Dear Mr. Erickson: On May 29, 1975 we made a routine inspection of the home being constructed at 1365 Onondaga Street. At the time of inspection, the front sidewalk was formed up and ready for pouring. After inspecting the basement walls it was apparent that there had been movement in the foundation system to the extent of it being out of plumb and alignment. It was called to the masonry contractors attention and a call was made to you bringing it to your attention The major problem appeared to be along the front wall with some signs of stress in the east and north walls as well. Specific instructions were given to you to correct the situation. We were not notified of any correction work being completed. Around the 1st of April the owner called us complaining about the foundation walls, basement floor slab and the garage slab. We went out in response to his call and numerous cracks in the basement floor (far more than normal) were found. The garage slab has settled adjacent to the house foundation to the entent of causing the owner a problem in that water runs towards the house foundation and in the winter time freezes. The front foundation wall appeared to be both out of plumb and was also not straight, the east and west walls were okay, and the north wall appeared to be a little out of plumb. On April 7, 1976 we returned to the house and took measurements to determine to what extent the front and south walls were out of plumb and alignment. Attached is a sketch of the,results which indicates a vertical. deflection of 5/8 inch maximum and a horizontal deflection of 1 3/16 inch. The building code, UBC Section 2312 (a) states: "Walls and structural framing shall be erected true and plumb in accordance with design." Since the Code does not mention how far out of plumb a wall can be before it may be structurally unsound, it leaves us little to go by unless an Mr. Erickson April 15, 1976 Page 2 engineer were to inspect and certify the stability of the wall. The structural report however will only certify its structural stability and this may not satisfy the owner as to its appearance. This aspect of the wall condition will have to be settled with the owner. The basement floor slab as mentioned previously has numerous cracks, of which are about 1/8 inch open. Also the finish is again that you must settle this with the owner. It ispoor and I suggsome est samples should be taken to determine the thickness and strength ssible thaof t core concrete. The garage slab concrete appears to be structurally sound since there are no cracks of substantial nature, however it no doubt has settled near the house foundation wall. He reported that he has not received any response to his complaint with reference to his problems with the house. We have not received any structural report on the structural stability of the south basement wall. The lack of any substantial reaction on your part does disturb us. Would you please contact Mr. Tieden in answer to his complaint and obtain the services of a qualified engineer to substantiate the structural stability of the south wall of the structure. Fridley, Minnesota 55432 Re: 1365 Onandage Dear Mr. Clark: After repeated efforts to get an opinion on the above property, my foreman and myself were finally successful this morning in meeting at the above property with a representative of Oscar Roberts Company, cement contractors. In the opinion of the representative from Oscar Roberts Co. there should be no structural problem as to the stability of the walls and we should be receiving a letter to that effect very shortly. We agreed with the cement contractor that he would go in today and point up the basement walls once more and repair the cracks in concrete where necessary with a Latex cement grout. There does not seem to be any further movements or openings in the crack in the basement floor. The basement walls had previously been straightened and pilaster installed with re - bars both front and back. We have conveyed this information to Mr. Tieden and he seems to be satisfied with the results. Yours truly, Inc.
