The proposed location of the accessory building will be placed over an existing sanitary sewer line. The Engineering staff does not have a problem with the structure being placed on a slab over the sanitary sewer line as long as a Hold Harmless Agreement is executed, which relieves the City of any responsibility to the structure as a result of repairs or replacement of the sanitary sewer line. Moravetz, Engineering Assistant DATE: September 17, 1992 SUBJECT: Sanitary Sewer Issue Affecting the Pehl Property (1250 Mississippi St) In 1956 the City installed a sewer main from 63rd Avenue to Mississippi Street between Pierce Street and Central Avenue. The project was put in with no easements for whatever reason. County records do not show any easements that were granted nor condemned. The sewer line running from 63rd to 64th has been accommodated with an easement with the platting of Herwat Rice Creek Terrace. However, the sewer line running from 64th to Mississippi Street remains easement free. In 1974 a sewer line was installed from Central Avenue running west along the westerly prolongation of 64th Avenue. This line was fed into the lift station at Central Avenue, leaving the line north of that point as a 'back up' line in the event of a lift station failure. Since the installation of the lift station, only one service line dumps into the sewer main extending through Pehl's property, the service line is from the Holi Haus (building west of Sandees' Cafe). The depth of this "seldom used" sewer line is 16 to 24 feet deep. The existing service for the Holi Haus could be re-routed if a new line was constructed from the existing M.H. southeast of the Pehl property south approximately 400 feet to the sewer system built in 1974. This new line would necessitate an easement from Brickner, owner of part of Lot 3, Auditor's Subdivision No. 88. Another less attractive option would be to install a new service to Mississippi Street. However, the main is 25 to 29 feet deep in street and the County just completed street surfacing improvements to Mississippi Street this summer. Burns On Wednesday, January 6, 1993, between 3:00 p.m. and 3:45 p.m. I met with Gerald Pehl, Dorothy Pehl, Attorney James Neilson, Virgil Herrick and John Flora. Mr. Neilson began by stating that Mr. and Mrs. Pehl bought their property on Mississippi Street without knowledge of a sewer line. They became aware of the existence of a sewer line on the property when Mr. Pehl attempted to get a special use permit from the City to build a garage. At that time, he was told he had to give us an easement for the sewer line in exchange for the special use permit. Subsequently, the City dropped that demand and granted the special use permit. Mr. Neilson stated that his clients bought the property subject to easements and parties in possession (adverse possession). He did say, however, that the items to which Mr. and Mrs. Pehl were subject to were those that were recorded at the County or those that were visible when the property was bought. Since the sewer line was not visible, it is Mr. Neilson's contention that Mr. and Mrs. Pehl are not obligated to continue to have the sewer line on their property. They want the sewer line removed, even though it may have been constructed with the consent of the previous property owner. Mr. Neilson said that Mr. Pehl has a right to withdraw his consent and require the removal. Mr. Neilson identified the property as Lot 15 of Auditor's Subdivision No. 88. He said that the problem his client has with the sewer line is that the pipe is only 7.85 feet from the northeast corner of the house. He also has a problem in that he feels that the sewer line will have a negative impact on the future value of the house. An appraiser, Mr. George Johnson of Appraiser Analysts, has estimated that the reduced value is about $24,000. Memo to File Sewer Line - Pehl Property January 7, 1993 Page Two Virgil Herrick stated that this assessment of potential damage is very speculative. Mr. Neilson said that it would have to be determined in court. He also said he recalls a very unique case in the City of Anoka that occurred two or three years ago. The implication is that the case was settled in favor of the property owner. He implied in his statements that he felt that the property owners would win if this case went to a jury. Mr. Neilson asked what the City had to propose to resolve the matter. I pointed out that in September, 1992, we had proposed that Mr. and Mrs. Pehl be indemnified and that we did not hear from them for several months. We felt that before proceeding, we needed a response to our original proposal. Mr. Neilson responded by saying that Mr. and Mrs. Pehl will not give us the easement requested in my letter dated September 28, 1992. Virgil asked if there were any alternative solutions they would accept, other than removing the sewer line. Mr. Neilson said they would accept moving the sewer line to the pLrameter of the property. We ended the meeting by discussing several other potential alternatives. We talked about injecting the line with Insituform, a process that would expand the life of the sewer line indefinitely. We also spoke briefly about the possibility of vacating the line and tying the Holly house either directly to Mississippi Street or the lift station to the south. Ultimately, those present at the meeting on behalf of the City agreed that we would consider the points raised by Mr. and Mrs. Pehl and Mr. Neilson and contact them. Mr. Neilson agreed to make copies of the abstract of title he had brought and forward them to Virgil Herrick. We also briefly discussed with Mr. and Mrs. Pehl and Mr. Neilson the possibility of amending the indemnification agreement previously sent to them on September 28, 1992, to include language that would allow them to recover attorney's fees for any legal action they might have to take in order . to enforce the indemnification agreement. Flora,+ Public Works Director DATE: February 2, 1993 SUBJECT: Sewer Line — Pohl Property, 1250 Mississippi St As a result of a meeting we had with the Pehl's and their attorney on January 6, 1993, I am providing the following costs to be considered in negotiating a solution to their issue regarding the sewer line which runs across their property. If we are required to do anything, it would be my suggestion that we provide the Pehl's with a hold harmless agreement regarding the sewer line that runs across their property and enhance that agreement by relining the existing 10 -inch corrigated metal pipe with an Insituform liner. Cost of this liner is estimated at approximately $25,300. If this option would not be acceptable, another possible option is to completely close off the line, and abandon the sewer line through their property. The cost to pump concrete into the lines between the manholes of the line which run through their property would be approximately $2,500. In addition, we would be required to relocate the existing adjoining property (Holly Haus) sewer service which connects to the manhole upstream of the Pehl's property. In this regard we have two options. One option would be to relocate the sewer service to the lift station to the south at a cost of approximately $12,000 or to relocate the service to the Mississippi Street sewer line at a cost of approximately $14,000. Either of these relocations may require an easement as the Holly Haus owner may dictate that the City be responsible for the realignment of the existing sewer line. If the sewer line which runs across the Pehl property was to be abandoned, I see no reason why a hold harmless agreement would be necessary. If you need additional information in regard to this problem, please let me know. Flora, Public Works Director DATE: February 2, 1993 SUBJECT: Sewer Line — Pehl Property, 1250 Mississippi St As a result of a meeting we had with the Pehl's and their attorney on January 6, 1993, I am providing thefollowing costs to be considered in negotiating a solution to their issue regarding the sewer line which runs across their property. If we are required to do anything, it -would be my suggestion that we provide the Pehl's with a hold harmless agreement regarding the sewer line that runs across their property and enhance that agreement by relining the existing 10 -inch corrigated metal pipe with an Insituform liner. Cost.of this liner is estimated at approximately $25,300. If this option would not be acceptable, another possible option is to completely close off the line, and abandon the sewer line through their property. The cost to pump concrete into the lines between the manholes of the line which run through their property would be approximately $2,500. In addition, we would be required to relocate the existing adjoining property (Holly Haus) sewer service which connects to the manhole upstream of the Pehl's property. In this regard we have two options. One option would be to relocate the sewer service to the lift station to the south at a cost of approximately $12,000 or to relocate the service to the Mississippi Street sewer line at a cost of approximately $14,000. Either of these relocations may require an easement as the Holly Haus owner may dictate that the City be responsible for the realignment of the existing sewer line. If the sewer line which runs across the Pehl property was to be abandoned, I see no reason why a hold harmless agreement would be necessary. Flora, Public Works Director DATE: February 26, 1993 SUBJECT: Sewer Line — Pehl Property 1250 Mississippi Street Reference: My memorandum PW93-039 dated February 2, 1993 subject as above In an attempt to resolve the Pehl issue regarding the sewer line which runs under their property, I would suggest, as a most expedient and cost effective solution, that the City provide Pehl with a hold harmless agreement indicating that the City would be responsible for any costs associated with damage to their property as a result of the sewer line. If the agreement can be agreed to and executed, we can at some point in time, Insituform that section in conjunction with the other portion of that line on a normal schedule as we upgrade the corrugated metal sanitary sewer pipe. To accelerate that section of line with a liner at this time, would not address the more critical section of that line. Again, if the agreement were accepted, we could ensure the Pehl's that this section of line would be incorporated into our sanitary sewer maintenance program, and it would assure the City that we would not be liable for any problems for the next number of years. Flora, Public Works Director PW93-167 FROM: Scott Erickson, Asst Public Works Director DATE: May 5, 1993 SUBJECT: Holl -Haus Sanitary Service Relocation Four options have been reviewed regarding the sanitary service for the Holi-Haus. Option No. 1 is rerouting the existing service line from the Holi-Haus out to Mississippi Street. Included in this option is the abandonment of the existing sewer main that runs through the Pehl property. This existing line would be abandoned and filled with concrete. The estimated cost is $28,000. Option No. 2 is to relocate the existing sewer main from the Pehl property onto the Holl -Haus property and extend it to the Mississippi Street main. This would be an extremely expensive option due to the fact that a minimum 25 -foot deep cut would have to be made for this installation. This option is estimated to be approximately $45,000. The third option is to extend the existing Holl -Haus service from the manhole south to the existing lift station main. This option would cost approximately $32,000 and would entail removing a number of large trees on this property. The fourth option is to Insituform the existing main that runs through the Pehl properly and purchase the necessary easements from Pehl. This option is estimated to be approximately $35,000; $20,000 relating to Insituforming the line and an estimated $15,000 for purchase of the necessary easement. Engineering staff has contacted the property owners, the Fishers and the Brickners, regarding obtaining the necessary easements to allow us to relocate the sewer main from the Pehl properly. The initial meeting was positive, with the property owners generally appearing to be willing to grant the easements to the City. Haukaas, Public Works Director DATE: November 26, 2003 SUBJECT: Sewer Line Across Pehl Property. 1260 Mississippi Street PW03-098 As requested by the City Council at their November 24, 2003 meeting, I have assembled all recorded documentation regarding the sanitary sewer trunk line that crosses the Pehl property at 1260 Mississippi Street As you can see, this issue was before the City Council in 1992 as several people recalled. The only recent contact has been due to the proposed Town Center Development The Pehl"s met with the Planning staff on November 1, 2003. The Pehl"s still contend that the City should move the line, and if not, then require the developer for Town Center to do it Staff explained that we could not require that relocation by the developer. The Planning staff did offer to again search for information on the easement None was found because it did not exist The Pehl"s were notified by Paul Bolin that no easement existed after the November 3 Planning Commission meeting and that the City has not changed its position since the determination in 1992. If any new information was found, only then would they be contacted. The only things that have changed since 1992 are that the W Avenue lift station now is monitored by our SCADA system and alarms go out in the event of a failure, and secondly that the Tamarisk building would be removed if the Town Center Development goes forward. With these two things in mind, there is no need to keep this pipe. Once Tamarisk is gone, this issue could be easily resolved by filling the pipe with sand or grout and abandoning it in place. THE SURVEY DID NOT SHOW A SEWER LINE ON THE PROPERTY OR ANY EASEMENT OF ANY KIND. SUBSEQUENTLY, WE CLOSED ON THE PROPERTY ON THE SCHEDULED DATE, JANUARY 15, 1992. SOMETIME IN EARLY FEBRUARY, I MADE TELEPHONE INQUIRY AS TO RESTRICTIONS ON ACCESSORY BUILDINGS AND WAS TOLD OF THE SQUARE FOOTAGE RESTRICTIONS AND OF A SEWER LINE THAT CUT'. DIAGONALLY ACCROSS THE PROPERTY THAT MIGHT INTERFERE WITH THE LOCATION OF ANY BUILDING. I WAS NOT TOLD OF THE EXTENT OF THE ENCROACHMENT. JOHN TOLD IIS THE CITY WOULD REQUIRE AN EASEMENT AND A HOLD HARMLESS AGREEMENT AS CONTINGENTS TO ISSUING A PERMIT. WE UNDERSTOOD THEN AND WE UNDERSTAND NOW WHY THE CITY REQUIRES THESE AGREEMENTS. THE CITY HAD DONE A SURVEY OF THE PROPERTY IN ORDER TO LOCATE THE SEWER AND IDENTIFY THE EASEMENT REQUESTED. AFTER THE PLANNING COMMISSION HEARING AND SUBSEQUENT APPROVAL WITH CONTINGENCIES, WE DECIDED THAT IT WOULD NOT BE IN OUR FINANCIAL BEST INTEREST TO BUILD OUR BUILDING OVER A SEWER LINE AND BE BOUND BY A HOLD HARMLESS AGREEMENT. WE SOUGHT THE ADVICE OF AN ATTORNEY SPECIALIZING IN REAL ESTATE MATTERS. HIS RECOMMENDATION WAS TO OBTAIN AN APPRAISAL BASED ON THE INFORMATION EXPLAINED.ABOVE TO DETERMINE THE EXTENT OF ANY DECREASE IN VALUE AS A RESULT OF THE ENCROACHMENT. FOLLOWING THE MEETING.WITH GUR ATTORNEY, I MET WITH BARB DACY AND CLYDE MORAVETZ, A CITY'` ENGINEER. I INQUIRED ABOUT RELOCATING THE SEWER LINE AND FILLING THE' LINE WITH CONCRETE IN THE EVENT OF FAILURE. RELOCATING -THE LINE TO A MORE CONVENTIONAL EASEMENT SUCH AS THE PROPERTY LINE, WOULD ELIMINATE THE NEED FOR A HOLD HARMLESS AGREEMENT AND GRANTING SUCH AN EASEMENT WOULD NOT ENCUMBER THE PROPERTY FOR'FUTURE SALE. THIS WOULD BE A "WIN-WIN SITUATION. WE ALSO DISCUSSED RE -LOCATING THE BUILDING ON THE SITE MORE THAN 50 FEET FROM THE SEWER LINE. THIS DISCUSSION LED TO OUR DECISION TO RELOCATE THE BUILDING. BARB TOLD ME THAT PLANNING WOULD SUPPORT A RECOMMENDATION TO THE CITY COUNCIL FOR APPROVAL OF THE ISSSUANCE IF A SPECIAL USE- PERMIT WITHOUT THE EASEMENT AND HOLD HARMLESS CONTINGENCIESW WE WERE ENCOURAGED THAT WE COULD WORK OUT THE SPECIAL USE PERMIT- TISSUE AND THE EASEMENT ISSUE IF THEY WERE TREATED SEPARATELY NOW THAT THE BUILDING WAS BEING RELOCATED. HOWEVER, OUR FIRST CHOICE: -OF LOCATIONS WAS THE SITE AS STATED IN OUR APPLICATION. WE REALIZED THE NEED OF CITY TO OBTAIN AN EASEMENT AND A HOLD HARMLESS AGREEMENT AS CONTINGENCIES TO THE APPROVAL AND ISSUANCE OF A PERMIT. BARB TOLD ME THAT PLANNING WOULD RECOMMEND APPROVAL TO THE CITY COUNCIL REMOVING THE EASEMENT AND HOLD HARMLESS CONTINGENCIES. I TOLD HER THAT I WOULD BE AT THE COUNCIL MEETING TO ANSWER ANY QUESTIONS AND COMMENT. I CALLED THE APPRAISER AND TOLD THEM TO PUT THE APPRAISAL ON HOLD SINCE THE PERMIT WAS NOT BEING WITHHELD BECAUSE OF THE EASEMENT REQUIRMENT. Moravetz, Engineering Assistant DATE: September 17, 1992 SUBJECT: Sanitary Sewer Issue Affecting the Pehl Property (1250 Mississippi St) ` In. 1956 the City installed a sewer main from 63rd Avenue to Mississippi Street between Pierce Street and Central Avenue. The project was put in with no easements for whatever reason. County records do not show any easements that were granted nor condemned. The sewer line running from 63rd to 64th has been accommodated with an easement with the platting of Herwat Rice Creek Terrace. However, the sewer line running from 64th to Mississippi Street remains easement free. In 1974 a sewer line was installed from Central Avenue running west along the westerly prolongation of 64th Avenue. This line was fed into the lift station at Central Avenue, leaving the line north of that point as a 'back up' line in the event of a lift station failure. Since the installation of the lift station, only one service line dumps into the sewer main extending through Pehl's property, the service line is from the Holi Haus (building west of Sandees' Cafe). The depth of this "seldom -used" sewer line is 16 to 24 feet deep. The existing service for the Holi Haus could be re-routed if a new line was constructed from the existing M.H. southeast of the Pehl property south approximately 400 feet to the sewer system built in 1974. This new line would necessitate an easement from Brickner, owner of part of Lot 3, Auditor's Subdivision No. 88. Another less attractive option would be to install a new service to Mississippi Street. However, the main is 25 to 29 feet deep in street and the County just completed street surfacing improvements to Mississippi Street this summer. If the City were to discontinue use of this 'back up' line, I would recommend putting in an alarm system which the police could monitor. Bums, City DATE: January 7, 1993 Manage i SUBJECT: Sewer Line - Pehl Property, 1250 Mississippi Street On Wednesday, January 6, 1993, between 3:00 p.m. and 3:45 p.m. I met with Gerald Pehl, Dorothy Pehl, Attorney James Neilson, Virgil Herrick and John Flora. Mr. Neilson began by stating that Mr. and Mrs. Pehl bought their property on Mississippi Street without knowledge of a sewer line. They became aware of the existence of a sewer line on the property when Mr. Pehl attempted to get a special use permit from the City to build a garage. At that time, he was told he had to give us an easement for the sewer line in exchange for the special. use permit. Subsequently, the City dropped that demand and granted the special use permit. Mr. Neilson stated that his clients bought the property subject to easements and parties in possession (adverse possession). He did say, however, that the items to which Mr. and Mrs. Pehl were subject to were those that were recorded at the County or those that were visible when the property was bought. Since the sewer line was not visible, it is Mr. Neilson's contention that Mr. and Mrs. Pehl are not obligated to continue to have the sewer line on their property. -They want the sewer line removed, even though it may have been constructed with the consent of the previous property owner. Mr. Neilson said that Mr. Pehl has a right to withdraw his consent and require the removal. Mr. Neilson identified the property as Lot 15 of Auditor's Subdivision No. 88. He said that the problem his client has with the sewer line is that the pipe is only 7.85 feet from the northeast corner of the house. He also has a problem in that he feels that the sewer line will have a negative impact on the future value of the house. An appraiser, Mr. George Johnson of Appraiser Analysts, has estimated that the reduced value is about $24,000. N Memo to File Sewer Line Pehl Property -January 7, 1993 Page Two Virgil Herrick stated that this assessment of potential damage is very speculative. Mr. Neilson said that it would have to be determined in court. He also said he recalls a very unique case in the City of Anoka that occurred two or three years ago. The implication is that the case was settled in favor of the property owner. He implied in his statements that he felt that the property owners would win if this case went to a jury. Mr. Neilson asked what the City had to propose to resolve the matter. I pointed out that in September, 1992, we had proposed that Mr. and Mrs. Pehl be indemnified and that we did not hear from them for several months. We felt that before proceeding, we needed a response to our original proposal. Mr. Neilson responded by saying that Mr. and Mrs. Pehl will not give us the easement requested in my letter dated September 28, 1992. Virgil asked if there were any alternative solutions they would accept, other than removing the sewer line. Mr. Neilson said they would accept moving the sewer line to the pprameter of the property. We ended the meeting by discussing several other potential alternatives. We talked about injecting the line with Insituform, a process that would expand the life of the sewer line indefinitely. We also spoke briefly about the possibility of vacating the line and tying the Holly house either directly to Mississippi Street or the lift station to the south. Ultimately, those present at the meeting on behalf of the City agreed that we would consider the points raised by Mr. and Mrs. Pehl and W. Neilson and contact them. Mr. Neilson agreed to make copies of the abstract of title he had brought and- forward them to Virgil Herrick. We also briefly discussed with Mr. and Mrs. Pehl and Mr. Neilson the possibility of amending the indemnification agreement previously sent to them on September 28, 1992, to include language that would allow them to recover attorney's fees for any legal action they might have to take in order . to enforce the indemnification agreement. If we are required to do anything, it -would be my suggestion that we provide the Pehl's with a hold harmless agreement regarding the sewer line that runs across their property and enhance that agreement by relining the existing 10 -inch corrigated metal pipe with an Insituform liner. Cost.of this liner is estimated at approximately $25,300. If this option would not be acceptable, another possible option is to completely close off the line, and abandon the sewer line through their property. The cost to pump concrete into the lines between the manholes of the line which run through their property would be approximately $2,500. In addition, we would be required to relocate the existing adjoining property (Holly Haus) sewer service which connects to the manhole upstream of the Pehl's property. In this regard we have two options. One option would be to relocate the sewer service to the lift station to the south at a cost of approximately $12,000 or to relocate the service to the Mississippi Street sewer line at a cost of approximately $14,000. Either of these relocations may require an easement as the Holly Haus owner may dictate that the City be responsible for the realignment of the existing sewer line. If the sewer line which runs across the Pehl property was to be abandoned, I see no reason why a hold harmless agreement would be necessary. If the agreement can be agreed to and executed, we can at some point in time, Insituform that section in conjunction with the other portion of that line on a normal schedule as we upgrade the corrugated metal sanitary sewer pipe. To accelerate that section of line with a liner at this time, would not address the more critical section of that line. Again, if the agreement were accepted, we could ensure the Pehl's that this section of line would be incorporated into our sanitary sewer maintenance program, and it would assure the City that we would not be liable for any problems for the next number of years. Option No. 1 is rerouting the existing service line from the Holl -Haus out to Mississippi Street. Included in this option is the abandonment of the existing sewer main that runs through the Pehl property. This existing line would be abandoned and filled with concrete. The estimated cost is $28,000. ...., Option No. 2 is to relocate the existing sewer main from the Pehl property onto the Holi-Haus property and extend it to the Mississippi Street main. This would be an extremely expensive option due to the fact that a minimum 25 -foot deep cut would have to be made for this installation. This option is estimated to be approximately $45,000. The third option is to extend the existing Holl -Haus service from the manhole south to the existing lift station main. This option would cost approximately $32,000 and would entail removing a number of large trees on this property. The fourth option is to Insituform the existing main that runs through the Pehl property and purchase the necessary easements from Pehl. This option is estimated to be approximately $35,000; $20,000 relating to Insituforming the line and an estimated $15,000 for purchase of the necessary easement. Engineering staff has contacted the property owners, the Fishers and the Brickners, regarding obtaining the necessary easements to allow us to relocate the sewer main from the Pehl property. The initial meeting was positive, with the property owners generally appearing to be willing to grant the easements to the City.
