning application. Also enclosed is a rezoning application. A schedule is also enclosed identifying the application deadlines and Planning Commission and City Council meeting dates. In order to make application for the rezoning, you must complete the application form, submit a check in the amount of $300.00 (this is a non- refundable fee in order to cover staff administration expenses), and submit a scaled plan of the property showing the dimensions of the lot, street names and location of the proposed structure and setbacks. If you wish to pursue construction of a multiple family dwelling, it may assist your application in providing as much information as possible about the type of construction and appearance of the building.
