As you are aware, we did have sound leakage thru the first floor party walls at the junction of the common base board heating units and the wall and thru the electrical outlets in the party walls of Black Forest. To correct the leakage problem in these areas, we have packed Dura - Gum Bulk Sealer around the heating pipes and electrical outlets in all the first floor party walls. The common heating pipes do not occur on the second and third floors, but for insurance extra fiber- glass insulation will be placed around electrical, phone and TV outlets in all of the party walls that have not been sheetrocked on these floors. Construction details, as furnished by Mr. Lars Anderson, consisted of the followinf: 2" X 10" wood floor joists 16" o.c. - j" plywood subfloor - 2" particle board - 2" foam pad I heavy carpet. The ceiling portion consisted of full thick (321") fiberglass insulation in joist spaces - 5/8" sheet- - rock.on RGl channel. Ceiling finished in normal construction manner. Test Procedure - The test procedure was patterned after ASTM E-90-70. - - The sound generating equipment was located in the bedroom of Apt. 107 with two speakers pointed at the ceiling at about a 75° angle. Sound level readings were taken simultaneously at 1/3 octave bands by use of B ixel & Kjaer precision sound level meters. Decay curves were taken in the termination bedroom of Apt. 207 so as to determinetotal room absorption. Mr. Herlay said the roadway is not plowed and when he requested it from New Brighton they said they did not plow because there are no New brighton residents using that roadway. He said he would like the City of Fridley to _do it if possible. If not, he will check into the possibility of paying the City of Fridley for doing it. I think on both of these questions, there might be some legal question of us going outside the municipal boundaries and doing this work. I would like you to check into the agreement we have with Darrel Farr (Viewcon) about this roadway. My recollection was that it was the responsibility of Darrel Farr Corporation to maintain this roadway for a number of years. Please check into it and advise this gentleman appropriately, and advise me of the action taken. Thank you for your assistance. Mr. Herlay also indicated the roadway was being plowed by Darrel Farr Corporation, however, the main problem seems to be removal of ice build-up that has occurred on the roadway. I indicated the maintenance of the road was the responsibility of the Darrel Farr Corp. and he agreed and said he would contact the Corporation and try to clear up the problem. The agreement we have on file does state maintenance is to be by the Darrel Farr Corp. COUNCIL MEETING OF JULY 26 , 1982 PAGE 4 ^Councilman Fitzpatrick stated he can sympathize with Mrs. Anderson's objection to having this building close to the property line, however, he would have to concur with the recommendation .of the Appeals Commission. MOTION by Councilman Fitzpatrick to concur with the recommendation of the Appeals commission to grant a variance to reduce the side yard setback for an attached garage from the required five feet to three feet to allow construction of a 22 x 38 foot attached garage with the stipulation that the north wall be a firewall with 5/8 inch type x gypsum board and that any windows in the north wall be fire safe steel mesh windows. Seconded by Councilman Schneider. Counc]man Barnette stated he grew up in Minneapolis where the houses were close together and doesn't remember any problems with drainage. Mrs. Anderson stated the overhang would be right on top of her fence. Mr. Flora stated the overhang will be 1-1/2 feet inside the property line. Councilman Schneider asked if Mr. Kishish's contractor indicated any problem with the fencer 'and Mr. Rishish stated he hadn't noted any problems. Councilman Hamernik suggested possibly adding a stipulation that this addition wouldn't disrupt any drainage flow that is currently existing. Mr. Rishish stated this would be satisfactory if they can establish what is currently existing. He stated he has never seen water came to the back of his house. Councilman Barnette asked if he ever had water in his basement. Mr. Rishish stated he has because of a cracked foundation, which he hopes to correct, but there was no water in the basement because of the manner in which the water drains. UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee declared the motion carried unanimously. The Council received the minutes of the Planning Commission Meting of July 14, 1982. 3 CWSMERATION OF AN AGREEMENT WITH DARNEL A. FARR DEVEUOPMENT CORPORATION FOR BLACK FORREST APARTMENTS: 6� / Mr. Qureshi, City Manager, stated the development agreement provided by the Darrel Farr Corporation indicates they had a mortgage cc mii.tment prior to the effective date of the City's ordinance regarding a moratorium on condominium conversions. Mr. Qureshi stated the staff, with the help of Councilman Schneider, worked with the Farr Corporation to work out certain conditions which gave additional consideration to the existing renters. Councilman Schneider stated that State law on condominium conversions preempts the City's authority and, as the development agreement indicates, Farr Corporation had obtained a mortgage commitment prior to the effective date of the City's ordinance. Mr. Flora stated, during discussions, it was found there was too much square footage on the property and, therefore, the petitioner will remove part of the existing garage, leaving a 12 x 14 foot storage shed for the property. Mr. Flora stated one neighbor objected to this variance, as she felt the roof would be too close to the property line, and result in a devaluation of her property. Mr. Flora stated the Appeals Commission has recommended approval of the variance with the stipulation that the north wall be a firewall with 5/8 inch type x gypsum board and any windows on the north wall be fire safe steel mesh. Councilman Fitzpatrick stated the Appeals Commission unanimously recommended approval of this variance in spite of the objection of the affected neighbor. He pointed out the variance is only for two feet and is prepared to recommendation. Councilman Fitzpatrick stated he believed the person who objected, and the petitioner, were both present his evening. Mrs. Harold Anderson, 5342 Altura Road, stated she felt the roof lines would be too close together. She further stated there would be a problem with the snow and a lot of moisture in the basement. Mr. Fora stated the plans indicate a roof overhang of 18 inches beyond the wall. Mr. Rishish stated the roof line follows the existing line so he felt any _snow would either go forward or back and wouldn't build up between the houses. Councilman Barnette asked Mrs. Anderson if she had problems with drainage. Mrs. Anderson stated she had not, but guessed others had problems, and was sure the houses would be too close and would cause water in the basement. Councilman Barnette stated he felt the drainage could be taken care of so water wouldn't drain towards Mrs. Anderson's house. Mr. Rishish stated the natural drainage pattern now tends to be to the back of the lot. Mr. Nee stated, overall, this looks like a good improvement and this addition could be built, without a variance, if it was two feet shorter. Mrs. Anderson stated she was aware of this, but two feet was two feet. She stated she felt the improvement was an advantage for Mr. Rishish, but not for them. V , COUNCIL MEETING OF JULY 26, 1982 PAGE 5 Councilman Schneider stated he felt the conditions worked out with the Farr Corporation have minimized the adverse effects of this conversion for the tenants. He stated Farr Corporation is willing to enter into a formal legal agreement to assure these conditions. MOTION by Councilman Schneider to authorize the City administration to enter into the development agreement with Darrel Farr Corporation. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the moton carried unanimously. Mayor Nee stated he felt both the staff and the Farr Corporation deserve some congratulations for working out these conditions to accommodate the tenants. As you indicated, I did look at one roof vent installation, at the request of Vicky Robertson, on December 11, 1992. At that time I informed Ms. Robertson that the roof vent I saw appeared to meet the Code requirements. Also, on December 17, 1992, I met with Mr. McFarland at the site and although we couldn't• get on the roof because of snow, I repeated to him that the roof vent I viewed appeared to meet the Code. He asked if I could give him an inspection report. At this request I informed him that no permit had been issued nor in my opinion was one needed, nor could I give an inspection report if the work was not done under a permit. I did suggest to Mr. McFarland however that if he needed further inspections and or written reports on this work, that he should contact a consultant.
