Dear Ms. Shute:
This letter is to confirm the information which was discussed in
our recent meeting at your residence. At that time, we met with
Scott Erickson, Assistant Public Works Director, regarding the
retaining wall located along the west side of your property.
As we indicated to you, this retaining wall is clearly located
within the City right-of-way. Because of its location, you should
be aware that the City will not be responsible for any damage
to this retaining wall as a result of operation of City snowplows
or other City maintenance equipment. In addition, you may be held
responsible for damages occurring to this equipment during its
normal use on street maintenance activities.
Also, as Scott and I stated, this retaining wall is deteriorating
and will likely pose a serious maintenance concern for you and a
potential hazard on the City street in the near future. For this
reason, you must remove or relocate this retaining wall to an
appropriate place on your property by November 1, 1994.

SUBJECT: Retaining Wall at 501 Mississippi Street NE
My understanding is that Steve Barg received a request from the Public Works Maintenance
Department to look at the retaining wall located at 1501 Mississippi Street NE. Steve asked me
to assist in evaluating the hazard potential of the wall.
The wall is approximately 2 - 3 feet high and is constructed of brick and mortar. It was built
directly on top of the existing concrete curbing adjacent to the asphalt street. The retaining wall
is old and deteriorating with mortar spalling throughout the length of the wall.
It appeared that the wall could pose a potential liability for the City and property owner if brick
were to fall into the travel way. A hazard could result if loose brick or brick pieces were in the
street during snowplowing or sweeping. The brick could be thrown by the snowplow, potentially
causing harm to passing pedestrians, parked cars, buildings, etc. This is in addition to any potential
liability the City or property owner may have if a vehicle driving in the travel way were to strike
the wall in its present location or any pieces of the wall that may deteriorate into the travel way.
There is no record of the City approving the construction of the wall in its present location.

On Octobex 20, 1993, staff received a cxenplaint from an employee at the Public
Works Department regarding the retaining wall at the above referenced location.
On October 21, 1993, I inspected this property and observed a retaining wall in
poor condition on top of the curb adjacent to Arthur Street. Subsequently, I
called the property owner and set a meeting involving the two of us and Scott
Erik, Assistant Public Works Director.
On October 26, 1993, Scott and I met with Ms. Shute at her residence. At that
time, staff discussed the liability concerns and addressed the need to remove
or relocate this retaining wall to prevent a serious health and safety problem
in the future. Me information contained in the attached letter to Ms. Shute
prized the details of this meeting which staff believes to have been fully
understood by the property owner at that time.
Approximately once each month (during the non -winter months), staff receives
ccuplaints from the Public Works Dent or area residents involving
landscaping and/or other improvements in boulevard areas. While the City has
not actively pursued removal of all boulevard obstructions, staff has
consistently sought to ensure that liability issues are addressed and health and
safety concerns are protected. When couplaints are received, staff inspects the
site and typically sends the property owner a letter very similar to that
received by Ms. Shute. (Although the City may not h*Rnd to pursue reimbursement
from residents for damages occurring to street maintenance equipanent, staff has
included this language to clearly indicate that property owners should fully
understand the serious nature of constructing such improvements within the City
right -of -ray.) Only the third paragraph requiring removal of the retaining wall
within one year (based on assessment of deterioration and safety concerns as
determined by the Assistant Public Works Director) differentiates this letter
from other letters sent in similar circumstances.
Please let us know if you have questions or wish to further discuss how boulevard
improvement issues are addressed.

RE: First Notice of Noncompliance at 1501 Mississippi Street
Dear Ms. Shule:
The City of Fridley has established a City Code for the purpose of
promoting a pleasant and attractive suburban environment. A recent
inspection of the property at 1501 Mississippi Street revealed that
not all Code requirements are presently being met. Listed below
are items which do not comply with the City Code:
1. Discontinue outside storage of miscellaneous materials
including numerous cement bricks located along the west
property line in the front, side and rear yard.
2. Fridley City Code Section 205.04.04.1 states that no land
shall be altered, and no use shall be permitted that results
in water run-off causing flooding, erosion, or deposits of
minerals on adjacent properties. I observed a large amount of
dirt and other run-off materials from your property being
deposited in the Arthur Street curb and gutter.
Your prompt attention in correcting this situation would greatly
assist us in helping make Fridley a better place to live. An
inspection will be conducted on or.shortly after May 22, 1995, to
determine compliance.

In 1997, the City Council adopted an ordinance declaring gravel driveways a public nuisance.
They were declared a public nuisance for a number of reasons, such as: they can cause
erosion, contaminate soil with oil and other vehicles fluids, and deposit soil and gravel in the
City's storm sewers and detention ponds. When gravel driveways were declared a public
nuisance, the City Council gave property owners five years to have their gravel driveways
paved. The five-year deadline is quickly approaching, which means all gravel driveways within
the City of Fridley must be paved with approved concrete or asphalt by December 31, 2002.
If on December 31, 2002, your driveway hasn't been paved a citation will be issued and filed at
the Anoka County Courthouse. A misdemeanor citation is a criminal offense and is punishable
by up to 90 days in jail and/or a $700 fine.
