NOTICE OF PUBLIC HEARING
Notice is hereby given that the Appeals Commission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, October 15 , 1985 in regard to the
following matter:
Consideration of a variance request pursuant to
Chapter 205 of the Fridley City Code, to reduce
the front yard setback from 35 feet to 19 feet
to allow the construction of a living area
addition on Lots 18 and 19, Auditor's Subdivision
No. 92, the same being 5924 Oakwood Manor.
Notice is hereby given that all persons having an interest therein will be
given the opportunity to be heard at the above time and place.

A. PUBLIC PURPOSE SERVED BY REQUIRE14ENT:
Section 214.12.2B restricts the maximum to eighty (80) square feet in
total free-standing sign area per development.
Public purpose served by this requirement is to control visual pollution
and excessive use of signs in commercial areas.
B. STATED HARDSHIP:
1. The property and building are located at an elevation which is
located so far below the main thoroughfare (Central Avenue) that
visibility is almost nonexistent.
2. Compounding the difference in elevation between the building and
Central Avenue is the fact that the building is tucked into a hill-
side. This fact further reduces visibility from Central Avenue.
3. Wall signs are totally inadequate to provide any identification
from the east, which is where almost all potential customers would
have to enter (via 53rd Avenue).
For the above reasons, a variance fs requested to allow two of the tenants
in this project to install signage on the existing pylon; such signage not
to exceed 40 sq. ft. in total surface area.
C. ADMINISTRATIVE STAFF REVIEW:
A sign hei ht variance was granted for this nvlon sign in February of
this year ?from 25 feet to 35 feet). The Pickwick pylon sign is 80
sq.. ft.; therefore no additional sign area is left for additional signs.
There are wall signs that identify the other two tenant spaces.
Mr. Clark stated the Commissioners had an aerial photo of the area, 41ong with
a picture of the sign. Mr. Brody was proposing to add two more panels below
the existing panel to indicate his two other tenants. When the Pickwick build-
ing was built, it was anticipated there would be one, and possibly two other
tenants. Mr. Brody did bring in a wall sign plan which the City approved,
and he has a Cost Cutters' logo on the front wall facing 53rd and on the west
wall facing Target.
Mr. Brody stated he was the developer of the site and also the owner of the
�roperty. Because of the building's location, it was a very difficult site.
hey took a difficult site and developed a very attractive building; however,
they did not anticipate the hardships the tenants would find once they opened
for business.

neighbor's front yard.

is now our main entrance as the new road was built on the opposite side than
proposed. Entrance is small and not convenient as door from basement and
exterior collide. There is just enough room to turn oneself around in
existing entrance. Furniture, appliances or other large items cannot be
brought into existing entrance of the house or into the basement. The
construction being considered will also allow for additional access for exit
in case of fire, storm, etc. Addition will also allow for better heat
circulation and efficiency. Last, but not least, addition will enhance the
usage of existing square footage and the aesthetics of our home inside and
for the neighborhood."

the City a le ter regarding this disc sion, and he had hoped it would arrive
in time for his Commission meeting. a has not yet received the letter, but

Mr. Clark stated the Commissioners had an aerial photo of the petitioner's
house with the addition sketched in. In 1981, it was a single story house,
and the second story was added after obtaining a variance from the City.
He showed the Commission two pictures of the house with the second story.
Mr. Clark stated originally the house was built with the intention of the city
building Arthur St. to the west of the house. Over a period of years with
houses being built and the school buying the nronerty, the street was switched
from that location to Oakwood Manor, so additional right of way was taken from
this property to make Oakwood Manor. That caused the house to be located the
way it is today. What the petitioner wants to do now is add approximately
3 ft. on to the front to put in a foyer in order to have room between the front
door and the stairway going upstairs so the doors can swing easily.
Mr. Gerald Burrow stated the hardship was self-explanatory. He stated the front
entrance is basically their main entrance. There is very little room to even
turn around, and there is no room to get appliances and furniture through the
existing entrance. The addition will make for a better home.
Mr. Betzold asked if there was any boulevard easement.
Mr. Clark stated that as far as they can determine there is about a 1 ft
boulevard. This addition, if built, would make the house only about 20 ft.
from the curb.
Mr. Burrow stated he has talked to his neighbors and has heard no objections.

Mr. Barna stated it has already been established that the problem was not
caused by the homeowner. The foundation and the house were built before
Oakwood was constructed. The second story exnansion added in 1981 did not
rectify the entry problems. He did not believe the 3 ft. addition on the
front of the house plus the stoop and stairway was going to cause any more
of a visual obstruction than the present situation. He felt the hardship was
satisfied, and he would have no objection to granting the variance.
Mr. Betzold stated this was a situation where neither the City nor the
petitioner looked to the future. He stated they have to makethebest of a bad
situation. He would not have any objection to the variance as requested.
Ms. Gerou stated this was not a self-imposed hardship. When the second story
was added on, it did not change the first floor footprint. The petitioner
does need this 3 feet and she would be in favor of granting the variance.
Mr. Plemel stated he did not think 3 ft. would be noticeable, and there was
no neighborhood objection.

ADMINISTRATIVE STAFF REPORT
5924 Oakwood Manor N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.3D.1 requires a front yard with a depth of not less than
thirty-five (35) feet.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right of way and also for
aesthetic consideration to reduce the building "line of sight" encroach-
ment into the neighbor's front yard.
B. STATED HARDSHIP:
"Home was built in the reverse position. The entrance under consideration
• is now our main entrance as the new road was built on the opposite side
than proposed. Entrance is small and not convenient as door from basement
and exterior collide. There is just enough room to turn oneself around in
existing entrance. Furniture, appliances or other large items cannot be
brought into existing entrance of the house or into the basement. The
construction -being considered will also allow for additional access for
exit in case of fire, storm, etc. Addition°will also allow for better
heat circulation and efficiency. Last, but not least, addition will
enhance the usage of existing square footage and the aesthetics of our
home inside and for the neighborhood."
C. ADMINISTRATIVE STAFF REVIEW:
The petitioner was granted a variance in 1981 for his present 22 foot
setback. He would now loke to add on an additional 3 feet to enlarge the
depth of his front foyer. There is very little boulevard on Oakwood Manor;
approximately 1 foot.
If the Board approves this request, staff has no stipulations to suggest.

Mr. Clark stated the Commissioners had an aerial photo of the petitioner's
house with the addition sketched in. In 1981, it was a single story house,
and the second story was added after obtaining a variance from the City.
He showed the Commission two pictures of the house with the second story.
Mr. Clark stated originally the house was built with the intention of the city
building Arthur St. to the west of the house. Over a period of years with
houses being built and the school buying the property, the street was switched
from that location to Oakwood Manor, so additional right of way was taken from
this property to make Oakwood Manor. That caused the house to be located the
way it is today. What the petitioner wants to do now is add approximately
3 ft. on to the front to put in a foyer in order to have room between the front
door and the stairway going upstairs so the doors can swing easily.
Mr. Gerald Burrow stated the hardship was self-explanatory. He stated the front
entrance is basically their main entrance. There is very little room to even
turn around, and there is no room to get appliances and furniture through the
existing entrance. The addition will make for a better home.
Mr. Betzold asked if there was any boulevard easement.
Mr. Clark stated that as far as they can determine there is about a 1 ft
boulevard. This addition, if built, would make the house only about 20 ft.
from the curb.
Mr. Burrow stated he has talked to his neighbors and has heard no objections.
MOTION BY MR. BARNA, SECONDED BY MS. GEROU, TO CLOSE THE PUBLIC HEARING.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON GABEL DECLARED THE MOTION
CARRIED UNANIMOUSLY.
Mr. Barna stated it has already been established that the problem was not
caused by the homeowner. The foundation and the house were built before
Oakwood was constructed. The second story exnansion added in 1981 did not
rectify the entry problems. He did not believe the 3 ft. addition on the
front.of the house plus the stoop and stairway was going to cause any more
of a visual obstruction than the present situation. He felt the hardship was
satisfied, and he would have no objection to granting the variance.
Mr. Betzold stated this was a situation. where neither the City nor the
petitioner looked to the future. He stated they have to make the best of a bad
situation. He would not have any objection to the variance as requested.
Ms. Gerou stated this was not a self-imposed hardship. When the second story
was added on, it did not change the first floor footprint. The petitioner
does need this 3 feet and she would be in favor of granting the variance.
Mr. Plemel stated he did not think 3 ft. would be noticeafile, and there was
no neighborhood objection.

Ms. Gabel concurred with what had been said by the other commissioners.

ADDITION ON LOTS 18 AND 19, AUDITOR'S SUBDIVISION NO. 92, THE SAME BEING
5924 OAKWOOD MANOR.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON GABEL DECLARED. THE MOTION
