In the zoning district where you live, home occupations are permitted as an accessory use, provided certain criteria are met. One of the key requirements (City Code copy enclosed) in defining an acceptable home occupation is as follows: 1. No over-the-counter retail sales are involved. The information which I received suggested that the home occupation you may be conducting is in violation of this provision. If you are operating a business out of your home which is not fully in compliance with our home occupation definition, please discontinue this practice immediately. Dear Mr. Kilgore: On October 18, 1989, I sent you a letter regarding code violations at the above -referenced address. Shortly thereafter you contacted me by telephone and we discussed what was needed to bring the property into full compliance with City Code. On November 13, 1989, I reinspected this site and observed the following violations: 1. Vehicle (834 -EGA) parked on grass in side yard. Fridley City Code requires that all vehicles must be kept on a hard surface parking area or in an enclosed structure. 2. Outside storage of materials beside storage shed at southeast corner of property. 3. Vehicle without appropriate current license displayed and not in street operable condition. (The only plate observed near the car registers to another vehicle. In addition, while City Code permits storage of a single inoperable vehicle with current registration provided it is in the reasonable process of restoration to an operable vehicle, the time allotted for such restoration is not indefinite. I have made numerous unsuccessful attempts to contact you at home since this second inspection. These violations need to be corrected as soon as possible. Dear Mr. Henry: Recently, you contacted the City to express concern regarding the various code issues at the above referenced property. I conducted an initial inspection of this site, discussed the matter with Councilmember Steve Billings, and performed followup inspections. I would like to provide the following written response to address your concerns. 1. Display/sale of items - You expressed concern regarding the display and sale of assorted items in and adjacent to the driveway area. I met with the property owner in early September and discussed the details of her upcoming sale. At that time, I informed the property owner that although the Fridley Zoning Code does not specifically limit the number or duration of garage sales, the City has consistently maintained that there is a point at which such activity constitutes an illegal home occupation. The property owner stated that she had recently purchased another home and the upcoming sale would last approximately two weeks and would include only those items which had belonged to this residence. I discussed this matter with Councilmember Billings, and we agreed that her planned sale would not constitute a violation of the home occupation requirements. To the best of my knowledge, the sale began during the third week in September and was completed within approximately two weeks as we discussed. 2. Storage of solid waste containers - You indicated that there were numerous garbage cans stored along the side of the garage, and you expressed dissatisfaction with the appearance that this created. While meeting with the property owner, I checked on this matter and observed Don Henry October 20, 1993 Page 2 eight fully secured solid waste containers in the side yard. While this may seem to be a high number of solid waste containers for an individual residence, each container met acceptable quality standards, and the City Code does not set a limit on the number of containers which a resident may maintain on his/her property. 3. Siding business - You indicated that this property owner operates a siding business called "Exterior Design Service" from this residence. The Fridley City Code does permit home occupations, provided certain criteria are met. (I have enclosed a copy of the home occupation requirements for your review.) From speaking with the property owner, it is my understanding that the only business activity which occurs at the residence is that calls are received from this location. Provided that all other criteria are met (no outside employees, no stock in trade stored outside the dwelling unit, etc.), this would not constitute a violation of the home occupation section. Upon my inspection, I did not observe any conditions which would constitute noncompliance. However, please let me know if you have further information or observe conditions which would indicate that the home occupation section is being violated in some way.
