be double garages. In many instances with an older home with a single attached
garage, the home owner is forced to rebuild to gain a double garage. The City
Engineer pointed out that before passage of the Zoning Ordinance, there was no
requirement for an attached garage so this is a big jump for the City.
Mayor Kirkham commented that there is no way of adding onto his garage to make
it a double, and he wished that it had been a requirement when his house was
built.
MOTION by Councilman Harris to receive the information from the City Engineer
and instruct that it be put back on the Agenda at the next Regular Meeting.
Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.
CONSIDERATION OF VACATION OF CERTAIN RIGHT OF WAY ALONG T.H. #47 EAST SERVICE
ROAD TO FACILITATE ACQUISITION OF RIGHT OF WAY FOR SERVICE ROAD LOOPEACKS AT
61ST AVENUE AND 57TH AVENUE. INTERSECTION WITH T.H. #47 AND SETTING THE
PUBLIC HEARING DATE:
MOTION by Councilman Liebl to set the Public Hearing for the vacation of
property for the loopbacks for February 8, 1971. Seconded by Councilman
Kelshaw. Upon a voice vote, all voting aye, Mayor Kirkham declared the
motion carried unanimously.
CONSIDERATION OF ACQUISITION OF ACCESS EASEMENT TO 1152 NORTON AVENUE:
The City Engineer explained that there are two homes using a common driveway.
The necessity for an access easement comes about because of a neighborhood
fued. Mr. Louis Gray is asking $150 for the easement.
MOTION by Councilman Liebl to authorize acquisition of the easement from
Mr. Louis Gray for $150.00. Seconded by Councilman Kelshaw. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
RESOLUTION #10-1971 - A RESOLUTION ORDERING.PRELIMINARY PLANS, SPECIFICATIONS
AND ESTIMATES OF THE COSTS THEREOF: REPAIR, REJUVENATION AND IMPROVEMENT OF
OCKE LAKE DAM:
The City Engineer said that he has already made a report to the Council in
regard to the improvement of Locke Lake Dam. It will take $5200 for the
immediate necessary repairs; another $15,000 for rejuvenation and $52,000 for
totally rebuilding the dam. He questioned how the Council would handle the
funding. Should it be assessed, and if so, how much?
The City Attorney said that the people on the lake would be benefitting from
the rejuvenation of the dam and should be assessed. Councilman Liebl said that
he did not feel that the reconstruction should come out of general funds except
for the $5200 for the repair work, as that is necessary maintenance. Mayor
Kirkham said that the whole City does benefit from the lake, but the lions
share of the benefit is with the people living on the lake.
The City Engineer said that the $5200 is immediately necessary as preventive
maintenance. Whether to put in the improvement at $15,000 or $52,000 would be
the people's choice, but he would have to recommend the $15,000 job as the other
is very expensive.

Councilman Harris said that this dam has been there for many years. The
people pay an additional amount in taxes for having lakeshore property and they
would not like to lose it. Councilman Breider felt that the $15,000 or $52,000
would have to be assessed, but the $5200 would be considered maintenance and
paid by City funds. He added that it could be considered the same as a street.
The maintenance funds come from the City, but the improvement is assessed.
Mayor Kirkham asked if there is $5200 available. The Acting City Manager said
that there is no specific money provided, but there is the emergency fund. He
added that if the dam is completely redone, it would be handled like any other
improvement project.
MOTION by Councilman Harris to adopt Resolution #10-1971 and further authorize
$5200 fol, the repair to be borne by general City maintenance funds. The City
will hold the Public Hearing and make it known to the people that the maintenance
will not be yearly, but only once, and the further rejuvenation will be assessed.
The motion was seconded and upon a voipe vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.
The City Engineer pointed out that the future problems will be increasing
because of the increased flow of water as the area upstream develops.

A PUBLIC HEARING ON THE MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVEMENTS:

from the City for the purchase of the easement, but that
sometime last Summer one of the City officials or employees
had indicated to the people living to the west of Mr. Gray
that they could drive over a certain portion of his lawn, which
they did.
Mr. Gray thereafter complained to the City about this and
nothing was done and the people continued driving over the
northwestern part of his property at an angle. He indicates
that damage done was in the amount of $50.00 and, therefore,
he is requesting the sum of $150.00.
I feel a bit embarrassed writing this letter and indicated to
him that it would be so for me to do this, but he will not
sign the deed until he is assured that he will receive $150.00.
I might add that no part of the award is to be taken by me
for attorney's fees.

In reference to your letter of December 11th, 1970 I have prepared
a Quit Claim Deed for easement, a copy of which I am enclosing,
and had forwarded to the Grays' attorney, Mr. Barna, for signature.
The Grays are the Contract Purchasers and the Laboes are the Fee
Owners so they would all have to join in the Deed.
I would appreciate your checking the legal description to make
sure the City does obtain the 10 foot easement needed to provide
access.
Enclosed you will find Mr. Barna's letter indicating his clients
are insisting on $150.00 indicating that $50.00 of the amount they
want is for some damage done to their property.
Because of the nature of the problem and the expense of going through
Condemnation to resolve the problem it is my recommendation that the
City do pay $150.00 for acquisition of the easement to provide access
to 1152 Norton Avenue N.E.
In the event the City would improve the easement then I believe
the cost should be accessed against 1152 Norton Avenue since I do
not believe they have previously been accessed for any street improve-
ments.
Please advise whether or not the legal description is correct and,
further, whether the City will pay the $150.00 and I will then ask
Mr. Barna to proceed to have the Quit Claim Deed executed.

On August 17, 1988, it was confirmed by an on-site inspection that the
property at 1152 Norton Avenue N.E. does not meet the minimum standards
necessary to maintain a pleasant and prosperous suburban environment. While
major code requirements are satisfied, the following item does not cc$mply
with the performance standards of the City Code:
1. Four unlicensed (three without plates and one with Minnesota License FFZ
780) on property. These need to be currently licensed/street operable or
removed frau property or stored in an enclosed structure (shed, garage,
etc.)
Your immediate action to correct this situation would be a great improvement
for your property and the entire oQmnunity as well. An inspection will be

Dear Mr. Kowalki:
Last October 10, 1989, you and other neighboring property owners
met with me regarding the possibility of rezoning the property from
M-1, Light Industrial and R-3, General Multiple Dwelling, to C-2,
General Business. The primary concern was whether a contractor's
business would be permitted in the C-2 district. We have reviewed
the ordinance and determined that a contractor's business would be
a permitted use on the property; however, any exterior storage of
materials and equipment would need to receive a special use permit
and be properly screened.
I had promised to follow-up on this question last fall. I
apologize that I have not been able to contact you earlier for this
information. Please be advised that we are not asking you to
rezone or stating that you have to rezone. The intent of our
meeting last October was just to follow-up on the Chopper City
Sports rezoning application that occurred last fall. Should you
wish to apply for a rezoning, please feel free to contact me and
I can review the process with you.
The City Council will be embarking on a City-wide Comprehensive
Plan update process which will evaluate conflicts between existing
land uses and zoning and evaluate future land uses.

In the zoning district where you live, hone occupations are permitted as an
accessory use, provided that certain criteria are met. I have enclosed a copy
of this City Code section for your review.
Recently I received information suggesting that you may be operating a motor
vehicle repair business out of your residence. This type of business does not
meet the criteria for acceptable home occupations as defined in the. Code. If
you are operating such a business, please comply with the City Code by
discontinuing this activity immediately.
In addition, I have received information indicating that you are in violation
of the following Zomig Code regulation for single family residential housing:
1. More than five unrelated persons living in a dwelling unit shall not
constitute a family.
If this is correct, you must take action as soon as possible to comply with the
Code requirement. If there is more than one dwelling unit in the structure and
you are renting a separate dwelling unit to one or more parties, you need to
obtain a City license for rental housing. Please call Deputy Fire Chief Richard
larson at 572-3611 for more information on obtaining a license.

SUBJECT: Complaint Received from Councilmember Schneider
On January 27, 1993, you referred a complaint which had been
received by Councilmember Schneider concerning the property
directly west of 1170 Norton Avenue N.E. On January 29, 1993, I
sent a letter (copy attached) concerning possible operation of an
illegal home occupation and too many unrelated people living in a
single family residence. On February 1, 1993, I sent you a memo
(copy attached) indicating my observations and requesting further
assistance from the complainant in addressing these issues.
Since that time, I have continued to conduct periodic inspections
of the property i -n question. During these inspections, I have not
observed any direct evidence of automobile repair work actually
occurring. However, there are always a number of vehicles on the
site, and they seem to be moved across different portions of the
property. On one occasion, I observed two individuals driving
separate vehicles onto this property and, shortly thereafter,
leaving the property together in one vehicle. While these
observations suggest the possibility of an illegal home occupation,
they would need to be supplemented by additional first-hand
knowledge and testimony provided by the complainant.
Perhaps Councilmember Schneider would like to recontact the
complainant (Mrs. Gray) to determine whether or not she wishes to
pursue this matter further. Should the complainant decide to work
with staff, we could explore this issue further and discuss the
evidence necessary to bring charges in this matter. Without this
assistance, it is quite unlikely that I would be able to consider
pursuing any legal action.
Please let me know if you have any questions or wish to discuss
this further.

Dear Mr. Marcil:
In 1997, the City Council adopted an ordinance declaring gravel driveways a public nuisance.
They were declared a public nuisance for a number of reasons, such as: they can cause
erosion, contaminate soil with oil and other vehicles fluids, and deposit soil and gravel in the
City's storm sewers and detention ponds. When gravel driveways were declared a public
nuisance, the City Council gave property owners five years to have their gravel driveways
paved. The five-year deadline is quickly approaching, which means all gravel driveways within
the City of Fridley must be paved with approved concrete or asphalt by December 31, 2002.
If on December 31, 2002, your driveway hasn't been paved a citation will be issued and filed at
the Anoka County Courthouse. A misdemeanor citation is a criminal offense and is punishable
by up to 90 days in jail and/or a $700 fine.
If you've already paved your driveways, Thank you! Please call me at 763-572-3595, so I can
update our files.
For your convenience, a brochure on the City's loan program has been enclosed. You can use
this loan program to acquire financing for your driveway improvement project. Please call Jim
