(SHORTY' S TOWING) Prior to Carl Newquist writing the official letter' to'us•calling to your attention the possible zoning violation being committed by Shorty's Towing,•I had some discussions with both. Carl Newquist and Shorty's. As it. stands at this point Shorty's are aware of the complaint regarding vehicles in their driveway. It is unknown at.this time if they will remove the vehicles in an effort to please the complainant. As you may know the original complaint from the neighbor was the running.of the diesel engine of one of the tow - trucks. The complainant indicated that this was creating a nuis- ..ance and emitting black soot.into his yard. Shorty's were advised of this complaint and apparently have ceased this.operation since the complainant indicated at his last visit to the Police Depart- ment that he has not observed this practice continue since we. advised Shorty's of the alleged violation. It now seems that the complainant wants to continue to push for other alleged. violations by Shorty's at their home. .It does not appear from reviewing our City ordinances -that Shorty's are'Violating any type of parking violation, therefore the only possible violation that remains is a possible zoning infraction..since they apparently have ceased the nuisance issue. There even is some question about the zoning , violation to the point where -it would not be possible for the City, such as -the Police Department, to gain specific evidence regarding this violation without a considerable amount of surveillance. Far. this reason our City Prosecutor has requested that the complainant keep a running log of .the dates and times that the tow trucks are in the yard and supplement this evidence with photographs. Fridley, Minnesota 55432 I recently interviewed a citizen by referral from the police department who complains that Shorty is violating the zoning ordinance by operating a towing service from his home. Specifically, this neighbor indicates that trucks are dispatched from the house and often seem to return to the house for short periods of time with cars in tow. Allegedly there are often three or four trucks on the premises at one time. During the colder winter months, diesel trucks are left running in the driveway with attendant noise and fumes. This seems to be similar to the situation we had with Roger's Mobile Home Repair. Because of the contractual relationship between Shorty's Towing and the City of Fridley I thought it possible to take care of this situation short of issuing a criminal complaint. I asked the citizen to document the alleged violations in diary form and with pictures if possible and I asked him to return to my office on March 3, 1975. I suspect if the situation has not improved by then that I will have no alternative but to issue a formal complaint charging Shorty with a zoning violaticn. Thank you. truly yours, Cart -O'.
