CITY OF FRIDLEY Appeals Commission Meeting— Tuesday, August 11,'1981 Page 1 CALL TO ORDER: Chairwoman Gabel called the Appeals Commission Meeting of August 11, 1981, to order at 7:30 p.m. ROLE CALL: Members Present: Patricia Gabel, Jean Gerou, Donald Hippen, Jim Plemel, Alex Barna Others Present: Darrel • C1 ark, City' of' Fridley APPROVE APPEALS COMMISSION MINUTES OF JULY 14, 1981: Chairwoman Gabel noted one correction to be made on Page 7, last paragraph, second line, to read, "addition will not make the current situation any worse. " MOTION by Mr. Barna, seconded by Mrs. Gerou, to approve the minutes of July 14, 1981, as written and corrected. 'UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE MOTION CARRIED',UNANIMOUSLY. 1. REQUEST FOR VARIANCE PURSUANT TO CHAPTER 205.053 (4A) OF THE FRIDLEY CITY CODE, TO REDUCE THE FRONT YARD SETBACK FROM 35 FEET TO 15 FEET TO ALLOW THE CONSTRUC- TION OF A SECOND STORY TO AN EXISTING HOUSE ON LOT 18, AUDITOR'S SUBDIVISION NO. 92, THE SAME BEING 5924 OAKWOOD'MANOR N.E. (Request by Gerald W. Burrow., 1027 - 20th Avenue N.E., Minneapolis, MN 55418). Mrs. Joan Burrow, 1027 - 20th Avenue N.E. and Mr. Gaylord Burrow, 5924 Oakwood Manor, were present. MOTION by Mr. Barna, seconded by Mr. Hippen to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECIARED THE PUBLIC HEARING OPEN AT 7:32 P.M. Chairwcman ,mel read the Staff Report: ADMINISTRATIVE STAFF REPORT 5924 Oakwood Manor N.E. A. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4A, requires a minimum front yard depth of 35 feet. Public purpose served by. this requirement is to provide open space for off-street parking without encroaching on public right of way. It also �- provides for the aesthetic consideration not to reduce the "building line of sight" encroachment into a neighbor's front yard. B. STATED HARDSHIP: "The house was built before the City established the street right of way for Oakwood Marg". Appeals Commission Meeting - August 11, 1981 - Page 2 C. AEKINISTRATIVE STAFF REVIEW: _ The existing dwelling was built in 1156 on top of a basement house which was constructed in the 19401x. When the basement was constructed, the township had planned that Arthur Street would be its access so the -basement was set to face Arthur Street. Then Oakwood Manor was planned, and the village was granted a 20 foot easement off the easterly edge of this lot, putting the house only some 20 feet off the west edge of Oakwood Manor. If this variance is granted, we have no stipulations to suggest, however since there exists a 3 to 5 foot survey overlap in this area, we suggest that the variance be referenced to the existing curb line which is 23 feet away from the existing house. Mr. Clark felt the Staff - f1patt. covered everything pretty well and clarified the overlaps by stating that way back when lots were sold, they were done so by metes and bounds and were not surveyed. He said that when they were finally surveyed, two surveyors would say two different things depending on which way they started from and they would overlap each other in the middle. He stated the Commission should reference the variance to the curb line because they don't know exactly where the lot line is. Mrs. Burrow showed the Cramission the plans for the first and second floor addition. Chairwoman Gabel asked for an explanation of the living situation. Mrs. Burrow said that her and her husband will be living with her father-in-law, Gaylord Burrow, and he will have the upstairs and share meals and the kitchen and explained further that they have a growing family. Chairwoman Gabel asked if they are going to hire a contractor and Mrs. Burrow said they will hire one to do most of the work and that they might do some of the finish work. Chairwoman Gabel asked Mr. Clark if there is?any problem.with the side lot lines, just the -front lot lines and -Mr. Clark said that was correct. Chairwoman Gabel noted that they might possibly want to build a garage in the future and said there would be no problem with that. Mr. Barna asked what the dimensions of the house were and Mrs. Burrow said 30' by 301. Chairwoman_ Gabel asked about the neighbors and Mr. Clark said he talked to a covple of them and they seemed to agree and Mr. Burrow said that he has good neighbors and they all want him to build. Mr. Barna asked if there would be any problems in terms of the foundation and Mr. Clark said he went over the structure with the builder already and there would be no problems. Mrs. Burrow said they would also be fixing up the exterior and they would like to start by the first of September. Mr..Barna felt the addition would bring the house into value alignment with the rest of the neighborhood. Mr. Plemel felt it would be a good addition. MOTION by Mr. Plemel, seconded by Mrs. Gerou, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE PUBLIC HEARING CLOSED AT 7:40 P.M. BUSINESS: Chairwoman Gabel reported that the City Council did uphold the decision on the sign issue from last meeting and that the Council thought that "intersection" Was anywhere traffic intersects. Mr. Clark reported that the Staff interpreted is where any two lanes emerged or conflict and Naegele said it was where they cross each other and Mr. Herrick said it is where two separate streets cross each other. Mr. Barna said an intersection would be Main Street over I694 and I694 over University and Central, but he did not consider that a real intersections that it would be where two lanes of traffic come together. Chairwoman asked if the Commission wanted to address defining intersection and Mr. Barna suggested adding it to the sign code. Chairwoman Gabel suggested that the Commission make some kind of recommendation or check out a definition and look at them at the next meeting. Mr. Clark said the Staff will look into it and felt the definition should*be confined to the sign code. Mr. Barna felt that the Highway Department would have a definition. ADJOURNMENT: MOTION by Mr. Barna, seconded by Mrs. Gercu, to adjourn the meeting.
