Sobiech, Public Works Director MEMO FROM: Steven Olson, Environmental Officer DATE: July 21, 1977 SUBJECT: Complaint on Number of Cars Located, and People Living at: 1220 Mississippi Street An inspection was made today, with no one at home. A card was left requesting the resident to call the office. The inspection found two cars and a boat parked in the driveway and one car and a pick-up truck in the street. The only thing physically wrong with the residence was that the yard needed mowing and there were a few extra tires in the yard. Mr. Steve Klick (tenant) (571-1403) called the office and indicated the home is owned by a person working for Northeast Realty located on Silver Lake Road and Mississippi. There are three people living there full time and one stays there over the weekends and works in Duluth. Of the four people involved, there are seven vehicles and they do some of their own maintenance on their vehicles. Mr. Klick stated that they would try to maintain their yard so there are not extra auto parts left lying about. A building permit shall not be required for the following: 1. One-story detached accessory buildings used as tool and storage sheds, playhouses and simi- lar uses, provided the projected roof area does not exceed 120 square feet (11.15 m2). Fences not over 6 feet (1829 mm) high. 3. Oil derricks. 4. Movable cases, counters and partitions not over 5 feet 9 inches (1753 mm) high. 5. Retaining walls which are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class 1, 11 or III -A liquids. 6. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons (18 927 L) and the ratio of height to diameter or width does not exceed 2 to 1. 7. Platforms, walks and driveways not more than 30 inches (762 mm) above grade and not over any basement or story below. 8. Painting, papering and similar finish work. 9. Temporary motion picture, television and theater stage sets and scenery. 10. Window awnings supported by an exterior wall of Group R, Division 3, and Group M Occu- pancies when projecting not more than 54 inches (1372 mm). 11. Prefabricated swimming pools accessory to a Group R, Division 3 Occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed 5,000 gallons (18 927 L). Unless otherwise exempted, separate plumbing, electrical and mechanical permits will be re- quired for the above -exempted items. Exemption from the pennit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. 106.3 Application for Permit. 106.3.1 Application. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the code enforcement agency for that purpose. Every such applica- tion shall: I. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work. 3. Indicate the use or occupancy for which the proposed work is intended. 4. Be accompanied by plans, diagrams, computations and specifications and other data as re- quired in Section 106.3.2. 5. State the valuation of any new building or structure or any addition, remodeling or alteration to an existing building. 6. Be signed by the applicant, or the applicant's authorized agent. 1-4 1994 UNIFORM BUILDING CODE 106.4.4-107.6 i.A time required by this section for good and satisfactory reasons. The building official may extend the time for action by the permittee for a period not exceeding 180 days on written request by the per mittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended more than once. 106.4.5 Suspension or revocation. The building official may, in writing, suspend or revoke a per- mit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any ordinance or regulation or any of the provi- sions of this code. SECTION 107 — FEES 107.1 General. Fees shall be assessed in accordance with the provisions of this section or shall be r as set forth in the fee schedule adopted by the jurisdiction. 107.2 Permit Fees. The fee for each permit shall he as set forth in Table I -A. `-a" The determination of value or valuation under any of the provisions of this code shall be made by the building official. The value to be used in computing the building pennit and building plan re- view fees shall be the total value of all construction work for which the permit is issued, as well as all fir finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire -extin- guishing systems and any other permanent equipment. 1073 Plan Review Fees. When submittal documents are required by Section 106.3.2, a plan E review fee shall be paid at the time of submitting the submittal documents for plan review. Said plan ,h review fee shall be 65 percent of the building permit fee as shown in Table 1-A. The plan review fees specified in this subsection are separate fees from the permit fees specified 1 `: in Section 107.2 and are in addition to the pen -nit fees. When submittal documents are incomplete or changed so as to require additional plan review or I when the project involves deferred submittal items as defined in Section 106.3.4.2, an additional I, plan review fee shall be charged at the rate shown in Table 1-A. 107.4 Expiration of Plan Review. Applications for which no permit is issued within 180 days 1 Fw'? following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The build- ing official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing that circumstances beyond the control of the applicant have pre- ; : W. vented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan re- view fee. 107.5.1 Investigation. The payment of such investigation fee shall not exempt any person from com- pliance with all other provisions of this code nor from any penalty prescribed by law. 107.6 Fee Refunds. The building official may authorize refunding of any fee paid hereunder which was erroneously paid or collected. The building official may authorize refunding of not more than 80 percent of the permit fee paid . when no work has been done under a permit issued in accordance with this code.'. 1-7»,r` ' 16B.66 CERTAIN INSPECTIONS. The state building official may, upon an application setting forth a set of plans and specifications that will be used in more than one municipality to acquire building permits, review and approve the application for the construction or erection of any building or structure designed to provide dwelling space for no more than two families if the set of plans meets the requirements of the state building code. All costs incurred by the state building official by virtue of the examination of the set of plans and specifications must be paid by the applicant. A building official shall issue a building permit upon application and presentation to the official of a set of plans and specifications bearing the approval of the state building official if the requirements of all other local ordinances are satisfied. HIST: 1984 c 544 s 71; 1986 c 444; 1994 c 634 art 2 s 6,10 16B.67 APPEALS. A person aggrieved by the final decision of any municipality as to the application of the code, including any rules adopted under sections 471.465 to 471.469, may, within 180 days of the decision, appeal to the commissioner. Appellant shall submit a fee of $70, payable to the commissioner, with the request for appeal. An appeal must be heard as a contested case under chapter 14. The commissioner shall submit written findings to the parties. The party not prevailing shall pay the costs of the contested case hearing, including fees charged by the office of administrative hearings and the expense of transcript preparation. Costs under this section do not include attorney fees. Any person aggrieved by a ruling of the commissioner may appeal in accordance with chapter 14. For the purpose of this section "any person aggrieved" includes the council on disability. No fee or costs shall be required when the council on disability is the appellant.
