given the opportunity to be heard at the above time and place.

ADMINISTRATIVE STAFF REPORT
953 Mississippi Street N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4C, requires a rear yard depth of not less than 25 percent
of the lot depth required, with not less than 25 feet permitted or more than
40 feet required for the main building.
Public purpose served by this requirement is to provide a rear yard space
to be used for green area which enhances the neighborhood.
B. STATED HARDSHIP:
"This is a large lot in an old plat. The house is situated so that any
split of the lot to form a new buildable site would place the lot line into
the required rear yard. The lot is large enough to split into three lots."
C. ADMINISTRATIVE STAFF REVIEW:
This lot is 111.37 feet by 250.0 feet on the northwest corner of Mississippi
Street and Oakley Drive, with the frontage on Mississippi Street.
The applicant proposes to split off the northerly 81 feet to make a buildable
site, fronting on Oakley Drive. The existing house is set back 121 feet
from the front property line (miss. St.) leaving a 20 foot rear yard if the
lot split is approved. If the Boards decision is to grant this request the
staff has no suggested stipulations.

Ir. Clark noted that the Planning Commission "commanded approval;of the lot split, depend-
ing on variance approval.- The reason for the frontage of 81 feet on the new building
site was to meet the required 9000 square foot lot. Air. Hippen asked if the 20 foot
rear yard was from the back of the home. Mr. Clark responded that it was from the
back of the house to where the new lot line would be, and that the garage would
also be about 20 feet. The other garage shown in the picture would be removed.
Yr. Barna asked Ix. Anderson why he just split the lot instead of going for three
lots and also why an 80 foot versus a 75 foot lot in the back? Mr. Anderson
responded that he understood that was the requirement and Fir. Clark added that
the 81 feet gave 9021 square feet enough to meet the area requirement.
MOTION by Mr. Barna, seconded by Mr. Hippen to close'the public hearing. UPON A
