Re: Bath Tub Drain Leak
Dear Ms. Richardson:
The purpose of this correspondence is to document pertinent dates and
recent observations with reference to the above problem.
The building permit was issued for the structure in May of 1972.
The plumbing final was made on the 7th of June, 1973.
On Friday, August 26, 1977, the City Plumbing Inspector was notified of a
possible problem with the tub drain. On August 30, 1977, Mr. Sandin, the
Plumbing Inspector, and I made a field inspection.of the premises and
observed apparent water damage to the dining room ceiling and found that
the gasket on the tub overflow was not sealed against the tub. It was
also determined that the tub drain was leaking at one of its connections.
These are the cause of the water leaking down into the room located below.
The City has no way of determining when the leak started, therefore we
can not order the plumber to correct the faulty drain.
It is our hope and desire that you and your builder can work out the
solution to your problem.

Innsbruck Townhome Roof Repair
I have reviewed Monica Weinert's.letter of November 8, 1993, with
Tom Blazina. We are not aware of the circumstances around the
cancelled contract between Gittleman Construction and the
Homeowners' Association. Tom had worked extensively with Gittleman
regarding code requirements for the roof repair. It was Tom's
understanding that Gittleman was agreeable: and cooperative to
install the new roofs in compliance with the code.
The roof repair needed on the buildings is extensive. Repairs have
occurred over the years by different contractors and, in some
cases, without the appropriate permits (see attached memo dated
September 13, 1993).

SUBJECT: Innsbruck Townhome Association Roof Repairs
The Innsbruck Townhome Association has advised its residents of the
need to re -roof five of eight four-plex buildings. Upon submission
of building permit applications, the contractor arranged for a
meeting with the Building Official and a roofing products
distributor to review the problems and provide long term solutions.
Field review of the roofs revealed problems such. as flashing, loose
seams, improper fastening methods, product deterioration, improper
penetrations, installation compatibility problems with adjacent
roofing materials, and more.
Review of our card address file, the construction documents
submitted for the original building permit and discussions with
individual owners revealed that all of the roofs have been re -
roofed without the benefit of a building permit, inspections, and
concern for compatibility with adjacent roofing materials.
Only eight of the four-plexes on East Bavarian Drive have roof
slopes of 2 -in -12 or less. Units further south of the proposed re -
roof four-plexes are constructed with 4 -in -12 slopes, which greatly
enhances the design performance of the four-plexes.
Tom Blazina is working with the roofing contractor and Mel
Gittleman, who represents the management company hired by the
Homeowner's Association. Tom has taken photographs of the roofing
problems/conditions for future verification.
This is brought to the City Council's attention for information
purposes only.

I reside at the Innsbruck North Townhomes in Fridley where the
townhome association has dictated and assessed a rigorous
repair/repainting project of the whole townhome area which began
this fall. Due to the circumstance that the current management
company - Gittleman Construction/Management Services - has
prematurely terminated its contract with the Innsbruck North
Townhome Association, the residences have no written assurances
that the work started this fall will be completed next spring.,
1994.
I am enclosing a copy of a letter that I am sending to the
Innsbruck North Townhome Association Board of Directors and to
Melvin C. Gittleman of Gittleman Construction/Management Services
outlining the work and related issues that have yet to be resolved
regarding this large project.and to apprise you of this situation
that has come up in a large development in the City of Fridley.

I am writing to inform you that due to the recent, unexpected
termination of agreement by the management company, Gittleman
Construction/Management Services, hired by the Innsbruck North
Townhome Association, I will not be making the second half of my
special assessment payment for repairs/painting on my townhome
unit. I made the first half of my special assessment payment on
October 9, 1993 in..the amount of $1,252.84 in good faith that the
scheduled repairs/painting on my townhome would be completed.
Since these repairs/painting will not be completed by the November
15, 1993.=due date, for the second half_. of, the special assessment
payment and are supposedly to be carried over into Spring, 1994,
and since the management company, Gittleman Construction/Management
Services, who oversaw the origination of these repairs/ painting,
will not be around to complete the task they started, I have no
written assurances that the repair/painting work will be completed
next year. The work yet to be completed is as follows:
1. Renailing was not done as is plainly visible in my courtyard
area.
2. I have paint shading/runoff on my townhome unit and garage
which is indicative of the fact that the paint was applied too
late in the season and that it rained right after it was
applied.
3. My front step platform off of my sliding glass door was not
painted.
4. I have a second story window painted shut (facing Innsbruck
Parkway) which I cannot free and cannot get to since I do not
have a ladder that will reach (and neither does Innsbruck
North Townhome Association).
5. I have paint splatters along the sides of my new screen door
in the courtyard.

6. My courtyard gutters are already peeling. I feel that I
should have been given some advance notice of the intended
painting date so that I would have been able to prepare those
surfaces by sanding.
7. My brand new garage service door needs to be repainted.
Mittelstaedt Painting painted the service door while it was
shut leaving a nice white border all around the new door.
Again, had I been given some advance notice of the intended
painting date, I could have made arrangements to be home so as
to unlock the service door.
8. The front door on my townhome unit, which is in the courtyard
area, has yet to be painted. _.
9. The window well areas need painting, since it is obvious they
were painted during the last painting and I have a distinct
line where the new and old paint end and begin.
10. Parts of the bottom of my fence in the courtyard were •not
painted.
11. Wherever caulking was done, the paint is cracking and the
white caulk is showing through.
12. All my windows need to be repainted to get the edges. Again,
had I been given some advance notice of the intended painting
date, I could have made arrangements to be home so as to open
the windows for painting.
13. My courtyard gate is not completely painted.
In addition to the work yet to be completed, the following issues
have yet to be resolved:
1. The cost of painting a middle townhome unit vs. painting an
end townhome unit. My townhome is a middle unit, it has less
exterior square footage, and should not cost the same to paint
as an end unit; particularly, since the end units have paid
more for painting in the past.
2. Materials/labor of repairs shared by myself and my neighboring
townhome unit (1543 North Oberlin Circle) were done by another
contracting firm hired by the 1543 North Oberlin Circle
townhome unit owner. We were both charged, again (double
charged), by Gittleman Construction/Management Services for
repairs they did not make.

3. I am still waiting for a logical explanation as to why my
other neighboring unit (1551 North.Oberlin Circle), who had at
least twice the amount of work done on their townhome unit as
I did, was charged about the same for labor as I was. I was
charged 32 hours and they were charged 34 hours. (Reference
the October 1, 1993 invoice from Gittleman Construction
Corporation for carpenter work and bid proposals from
Mittelstaedt Painting Co. information sent to myself with
copies to Toni DeMuse, President, Board of Directors,
Innsbruck North Townhome Association.) I also have
photographs of the work done on my townhouse unit vs. the work
done on my other neighboring townhouse unit (1543 North
Oberlin Circle) who had more work done than I did and is being
billed at least half the amount of labor hours by the
contracting firm they hired than I am. In addition to the
fact that townhome units, whose garages are opposite mine, who
had approximately the same amount of repairs done are paying
for 19 hours of labor. I feel that I have been overcharged
for labor when one compares the amount of repair work I had
done with the amount of similar -work others have had done to
the amount of labor hours I have been charged.
4. I was refused a written estimate by Gittleman
Construction/Management Services_ for the repairs/painting
before the work was begun. It is the mere nature of the
construction/contracting industry that estimates are provided
to clients prior to any- work commencing. Once the client
agrees to the work to be done by basing a decision on the
written estimate and it is becoming 4pparent that as the work
is progressing the work is going beyond the scope of the
estimate, work is :stopped and the scope of the estimate is
revisited. As mentioned above, I was refused this right of a
written estimate; and, the only information I ever received
was a final bill in the mail.
Please also consider this letter as a written request for a meeting
with myself and the Innsbruck North Townhome Association Board of
Directors to discuss the above-mentioned unresolved issues. I can
be reached at work at 574-4447. I also expect a written response
to this letter, sent to me, within ten working days of receipt of
