Fridley, MN 55432 June 6, 1995 SUBJECT: SHODDY MATERIALS/WORKMANSHIP OF LANDSCAPING To Whom It May Concern: In the timeframe from approximately September/October 1993, a contractor hired by the City of Fridley to backfill and sod the area adjacent to the new curb and asphalt, I believe, did a substandard job. Prior to the street widening/upgrading was done, we had our front yard landscaped by a professional landscaper in 1991, which allowed drainage away from the home toward the gutter. When the Fridley contractor was finished, there was a ditch adjacent to the curbing where water pooled. I might add that this whole project was to have been completed in the Spring of 1993. As it stands, it was completed in the Fall of 1993. I called in the Spring of 1994 and talked to Scott Erickson, who told me he would look into it. After his inspection, a crew showed up and threw down something that resembled black dirt. It was full of sticks and rocks about the size of a fist. Then approximately two weeks later, another person arrived and threw grass seed down. About three or four days later, we experienced a heavy rain. As a result, very little grass grew. I called the City again. Later in the summer, Scott told me that sod was too costly, so they would try seeding again. At that point, I was frustrated and figured I would wait until Spring 1995 to try to get some action. I called approximately two weeks ago and talked to John Thompson. I indicated to John there was dead grass in the boulevard area along Monroe Street (which was a result of the shoddy materials (peat sod) and workmanship of the contractor). I also indicated to John to drive down Monroe and see the damage. John called back and said he had done that. It was "winter kill", which several homes in Fridley experienced this past winter. I find it rather strange that the boulevard along Brookview Terrace, which was done when Monroe was, experienced hardly any "winter kill". I also find it rather strange that when Rice Creek Terrace was done a couple of years ago, there was very little "winter kill". It puzzles me why Monroe seemed to be so unfortunate. At any rate, John told me there was nothing that could be done since the warranty had expired. This upset me and my wife enough that we asked the landscaper who originally did the landscaping for us in 1991 to return and give us an estimate to allow for the correct slope for drainage. He complied and redid the boulevard area. Page 2 June 6, 1995 Had we realized this shoddy workmanship/materials would be costing us more money personally, in addition to being assessed for the work done, perhaps the landscaping we had originally contracted to be done, would have waited. My wife and I have lived and raised our children in Fridley for over 25 years. I find it hard to believe that the City of Fridley would let such workmanship happen. I would like to believe there is more City pride than that! We not only endured this project being less than quality work, we also endured the wedding guests from our daughter's wedding in September 1993 having to put up with the mess when they were at our home. I am enclosing a before and after set of photos of the yard as well as the bill for the work completed by the landscaper. We feel that for the amount we are being assessed for the street upgrade, our drainage and landscaping should be returned to the original condition before the street was widened and elevated. Please keep us informed as to the dispensation of this claim. I would like to get this cleared up as soon as possible. Payment of this bill would need to be directed to the landscaping company stated on the bill.
