NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of
Fridley will meet in the Council Chamber of the City Hall at 7:30 P.M. on
Tuesday, May 12, 1970 to consider the following matter:
A request for a variance of Section 45.053,
4A, to reduce the front yard setback from
35 feet to 32.05 feet to allow the construction
of an addition onto an existing dwelling located

5 FEET TO 4 FEET TO ALLOW THE CONSTRUCTION OF A 17 FOOT ATTACHED GARAGE
ON LOT 3, BLOCK 2, PEARSON'S CRAIGWAY ESTATES 2ND ADDITION, THE SAME
BEING 7872 FIRWOOD WAY N.E., FRIDLEY, MINNESOTA. (REQUEST BY MR. BRUCE

The City Engineer explained that this item has not been heard by the Board of
Appeals. The Board of Appeals changed their meeting night from Wednesday to
Tuesday, and the applicant missed the meeting. The request is to reduce the
sideyard from 5 feet to 4 feet to permit construction of an attached garage.
Mr. John Polymeros, of the Sussel Company, came forward to the Council table
and submitted a letter from Mr. and Mrs. David Kaliher, 7866 Firwood Way
N.E., stating that they,.as adjoining property owners,have no objection.
MOTION by Councilman Sheridan to receive the letter from Mr. and Mrs. David
Kaiiher, 7866 Firwood Way N.E. Seconded by Councilman Liebl. Upon a voice
vote; all voting aye, Mayor Harris Pro tem declared the motion carried.
MOTION by Councilman Liebl to close the Public Hearing on the variance requested
by Mr. Bruce Miller, 7872 Firwood Way N.E. Seconded by Councilman Sheridan.
Upon a voice vote, all voting aye, Mayor Harris Pro tem declared the motion
carried.
MOTION by Councilman Sheridan to grant the variance requested by Mr. Bruce
Miller for a reduction in sideyard from 5 feet to 4 feet. Seconded by Council-
man Liebl. Upon a voice vote, all voting aye, Mayor Harris Pro tem declared
the motion carried.
MOTION,by Councilman Liebl to receive the Minutes of the Board of Appeals
Meeting of May 12, 1970. The motion was seconded and upon a voice vote, all

Councilman Harris said that this project was for the water line in the Great
Northern plat to connect the new well in the southwest corner of the plat.
MOTION by Councilman Sheridan to concur with the recommendation of the
Consulting Engineer.and award the contract for Water Improvement Project #98
to Associated Contracting Company in the amount of $12,900.00. Seconded
'.'.: by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Harris Pro
tem declared the motion carried.
CONSIDERATION OF AMENDMENT TO BY-LAWS OF FIRE DEPARTMENT:
Councilman Harris said that it was not clear just what the changes were and
wondered if they would upset the actuarial survey.
I MOTION by Councilman Sheridan to table to the next regular Meeting for further
details on the proposed changes. The motion was seconded and upon a voice
vote, all voting aye, Mayor Harris Pro tem declared the motion carried.
RECEIVING MEMO FROM CITY ATTORNEY REGARDING SPRING LAKE PARK LAW SUIT.
The City Attorney said that he has tried to meet with Mr. Fleming, but so
far to no avail. He felt that Spring Lake Park will never enter into negotiation
for their percentage of the cost of the storm sewer. A court case would be
very lengthy and expensive, but he felt that this was the only avenue open.
MOTION by Councilman Liebl to proceed through the court system to get relief
from the Village of Spring Lake Park for the water problem created in Fridley.
Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor
Harris Pro tem declared the motion carried.

(REQUEST BY ROBERT D. LEDIN, 1923 LINCOLN STREET, MINNEAPOLIS, MINNESOTA.)
Mr. & Mrs. Robert Ledin were present to present the request.
Plans for the dwelling and the section of the plat showing the lot were
presented to the Board for their review.
Mr. Bagstad came forward and explained to the Board that Heather Hills
Addition is a new plat and this is one of the first dwellings to be built
in it. Therefore, there are no adjoining structures that would have to be
considered.
Mr. Drigans asked Mr. Ledin if they couldn't cut down on the dimensions by
one foot to be in accordance with the City Code.
Mr. Ledin answered that the architect that drew up the plans had originally
drawn the plans to be 2 feet smaller but they felt they would want the
extra room so they had him redraw the plans to include this ---2 extra feet.
The architect had told them he would have to increase or decrease the
dimensions in 2 foot sections as that is how the materials were bought.
Mr. Ledin also stated he had talked to the owner of the adjacent lot and
the owner had stated he did not mind the variance.

Mr. Sondheimer suggested to the applicant a few ways the plans could be changed
to decrease the length of the house by one foot.
Mr. O'Bannon: I will abstain from voting because I have a personal interest
in the area. I developed the property, Heather Hills Addition, and I don't.
like to see a new development coming before this Board no matter who develops
the property. A person who buys a lot, should then build the house to fit
that lot. This is only my .own personal opinion.
Drigans: The lot is an 80 foot lot which I feel has plenty of room to build
on without variances of the City Code.
Sondheimer: I think the plans could be redrawn to decrease the size of the
house by one foot without very much trouble. This would then allow the person
who buys the adjoining lot to have the opportunity to use his whole lot to
build on as he would not be restricted by the one foot encroachment.
MOTION by Sondheimer to close the public hearing.
Seconded by Drigans. Upon a voice vote, O'Bannon abstaining, the motion
carried.
MOTION by Drigans to recommend to the Council, denial of the request for the
following reasons:
1. The area is a new development area and the lots are 80 feet wide which
is quite adequate to build on without variances.
2. Although the architect has already drawn up the plans, the plans can
be redrawn to decrease the dwelling from 66 feet to 65 feet to fit
within the Zoning Codes.
Seconded by Sondhetmer. Upon a voice vote, O'Bannon abstaining, the motion
carried.
3., A REQUEST FOR A VARIANCE OF SECTION 45.053, 4A, TO REDUCE THE FRONT YARD
SETBACK FROM 35 FEET TO 32.05 FEET TO ALLOW THE CONSTRUCTION OF AN ADDITION
Mrs. Helen Shute was present to present the request.
Mr. Bagstad explained that the addition is proposed for the Northeast corner
of the house. The whole house is nonconforming as it was built quite a few
years ago and sits back only 23.6 feet from Mississippi Street and only 6.5
feet from Arthur Street. The proposed addition will be setback 32 feet
from Mississippi Street.
Mrs. Shute stated she would hike the addition as it would extend her kitchen
out 7 feet d allow room for a bathroom to be built on the ground floor. Her
elderly paree#ts are living with her and this would be very helpful to them
to have the t}athroofn where they wouldn't have to walk up any stairs.

Mr. Sondheimer asked if she had any plans drawn up of the proposed addition.
Mrs. Shute answered the architect did not want to draw up any until the
variance was approved.
Mr. O'Bannon stated it would be an improvement to the home as this is an
older home and there is plenty of room between the addition and the adjoining
structures.
MOTION by Sondheimer to close the public hearing.
Seconded by O'Bannon. Upon a voice vote, there being no nays, the motion
carried unanimously.
MOTION by O'Bannon to recommend to the City Council approval of the request
for the following reasons:
1. There is plenty of available room to the East of the existing home and
no part of the proposed structure would be closer to the street than
the existing structure.
2. It would be an improvement to the home and it would be a considerable
help to Mrs. Shute to have the bathroom on the first floor, for the
convenience of her elderly parents.
Seconded by Drigans. Upon a voice vote, there being no nays, the motion
carried unanimously.
