SUBJECT: Blaine & Lorne Kopischke - 6830 Monroe Street
On May 8, 1997 I sent a letter to the Kopischkes outlining previous correspondence on the problem of
stormwater runoff into their driveway, and asking them to contact me so that we could come to an
agreement on how to fix it.
On June 27 at 5:00 pm, I met with the Kopischkes at their home to discuss solutions to the above
problem. Nancy Jorgenson and Jim Johnson, a civil engineer from Bolton & Menk were also present.
A solution was arrived at in which the city would install a drain on each side of the driveway and pipe the
water across the yard and to the nearest catch basin in the street. In addition, the driveway would have a
raised area at the curb to keep water on the street and there would be some grading and sod on the south
side of the driveway to fill in a low spot. Mr. Johnson agreed that this was a viable solution. Mr.
Kopischke wanted some time to think it over and on July 14 called to tell me to create a drawing of our
plan.
On September 11, I delivered a sketch of the underground drain to the Kopischke residence for their
review. I told them that the City was still willing to do this work this fall if the plan was acceptable. I
had not received any response from them until Friday October 24 when Mr. Kopischke called to state he
was unsatisfied and would be attending the October 27 City Council meeting.

On Thursday, October 30, 1997, at 4:30 pm Blaine Kopischke met with Mayor Jorgenson and Jon Haukaas
to address the surface water runoff on his property.
At the meeting, they reviewed the original proposal to construct a couple of catch basins on his property.
In addition, we also suggested an alternative to place a catch basin upstream of his driveway which would
collect the surface water prior to his property and also to depress the curb flow line across his property to
provide for additional height to maintain the surface water runoff within the gutter line. As a result of these
discussions, Mr. Kopischke appeared to support the catch basin and gutter modification on Monroe Street.
He also requested that the City replace his driveway to remove the low spot that currently exists.
It was explained to him that the asphalt did not have the tolerance controls to ensure that a low spot could
be removed. Mr. Kopischke requested a concrete driveway, our response was that if he agreed to pay the
difference in price between concrete and asphalt, we could certainly do that.
Mr. Kopischke was given until Tuesday, November 4, 1997, to agree on a solution as any concrete work
would have to be done relatively soon because of the temperature drop.
We are currently awaiting Mr. Kopischke's decision. If received, we will initiate the work as soon as
possible and obtain an agreement from any claims on the work.

On Thursday, October 30, 1997, at 4:30 PM I met with Blaine Kopischke to review some options to solve the
storm water runoff problems at his residence. Mayor Jorgenson also attended this meeting.
At this meeting we discussed previous proposed solutions and our latest idea of installing a catch basin in the street
to the south of his driveway. This new basin would intercept the majority of street runoff flowing past his property.
In addition, the gutter flow line would be lowered between the new basin and the existing basin north of his
property to improve drainage of his driveway. Mr. Kopischke's driveway would also be resurfaced with the
understanding that the extremely tight elevation control proposed to guarantee drainage was nearly impossible with
asphalt. Mr. Kopischke suggested using concrete and we said that was possible if he was to pay the difference in
the cost of concrete over asphalt.
Mayor Jorgenson asked for a reply by Tuesday, November 4, so that work could still be completed before the
weather prohibited construction.
On Friday, October 31, I faxed a number of sketches to Mr. Kopischke detailing the proposed construction and
restoration. We then set a meeting for 4:00 PM that day to finalize plans. During this meeting we came to an
agreement on how to proceed. I presented Mr. Kopischke with an agreement letter from John Flora which stated
that our plan was acceptable and there would be no further claims against the City. I explained that this agreement
must be signed and returned to the City before any construction began. I also explained that we would still be able
to do this construction this year if the agreement was returned before the weather prohibited construction. Mr.
Kopischke took the agreement home to consider it over the weekend.

addition, the City will repave your asphalt driveway to the drawing.
The City understands that upon completion of this work, there will be no further claims to or against the City
regarding the surface water flows.
Request you sign the agreement below and return this letter to the City so that we may initiate the project as soon
as possible.

At a meeting with Mr. Blaine Kopischke at the Municipal Center on Friday, October 31, 1997, Jon Haukaas
explained our option of placing a catch basin in the street gutter line upstream of the Kopischke property
to collect the surface water flows. In this process we will be able to depress the gutter flow line in front of
his driveway thereby increasing the depth of the gutter in front of for his driveway and attempt to prevent
water from flowing onto his property. He further explained that while we agreed to replace his asphalt
driveway to eliminate back flow on the driveway, that there was only an 0.08 of a foot drop in 40 feet and
this tolerance would be difficult to achieve with an asphalt paver.
On Tuesday, November 4, 1997, Mr. Kopischke agreed to the solution of the catch basin as well as repaving
his asphalt driveway to attempt to contain the surface water flow to the street and in the storm water gutter
line. In Mr. Kopischke's approval, he also agreed to waive any future claims against the City as a result of
storm water flow on his property.
As a result of Mr. Kopischke's agreement, we initiated work on Tuesday afternoon, November 4, 1997, to
remove the curb and install the catch basin. Our goal is to have the concrete placed and the driveway paved
before the weather changes and asphalt plants close for this year.

As a result of Mr. Kopischke coming to the Council with his problem regarding the backflow of street water
onto his driveway, we did achieve an agreement with him to install a catch basin downstream of his property
and realigning the curb and gutter in an attempt to reduce the surface water runoff onto his property. We
also agreed that we would repave his driveway from his fence to the street.
As a result of the cold weather conditions, we were only able to complete the catch basin and concrete curb
and gutter installation. We were unable to repave the driveway as the asphalt plants have closed for the
season.
We have informed Mr. Kopischke and will schedule the driveway repaving for the first part of spring 1998
when the asphalt plants reopen.
