Approval of this rezoning is contingent upon the following stipulations: 1. The final landscape plan shall meet code requirements for number of and sizes of plantings and be reviewed and approved by City staff prior to Issuance of a building permit. 2. A landscape plan for the ponding area, in lieu of fencing, to be reviewed and approved by City staff prior to issuance of a building permit. 3. A storm pond maintenance agreement shall be filed with the City prior to Issuance of a building permit. 4. All landscaped areas shall have irrigation installed. 5. The proposed walkway shall be concrete. 6. Brick type and application on elevations and other external building materials to be reviewed and approved by City staff prior to issuance of a building permit. 7. A grading and drainage plan shall be submitted and approved by the City's engineering staff prior to issuance of a building permit. 8. The sewer connection shall be located near cul-de-sac. 9. Six inch watermain to the looped according to City engineering staffs specifications. 10. A 12 foot utility and drainage easement shall be granted along the entire southern edge of the property prior to final plat. 11. A 25 foot easement from the centerline of Norton Creek on the west side of the property shall be granted prior to final plat. 12. The parking lot shall be constructed to code standards. The petitioner shall pay applicable"park dedication fee of $1,500 per unit prior to the issuance of any building permits. 15. The fire turn around shall be re -designed to meet the City's Fire Department standards. 16. The driveway and fire turn around shall be designed to 9 ton standards. 17. The fire turn around shall be posted, "No Parking Fire Lane". 18. The size of the landscape islands shall be reduced by 5 feet in order to accommodate fire equipment. 19. The petitioner shall meet all Rice Creek Watershed District requirements prior to issuance of a building permit. 20. Provide proof that any existing wells or individual sewage treatment systems located on the site are properly capped or removed. 21. A Development Agreement outlining the Developer's obligation to install utilities, etc., will be prepared by the City and shall be signed by the Petitioner, prior to final plat approval. Narrative describing and supporting reasons for change. Items are required to be submitted in three (3) full-size copies, with one (1) 8'/" x 11" reduction. The City reserves the right, based on a case by case analysis, to waive any of the above requirements. REZONING PROCESS se: A rezoning request allows a property owner or the City to change the zoning designation on property located within the City's boundaries. Changing the zoning designation changes the permitted, accessory, and special uses allowed on property. A zoning text amendment changes the language within one or several zoning districts, changing the performance standards for uses. The Rezoning process begins by filling out a REZONING APPLICATION. This, with a site plan, and other appropriate drawings, must be submitted to the Planning staff. A fee is required with the application; $500 for all applications. Fees are non-refundable and are used for postage, publication of notices, and other expenses associated with the request. Once the application is received, the application is reviewed by staff from the Planning, Engineering, Assessing, Fire, and Police Departments. The impacts to adjacent properties are discussed, and stipulations are developed for recommendation to the City Council. Simultaneously, a mailing list of all properties within a 350 foot radius.of the property is generated. Notices of the request are sent to these property owners. There is approximately four weeks between the application due date and the Planning Commission meeting. Prior to the meeting of the Planning Commission, a staff report is written, and the petitioner called regarding the staff recommendation. The Planning Commission is made up of seven residents of the community. - The meetings are held the first and third Wednesdays of the month at 7:30 pm in the Council Chambers in the Municipal Center. The Planning Commission is an advisory commission to the City Council. It is the responsibility of the Planning Commission to conduct a public hearing, gather testimony and make a recommendation to the City Council regarding all rezoning requests. The City Council will conduct a separate hearing for all rezoning requests. The notice for the Planning Commission Public Hearing will include the date of the City Council Public Hearing.
